SETTLEMENT UNDER THE COMPREHENSIVE ENVIRONMENTAL RESPONSE, COMPENSATION AND LIABILITY ACT AND THE HAZARDOUS SITES CLEANUP ACT
Reading Industrial Scrap Company Site, Berks County The Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6020.101--6020.1305) and the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) (42 U.S.C.A. §§ 9601--9675), has entered into a proposed settlement with certain De Minimis Responsible Parties (Settlor).
The proposed settlement resolves claims of the Department with the Settlor under the HSCA, CERCLA and other applicable law for potential repose costs for remediation of the former Reading Industrial Scrap Company Site (Site) located in the City of Reading and Muhlenberg Township, Berks County. The Settlor purchased the property in the spring of 2002. Prior to the Settlor acquiring the Site, solid waste, including waste alleged to include ''hazardous substances'' within the meaning of section 101(14) of CERCLA (42 U.S.C.A. § 9601(14)) and section 103 of the HSCA (35 P. S. § 6020.103), were disposed at the Site.
The proposed settlement obligates the Settlor to remit $500 to the Department. The Department believes that the proposed settlement is fair, reasonable, practicable, in the public interest and in furtherance of the statutory goals of the HSCA and CERCLA.
For a period of 60 days, beginning with the December 21, 2002, publication date of this notice in the Pennsylvania Bulletin, the public is invited to review the Consent Order and Agreement (COA) memorializing the settlement, Monday through Friday, from 8 a.m. to 4 p.m. at the Department's Southcentral Regional Office, 909 Elmerton Avenue, Harrisburg, PA 17110 by contacting Pamela Trowbridge at (717) 705-4706. The COA can also be reviewed at the Southcentral Region's Reading District Office, 1005 Cross Roads Boulevard, Reading, PA 19605, (610) 916-0100.
After review, the public may submit written comments on the COA before February 18, 2003, by mailing them to Pamela Trowbridge at the Department's Harrisburg Office at the previous address. A person adversely affected by the settlement may also file an appeal from the COA to the Environmental Hearing Board.

N/A The primary pollutant source for the watershed is abandoned mine workings. This watershed was heavily mined for coal in the late 19th through 20th centuries. The effects of this are still present. All of the allocations made in the TMDL are LA, which are made to nonpoint sources of pollution.
The proposed TMDL was developed using MCS to determine long-term average concentrations that each stream segment could accept and still meet water quality criteria 99% of the time. MCS allows for the expansion of a data set based on its statistical makeup. Since there was no critical flow condition where criteria were exceeded, the Department used the average flow to express the loading values in the proposed TMDL. The proposed TMDL for the Bear Loop Run Watershed sets allowable loading rates for metals and acidity at specified points in the watershed. Field data collected over the past 10 years was used to establish the proposed TMDL for the Bear Loop Run Watershed. The data and all supporting information used to develop the proposed TMDL are available from the Department.
The Department will accept written comments on the proposed TMDL for the Bear Loop Run Watershed.
