Tentative Orders

   The Law Bureau Prosecutory Staff of the Pennsylvania Public Utility Commission (Commission) has developed a list of 51 telecommunications carriers that have failed to respond to their annual assessment reports. Prosecutory Staff has confirmed that for all of the companies on the following list the phone number is disconnected or is no longer in service and that there is no information available for any new phone number or address. The carriers have failed in their responsibility to keep the Commission informed of any address or phone number.

   Therefore, the Commission ordered that the Secretary publish a copy of the tentative orders which revoke the companies' certificates after a 20-day comment period, absent adverse comment. At the end of that time period, the tentative orders will become final. A representative order follows.

Tentative Order

By the Commission:

   Call Technology Corporation (Call) has failed to respond to the annual assessment report sent by the Fiscal Office pursuant to section 520(b) of the Public Code (66 Pa.C.S. § 520(b)). Telephone calls to the last known business address of Call confirmed that the number is disconnected and no information is available for any new phone number. At this point, there is no reasonable means to reach the company, and it has failed in its responsibility to notify the Commission of any address or phone number changes.

   Call, an interexchange reseller, was granted a certificate of public convenience by the Commission on July 27, 1993, at A-310055. Based on the findings of the Prosecutory Staff, we believe that it is appropriate to revoke Call's certificate of public convenience without the necessity of first filing a formal complaint. For these reasons, we tentatively conclude that revocation of Call's certificate of public convenience pursuant to 66 Pa.C.S. § 1102(a)(2) will not be detrimental to the public interest; Therefore,

   It is Ordered That:

   1.  Revocation of Call Technology Corporation's certificate of public convenience is hereby tentatively approved as being in the public interest.

   2.  A copy of this Tentative Order be published in the Pennsylvania Bulletin giving all persons having an interest in this proceeding 20 days from the date of publication to file a written response.

   3.  Absent the filing of adverse public comment within 20 days after publication in the Pennsylvania Bulletin, this Tentative Order shall become final without further order of this Commission.

   4.  Upon this order becoming final and without further action by the Commission, the certificate of public convenience held by Call Technology Corporation at A-310055 shall be cancelled and the company's name stricken from all active utility lists maintained by the Tariff and Annual Report Section of the Commission's Bureau of Fixed Utility Services and the Assessment Section of the Bureau of Administrative Services.

   5.  A copy of this Order be served upon the Office of Consumer Advocate, the Office of Small Business Advocate, the Office of Trial Staff and the Attorney General's Bureau of Consumer Protection.
