COAL AND NONCOAL MINING ACTIVITY APPLICATIONS Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); and The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). Mining activity permits issued in response to the applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P. S. §§ 4001--4015); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003).
The following permit applications to conduct mining activities have been received by the Department of Environmental Protection (Department). A copy of the application is available for inspection at the District Mining Office indicated before each application. Where a 401 Water Quality Certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for certification.
Written comments, objections or requests for informal conferences on applications may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34 (relating to public notices of filing of permit applications, opportunity for comment and informal conferences).
Where any of the mining activities listed will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. NPDES permits will contain, at a minimum, technology-based effluent limitations as identified in this notice for the respective coal and noncoal applications. In addition to the previous, more restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit, when necessary, for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the previously-mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.
Written comments or objections should contain the name, address and telephone number of persons submitting comments or objections; application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor; application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.
Coal Applications Received
Effluent Limits--The following coal mining applications that include an NPDES permit application will be subject to, at a minimum, the following technology-based effluent limitations for discharges of wastewater to streams:

FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401 The following permit applications and requests for Environmental Assessment approval and requests for Water Quality Certification have been received by the Department of Environmental Protection (Department). Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341(a)), requires the State to certify that the involved projects will not violate the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) as well as relevant State requirements. Initial requests for 401 Water Quality Certification will be published concurrently with the permit application. Persons objecting to approval of a request for certification under section 401 or to the issuance of a Dam Permit or Water Obstruction and Encroachment Permit, or the approval of an Environmental Assessment must submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before the application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.
The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on each working day at the office noted before the application.

The applicant proposes to remove the existing structure and to construct and maintain a 70.0-foot long precast concrete box culvert having an 18.0-foot wide by 8.0-foot high waterway opening in Zimmer Run on SR 3025, Section 021, Segment 0020, Offset 0000 approximately 0.3 mile northeast of the intersection of U. S. Route 19 and SR 3025 (Krider Road). Zimmer Run is a perennial stream classified as a WWF. The project proposes to directly affect 70 linear feet of stream channel.

To conduct the following activities associated with construction of the Presque Isle Downs horseracing facility south of I-90 east of SR 97:
1. To fill a total of 8.61 acres of 24 nonexceptional value wetland areas. Project includes the creation of a total of 10.56 acres of replacement wetlands at five areas within the project site.
2. To construct and maintain a prefabricated steel truss bridge having three 116.67-foot spans and a maximum underclearance of 23 feet across Walnut Creek (WWF-MF) approximately 3,000 feet upstream of SR 97.
3. To construct and maintain a prefabricated steel truss bridge having two 125-foot spans and a maximum underclearance of 15 feet across Walnut Creek approximately 4,800 feet upstream of SR 97.
4. To impact a total of approximately 11,808 feet of tributaries to Walnut Creek and elimination of approximately 12.1 acres of floodplain storage as a result of grading and fills associated with site construction, stormwater detention and wetland replacement. Approximately 1,576 feet of new open channel will be created near the north end of the site as part of the relocation of a tributary to Walnut Creek, restoration of approximately 1.79 acres of previously impacted floodplain of Walnut Creek, excavation to provide 11.8 acres of additional floodplain storage and construction of stream bank enhancement at nine locations along Walnut Creek.
5. To construct and maintain a 350-foot long reinforced concrete box stream enclosure having two 12-foot wide by 6-foot high waterway openings in the relocated tributary to Walnut Creek approximately 780 feet upstream of its mouth.
6. To construct and maintain a 249-foot long reinforced concrete box stream enclosure having two 12-foot wide by 6-foot high waterway openings in the relocated tributary to Walnut Creek approximately 175 feet downstream of the existing railroad line.
7. To modify and maintain the existing 50-foot long, 60-inch diameter steel culvert in a tributary to Walnut Creek on Footemill Road approximately 750 feet north of Robison Road.
8. To construct and maintain five stormwater outfalls to Walnut Creek and adjoining wetlands.
9. To fill an approximately 0.58 acre manmade pond at the northern end of the site.
10. To install and maintain sanitary sewer and water lines across Walnut Creek attached to the northern bridge.
11. To install and maintain a sanitary sewer line across a tributary to Walnut Creek on the southern end of the site.

To modify and maintain a total of approximately 600 feet of the channel of a tributary to Wolf Creek to provide flood capacity and erosion protection along the north side of East Water Street between SR 258 and SR 173. Project includes additional remediation to stabilize approximately 550 feet of channel previously modified without a permit and to realign and stabilize an additional 50 feet of channel including riprap, vegetative stabilization, rock vanes and guide rail and fence installation.

Project proposes to breach and remove Stack Pond Dam across a tributary to Susquehanna River (WWF) for the purpose of eliminating a liability to the owner and restoring the stream to a free flowing condition. The dam is located approximately 2,400 feet southwest of the intersection of Ulster Road (SR 4004) and T651 (Ulster, PA Quadrangle N: 17.9 inches; W: 4.5 inches).

Description of Proposed Action/Activity: The issuance of a permit authorizing the construction (and operation of) to upgrade 3 existing sewage pump stations, 13,000 LF of 8-inch gravity sewers, 38 individual grinder pump stations and 10,000 LF of 1.5- to 3.0-inch low pressure sewer to serve the northwestern portion of Morris Township and an adjacent area in Graham Township. The existing treatment plant serving the West Branch Area School will be abandoned. Treatment will be provided at the Moshannon Valley Regional Wastewater Treatment Facility, which discharges to the Moshannon Creek at Philipsburg.

NPDES Permit No. PA0025968, Sewage, Aliquippa Municipal Water Authority, 160 Hopewell Avenue, Aliquippa, PA 15001-3545 is authorized to discharge from a facility located at Aliquippa STP, Aliquippa Borough, Beaver County to receiving waters named Ohio River.
This notice reflects changes from the notice published at 33 Pa.B. 767 (February 8, 2003). The following stormwater outfall was added during the draft permit stage to comply with the EPA's Phase II stormwater permit requirements.
Outfall 101, which discharges to the receiving waters known as Ohio River from Outfall 001, serves as a stormwater discharge from areas in and around the treatment plant. There are at this time no effluent limitations on the outfall. This discharge must meet the stormwater discharge requirements in Part C of the NPDES permit.
NPDES Permit No. PA0026778, Sewage, Windber Area Authority, 1700 Stockholm Avenue, Windber, PA 15963 is authorized to discharge from a facility located at Ingleside Sewage Treatment Plant, Richland Township, Cambria County to receiving waters named unnamed tributary of Stony Creek and Stony Creek.
NPDES Permit No. PA0028801, Sewage, Moon Township Municipal Authority, 1700 Beaver Grade Road, Suite 101, Moon Township, PA 15108 is authorized to discharge from a facility located at Montour Run Water Pollution Control Plant, Moon Township, Allegheny County to receiving waters named Ohio River Back Channel.
This notice reflects changes from the notice published at 33 Pa.B. 768 (February 8, 2003). The following stormwater outfalls were added during the draft permit stage to comply with the EPA's Phase II stormwater permit requirements.
