HAZARDOUS SITES CLEAN-UP UNDER THE ACT OF OCTOBER 18, 1988
Prospective Purchaser Agreement Settlement under the Comprehensive Environmental Response, Compensation And Liability Act and the Hazardous Sites Cleanup Act The Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6020.101--6020.1305) and the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) (42 U.S.C.A. §§ 9601--9675) among other statutes, has entered into a Prospective Purchaser Agreement with Equity Brokerage, Inc. (EBI) related to the East Tenth Street HSCA Site in Marcus Hook, Delaware County, PA.
Under the terms of the Prospective Purchaser Agreement, EBI will make a contribution towards the Department's response costs at the Site and agrees not to exacerbate any existing contamination attributable to the East Tenth Street Site in exchange for a covenant not to sue and contribution protection from the Department.

Notice of Prompt Interim Response

Huntingdon County, PennsylvaniaThe Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6020.101--6020.1305) has initiated a prompt interim response at Mount Union Creosote Site. This response has been initiated under sections 501(a) and 505(b) of the HSCA (35 P. S. §§ 6020.501(a) and 6020.505(b)). The site is located at Mount Union Borough, Huntingdon County, PA.
The Mount Union Creosote Site (Site) is located in the northeastern section of Mount Union Borough, Huntingdon County. The area of concern is 15.5 acres previously occupied by a creosote treatment plant and its associated features. Former creosote treatment, storage and disposal activities have resulted in the release of hazardous substances. The athletic fields of the Mount Union Area High School are located in the area previously occupied by the south end of the former creosote plant operations and are believed to have been constructed over the area used for drying creosote impregnated railroad ties.
The Department conducted an investigation during July 1999 to assess the impact of former creosote activities on surface soils (less than 2 feet below the ground surface), the bedrock aquifer, and to determine groundwater flow paths and impacts to surface waters and sediments of the Juniata River.
The collection and analysis of surface soil samples throughout the Site indicate a sporadic occurrence of creosote-impacted soils. The chemicals of concern (COCs) are creosote related organic contaminants present above regulatory site-specific standards. The Site COCs are benzo(a)anthracene, benzo(a)pyrene, and benzo(b)fluoran- thene. Analysis of site monitoring wells shows the presence of soil COCs in the shallow groundwater.
To assess the site-specific potential impact of the COCs in the surface soil on the groundwater, a fate and transport analysis of potential leaching was performed and site-specific concentrations were calculated. The calculations indicate that existing groundwater contaminant levels are not currently impacting the Juniata River and will not impact river sediment and surface water in the future.
The Department proposes a prompt interim response at this Site to protect public health and safety or the environment. This determination is based on the potential and actual human exposure to hazardous substances in the shallow soil via inhalation, ingestion and dermal contact.
The Department considered three alternatives: 1. No action, which allows the continued exposure to COCs in the shallow soil. 2. Limited action, which includes implementation of a deed restriction to prevent future intrusive activities at the Site, and prohibit future use of groundwater at the Site. 3. Excavation and disposal of contaminated surface soil, and continued groundwater monitoring.
The Department has chosen to implement specific elements of Alternative 2 and implement Alternative 3. Both comply with applicable, relevant and appropriate requirements (ARARs), will reduce hazardous constituent concentrations below regulatory standards, remove direct contact threats, and are cost effective. These alternatives are protective of human health, safety, welfare and the environment by eliminating the risk from further release of hazardous substances at the Site.
The Department is providing this notice under sections 505(b) and 506(b) of HSCA (35 P. S. §§ 6020.505(b) and 6020.506(b)), and the publication of this notice starts the administrative record period under HSCA. The Administrative Record which contains information about this site and which supports the Department's decision to perform this action at the site is available for public review and comment. The Administrative Record can be examined from 8 a.m. to 4 p.m. at the Department's Southcentral Regional Office located at 909 Elmerton Avenue, Harrisburg, PA 17110, by contacting Crystal Snook at (717) 705-6645. The Administrative Record can also be reviewed at the Mount Union Public Library, Mount Union, PA.
The Administrative record will be open for comment from the date of publication of this notice in the Pennsylvania Bulletin and will remain open for 90 days. Settlement Under the Comprehensive Environmental Response, Compensation and Liability Act and the Hazardous Sites Cleanup Act
North Front Associates/Container Recyclers Site, Philadelphia County The Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6020.101--6020.1305) and the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) (42 U.S.C.A. §§ 9601--9675), has entered into a proposed settlement with William H. Cooper's Sons, Inc., concerning the cleanup of the North Front Associates (former Container Recyclers Ltd.) site in Philadelphia County, PA. Under the terms of the proposed Consent Decree, William H. Cooper's Sons, Inc. will pay into the Pennsylvania Hazardous Sites Cleanup Fund the sum of $10,600 in three installments. In the mid 1990's the Department implemented an Interim Response and a Prompt Interim Response to mitigate the threat to human health and the environment posed by the hazardous substances released there.
The specific terms of this settlement are set forth in the proposed Consent Decree between the Department and William H. Cooper's Sons, Inc. The Department will receive and consider comments relating to the proposed Consent Decree for 60 days from the date of this Public Notice. The Department has the right to withdraw its consent to the proposed Consent Decree if the comments concerning the proposed Consent Decree disclose facts or considerations which indicate that the proposed Consent Decree is inappropriate, improper, or not in the public interest. After the public comment period, the Department's settlement with William H. Cooper's Sons, Inc. shall be effective on the date which, if the Department has notified the United State District Court for the Eastern District of Pennsylvania in writing that no significant comments were received or that a response to significant written comments has been filed, the Court issues an Order entering the Consent Decree.

The following final reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).
Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (Act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the Act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed, and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected.

The applicant is seeking to attain a combination of the Statewide Health and Site-Specific standards for site soils, groundwater and sediment contaminated with PCBs, lead, heavy metals, solvents, BTEX, PHCs and PAHs.
Thomas Nardi Residence, Lower Paxton Township, Dauphin County. Marshall Miller & Associates, 3913 Hartzdale Drive, Suite 1306, on behalf of Thomas Nardi, 2219 Blue Mountain Parkway, Linglestown, PA 17112 AND Kreiser Fuel Service, Inc., RD 3, Box 7065, Jonestown, PA 17038, submitted a Final Report concerning remediation of site soils contaminated with BTEX and PAHs. The report is intended to document remediation of the site to the Statewide Health standard.
Northwest Region: Environmental Cleanup Program Manager, 230 Chestnut Street, Meadville, PA 16335-3481.
Stackpole Center, Northeast Area, 210 Stackpole St., St. Marys, PA 15857, Elk County. Hydrosystems Management Inc. has submitted a Remedial Investigation Report concerning the remediation of Stackpole Center, Northeast Area contaminated with PCBs, lead, heavy metals, BTEX, PHCs, PAHs and solvents. The Remedial Investigation Report demonstrated attainment of site specific standards and was approved by the Department July 2, 2002.

Provisions of 25 Pa. Code § 250.8 (relating to publication), Administration of the Land Recycling and Environmental Remediation Standards Act (act) requires the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. Plans and reports required by provisions of the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media; benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. A cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or non-residential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

PAD075485995. Rohm & Haas Co., P. O. Box 904, Spring House, PA 19477, Lower Gwynedd Township, Montgomery County. Permittee has chosen not to renew Part B permit and will conduct all hazardous waste storage operations under generator accumulation standards. Permit has expired. Certifications have been accepted for clean closure and bond release processed on August 20, 2002.
OPERATE WASTE PROCESSING OR DISPOSAL AREA OR SITE
Permits Issued under the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003), the Municipal Waste Planning, Recycling and Waste Reduction Act (53 P. S. §§ 4000.101--4000.1904) and Regulations to Operate Solid Waste Processing or Disposal Area or Site.
Southeast Region: Regional Solid Waste Manager, Lee Park, Suite 6010, 555 North Lane, Conshohocken, PA 19428.
Permit No. 300852. Stanley G. Flagg & Co. Inc., 1020 W High St, Stowe, PA 19464-6800, Borough of Pottstown, Montgomery County. Permit is for modifications to the residual waste landfill closure plan to implement remedial activities to address the improper closure of the landfill. The Borough of Pottstown objects to the removal of the fencing around the entire Flagg site. The Department is approving Flagg's proposal to remove most of the fencing once the closure remediation is completed. The landfill facility is only a portion of the overall site property and the Department does not have jurisdiction to require security for other than the landfill facility itself. Also, Flagg's proposed security measures for the closed landfill are considered adequate. Should they not prove to be so, Flagg or any future permittee remains responsible for any necessary upgrades or repairs. The permit was modified by the Southeast Regional Office on August 20, 2002.
Northcentral Region: Regional Solid Waste Manager, 208 West Third Street, Williamsport, PA 17701.
Permit No. 101201. Northern Tier Solid Waste Authority, P. O. Box 10, Burlington PA 18814-0010, for the Construction/Demolition Waste Landfill located in Hamilton Township, Tioga County. Implementation of the Radiation Protection Action Plan. The permit modification was issued by the Williamsport Regional Office on August 16, 2002.
Permit No. 101578. Northern Tier Solid Waste Authority, P. O. Box 10, Burlington PA 18814-0010, for the Tioga County Transfer Station located in Hamilton Township, Tioga County. Implementation of the Radiation Protection Action Plan. The permit modification was issued by the Williamsport Regional Office on August 16, 2002.
Permit No. 100955. Clinton County Solid Waste Authority, P. O. Box 209, McElhattan PA 17748-0209, for the Wayne Township Landfill located in Wayne Township, Clinton County. Implementation of the Radiation Protection Action Plan. The permit modification was issued by the Williamsport Regional Office on August 16, 2002.
