STATE CONTRACTS INFORMATION
DEPARTMENT OF GENERAL SERVICES
Act 266 of 1982 provides for the payment of interest penalties on certain invoices of "qualified small business concerns". The penalties apply to invoices for goods or services when payments are not made by the required payment date or within a 15 day grace period thereafter.
Act 1984-196 redefined a "qualified small business concern" as any independently owned and operated, for-profit business concern employing 100 or fewer employees. See 4 Pa.Code § 2.32. The business must include the following statement on every invoice submitted to the Commonwealth: "(name of business) is a qualified small business concern as defined in 4 Pa. Code 2.32."
A business is eligible for payments when the required payment is the latest of:
The payment date specified in the contract.
30 days after the later of the receipt of a proper invoice or receipt of goods or services.
The net payment date stated on the business' invoice.
A 15-day grace period after the required payment date is provided to the Commonwealth by the Act.

The principal items of work and approximate quantities include utility relocation, 45,179 c.y. earthwork, 700 h.l.f. coal seam drilling and 618 c.y. mine stabilization grouting for mine stabilization/seals and exposed coal protection, AMD collection system, AMD/stormwater collection system, installation of pre-cast concrete retaining wall panels including soldier piles and lagging and 1,000 s.y. rock face support system. BOGM 02-29 Cleaning Out And Plugging Seventeen (17) Abandoned Oil Wells, (Oil Creek State Park Property). The principal items of work and approximate quantities include: clean out and plug seventeen (17) abandoned oil wells, prepare and restore well sites, and mobilize and demobilize plugging equipment. Wells are estimated to be between 300-800 feet in depth and the estimated plugging time is 5 to 10 working days per well. RFP 12-02 The Commonwealth is seeking a single-source contractor who will operate the Electronic Benefits Transfer system (EBT) for five years, with two one-year extensions. The contractor is expected to provide recipients with access to cash assistance and food stamp benefits through automated teller machines (ATM's) and point-of-sale (POS) devices by means of their Pennsylvania ACCESS cards. In addition, Pennsylvania EBT cardholders shall have ATM and POS access to both cash and food stamp benefits nationwide as a result of the FNS interim rule on interoperability published August 15, 2000. The contractor will purchase, install and maintain the necessary hardware for the implementation and operation of a Statewide EBT system. This will include the central EBT processing and backup units, POS terminals and peripheral equipment, an Audio Response Unit (ARU), card encoding equipment, and the administrative workstations and card printers. The prime contractor may use subcontractors for the provision of EBT services. This includes the ARU for recipients and retailers, as well as private vendors for the installation and maintenance of EBT-only POS terminals and the card production equipment.
