   The Department of Environmental Protection has taken the following actions on applications received under the Safe Drinking Water Act for the construction, substantial modification or operation of a public water system.

   Plan Description: The Plan calls for the construction of a new low-pressure wastewater collection system to serve the Borough of Penn Lake Park. Wastewater will be conveyed to the Suburban Wastewater Company's (aka Little Washington Wastewater Company) Wastewater Treatment Facility, located in the Borough of White Haven, for ultimate treatment and discharge. The wastewater conveyance system will consist of a pump station and approximately 11,000 feet of 4-inch force main. The selected wastewater disposal alternative is described in the Plan as Alternative No. 1. Implementation of the selected alternative and operation of the proposed facilities will be performed by the Suburban Wastewater Company.

   Financing of the wastewater collection and conveyance systems is to be provided by the Pennsylvania Infrastructure Investment Authority.

   Implementation of the selected wastewater disposal alternative will require a Water Management Part II Permit for the construction and operation of the proposed sewage facilities. Other departmental permits may be required for construction if encroachment to streams or wetlands will result. The Department's review has also not identified significant environmental impacts resulting from this proposal.

This project expands the scope of previously approved planning in Granville Township. HAZARDOUS SITES CLEANUP ACT UNDER THE ACT OF OCTOBER 18, 1988

Notice of Proposed Remedial Response

Adams Sanitation Company, Inc. Landfill Site, Tyrone Township, Adams County

   The Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6020.102--6020.1303), is proposing a remedial response at the Adams Sanitation Company, Inc. Landfill Site (Site) in Tyrone Township, Adams County.

   The Site is located along Cranberry Road near Aspers in Tyrone Township, Adams County. The site can be found on the United States Geological Survey Biglerville, PA quadrangle map at 39°58`41" north latitude and 77°11`34" west longitude.

   The Site is located on a farm property consisting of approximately 108 acres. During different time periods, municipal and residual wastes were land filled in 3 areas. The land-filled areas comprise approximately 24 acres. Two landfill areas are located north of Cranberry Road and south of Cranberry Road. Wooded areas surround the site on all sides and lands beyond the wooded areas are mostly fruit orchards. Land filling activities ceased in 1990.

   Site characterization studies by the Department identified local groundwater contamination as a result of land filling operations at the Site. VOCs exist at levels above the Land Recycling and Environmental Remediation Standards Act and 25 Pa. Code Chapter 250 medium-specific concentrations (MSCs). VOCs detected above MSCs include benzene, vinyl chloride, dichloromethane (methylene chloride), 1,1-dichloroethane (1,1-DCA), 1,2-dichloroethylene (1,2-DCE), methyl ethyl ketone (2-butanone), tetrachloroethylene (PCE) and trichloroethylene (TCE). These chemicals include known, probable and possible human carcinogens. Also, benzene, vinyl chloride, PCE and TCE has been detected in leachate seeps above surface water quality human health criteria regulatory standards. Vinyl chloride, PCE and TCE has been detected in untreated water in both the former and current domestic water supplies serving the onsite residents.

   The proposed remedial response will provide final closure for the Site and reduce the threats to human health and the environment posed by the site. The Department is required to perform a remedial action when the response exceeds $2 million in cost or requires longer than 1 year to complete.

   The Department's selected response will include a synthetic cap over waste in the land filled areas north of Cranberry Road. This is in accordance with Commonwealth regulations governing municipal waste landfills. Groundwater modeling has shown that preventing surface water infiltration will be more effective in reducing groundwater contamination levels over a 20-year period than a groundwater pump-and-treat system with a 30-year net worth cost savings of approximately $2 million dollars. Groundwater modeling indicates that no offsite water supplies will be impacted. Under these circumstances, the Department does not feel that the extra cost of a groundwater treatment system is justified.

   In addition to the synthetic cap, an active/combustor gas vent component will be constructed to collect methane gas that currently exceeds allowable levels at locations along the site boundary and VOCs present throughout the land filled areas located north of Cranberry Road. This component will collect and destroy gases instead of just releasing them to the atmosphere.

   Since the landfill cap will prevent precipitation, the existing leachate production will dry up and without new contaminants being added to the groundwater, the existing groundwater contamination will decrease. Therefore, collection and aeration treatment of leachate will be performed until leachate production ceases. Contaminated spring discharges will undergo treatment by natural attenuation in the pond situated near the onsite residents' home. The oldest landfill area south of Cranberry Road is presently overgrown with mature trees and does not contribute significant levels of contaminants to the groundwater. Although this area is not part of the remedial construction activities, it will be monitored as part of the on-going ground water sampling program.

   The Department is providing this notice under sections 505(b) and 506(b) of the HSCA (35 P. S. §§ 6020.505(b) and 6020.506(b)) and the publication of this notice starts the administrative record period under the HSCA. The Administrative Record which contains information about this Site and which supports the Department's decision to perform this action at the Site is available for public review and comment. The Administrative Record can be examined from 8 a.m. to 4 p.m. at the Department's Southcentral Regional Office, 909 Elmerton Avenue, Harrisburg, PA 17110 by contacting Jeff Silar at (717) 705-4842. The Administrative Record can also be reviewed at the Adams County Public Library, 140 Baltimore Street, Gettysburg, PA during normal operating hours by contacting the Adams County Public Library at (717) 334-5716.

   The Administrative Record will be open for comment from the date of publication of this notice in the Pennsylvania Bulletin and will remain open for 90 days. Persons may submit written comments regarding this action to the Department before February 7, 2003, by mailing them to Jeff Silar at the previous address.

   The public will have an opportunity to present oral comments regarding the proposed action at a public hearing. The hearing has been scheduled for December 10, 2002, at 7 p.m. at the Tyrone Township Municipal Building, 5280 Old Harrisburg Road, York Springs, PA. Persons wishing to present formal oral comment at the hearing should register before 4 p.m. on December 4, 2002, by contacting Sandra Roderick at (717) 705-4931.

   If no person registers to present oral comments by December 4, 2002, the hearing will not be held, but will be replaced with an informational meeting. LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995

The following final reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (Act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site where one of the Act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected.

   For further information concerning the final report, contact the Environmental Cleanup Program Manager in the Department Regional Office under which the notice of receipt of a final report appears. If information concerning a final report is required in an alternative form, contact the Community Relations Coordinator at the appropriate Regional Office listed. ENSR Corporation, 2005 Cabot Boulevard West, Suite 100, Langhorne, PA 19047, on behalf of BOC Gases, 575 Mountain Avenue, Murray Hill, NJ 07974, submitted a Final Report concerning remediation of site soils and groundwater contaminated with Fuel Oil No. 2 and PAHs. The report is intended to document remediation of the site to the Statewide Health Standard.

   Lear Corporation, formerly Masland Industries, Granville Township, Mifflin County. Montgomery Watson Harza, 335 Phoenixville Pike, Malvern, PA 19355, on behalf of Lear Corporation, 21557 Telegraph Road, P. O. Box 5008, Southfield, MI 48086-5008, submitted a Final Report concerning remediation of site soils and groundwater contaminated with solvents. The report is intended to document remediation of the site to the Statewide Health Standard.

   Ruba Horner Residence, Conewago Township, Adams County. Alliance Environmental Services, Inc., 1414 North Cameron Street, Suite B, Harrisburg, PA 17103, on behalf of Ruba Horner, 4738 East Flower Circle, Mesa, AZ 85206 and Dan Wisotzkey, 3311 Honey Run Drive, York, PA 17404-9443, has submitted a combined remedial investigation and final report concerning remediation of site soils and groundwater contaminated with No. 2 fuel oil. The report is intended to document remediation of the site to a combination of the Statewide Health and Site-Specific Standards. LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995

PREAMBLE 3


The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of 25 Pa. Code § 250.8, Administration of the Land Recycling and Environmental Remediation Standards Act (Act) requires the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the Act. Plans and reports required by provisions of the Act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media; benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. A cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

   For further information concerning the plans and reports, contact the Environmental Cleanup Program Manager in the Department Regional Office under which the notice of the plan or report appears. If information concerning a final report is required in an alternative form, contact the Community Relations Coordinator at the appropriate Regional Office listed.    The Department has received the following final reports:

   Duff Residence, Upper Southampton Township, Bucks County. Eric Rosina, Storb Environmental, Inc., 410 N. Easton Rd., Willow Grove, PA 19090-2511, on behalf of Edward Duff, 2100 Byberry Rd., Huntingdon Valley, PA 19006, has submitted a Final Report concerning the remediation of site soil and groundwater contaminated with Fuel Oil No. 2. The Final report demonstrated attainment of the Statewide Health Standard and was approved by the Department on September 25, 2002.

   Swedeland Road Substation Property--PECO Energy, Upper Merion Township, Montgomery County. Jennifer Sowers, PECO Energy Co., 300 Front St., Bldg. 1, West Conshohocken, PA 19428, on behalf of PECO/Exelon, 2301 Market St., Philadelphia, PA 19101, has submitted a Remedial Investigation Report/Cleanup Plan concerning remediation of site soil and groundwater contaminated with heavy metals, BTEX, PAH, VOC and SVOC. The combined report was approved by the Department on October 10, 2002.

   Rahns Specialty Metals, Inc., Perkiomen Township, Montgomery County. Andrew P. Foster, Drinker, Biddle & Reath, LLP, One Logan Sq., 189th and Cherry Sts., Philadelphia, PA 19103 on behalf of Rahns Specialty Metals, Inc., Route 113, Rahns, PA 19426, has submitted a Remedial Investigation/Final Report concerning the remediation of site soil and groundwater contaminated with solvents. The report demonstrated attainment of Statewide Health and Site-Specific Standards and was approved by the Department on October 17, 2002.

   Scholler, Inc., City of Philadelphia, Philadelphia County. Craig Herr, RT Environmental Services, Inc., 215 W. Church Rd., King of Prussia, PA 19406, on behalf of Peter Young, 2330 Collins St., Philadelphia, PA 19134, has submitted a combined Remedial Investigation/Final Report concerning remediation of site soil and groundwater contaminated with No. 2, 4 and 6 fuel oil. The combined report demonstrated attainment of Site-Specific Standards and was approved by the Department on October 28, 2002.

   Southcentral Region: Environmental Cleanup Program Manager, 909 Elmerton Avenue, Harrisburg, PA 17110.

   Tyco Electronics Corporation, Swatara Township, Dauphin County. Science Applications Internation Corporation, 6310 Allentown Boulevard, Harrisburg, PA 17112, on behalf of TecPort Partners, L. P., 3555 Washington Road, McMurray, PA 15317, submitted a remedial investigation report concerning the remediation of site soils and groundwater contaminated with BTEX and PAHs. The applicant is seeking attainment of a Site-Specific Standard. The remedial investigation report was approved by the Department on October 25, 2002.

   Northwest Region: Environmental Cleanup Program Manager, 230 Chestnut Street, Meadville, PA 16335-3481.

These reports, submitted in partial fulfillment of the requirements of the Site-Specific Standard, were disapproved by the Department on October 28, 2002.

   Persons wishing to comment on the proposed action are invited to submit a statement to the Regional Office indicated as the office responsible, within 45 days from the date of this public notice. Comments received within this 45-day period will be considered in the formulation of the final determination regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Regional Office of the exact basis of any comment and the relevant facts upon which it is based. A public hearing may be held if the Regional Office considers the public response significant.

   Following the 45-day comment period and/or public hearing, the Department will make a final determination. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.
