COAL AND NONCOAL MINING ACTIVITY APPLICATIONS

   Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); and The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). Mining activity permits issued in response to the applications will also address the applicable permitting requirements of the following statutes:  the Air Pollution Control Act (35 P. S. §§ 4001--4015); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003).

   The following permit applications to conduct mining activities have been received by the Department of Environmental Protection (Department). A copy of the application is available for inspection at the District Mining Office indicated before each application. Where a 401 Water Quality Certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for certification.

   Written comments, or objections, or requests for informal conferences on applications may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34 (relating to public notices of filing of permit applications, opportunity for comment and informal conferences).

   Where any of the mining activities listed will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. NPDES permits will contain, at a minimum, technology-based effluent limitations as identified in this notice for the respective coal and noncoal applications. In addition to the previous, more restrictive effluent limitations, restrictions on discharge volume, or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit, when necessary, for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the previously-mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.

   Written comments, or objections should contain the name, address and telephone number of persons submitting comments, or objections; application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor; application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

   The following permit applications and requests for Environmental Assessment approval and requests for Water Quality Certification have been received by the Department of Environmental Protection (Department). Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U. S.C.A. § 1341(a)), requires the State to certify that the involved projects will not violate the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U. S.C.A. §§ 1311--1313, 1316 and 1317) as well as relevant State requirements. Initial requests for 401 Water Quality Certification will be published concurrently with the permit application. Persons objecting to approval of a request for certification under section 401 or to the issuance of a Dam Permit or Water Obstruction and Encroachment Permit, or the approval of an Environmental Assessment must submit any comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before the application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments, or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

   The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between of 8 a.m. and 4 p.m. on each working day at the office noted before the application.

WATER OBSTRUCTIONS AND ENCROACHMENTS

   Southeast Region:  Water Management Program Manager, Lee Park, Suite 6010, 555 North Lane, Conshohocken, PA 19428.

   E23-432. Department of Transportation, 7000 Geerdes Boulevard, King of Prussia, PA 19406, Thornbury Township, Delaware County, ACOE Philadelphia District.

   To perform the following activities associated with a culvert modification:

   1.  To place and maintain fill material in the assumed floodway of an unnamed tributary to Chester Creek (TSF) for the purpose of raising the roadway to an elevation to a level so that Chester Creek Road will not become inundated during large storm events.

   2.  To construct and maintain a riprap lined outfall channel draining to the Chester Creek.

   3.  To place six 54-inch RCP culverts through the approach fill to improve floodplain flow and to alleviate the backwater conditions.

   The project will impact approximately 25 linear feet of watercourse. The site is located 300 feet east of the intersection of Tanguy Road and Creek Road (West Chester, PA Quadrangle N:  10.6 inches; W:  2.5 inches).

   E09-850. Department of Transportation, District 6, 7000 Geerdes Boulevard, King of Prussia, PA 19406, Hilltown Township, Bucks County, ACOE Philadelphia District.

   The applicant proposes the following water obstructions and encroachments associated with the road widening and traffic improvements to facilitate access to a proposed Wawa Food Market.

   1.  To relocate 155 linear feet of the eastern unnamed tributary by extending an existing 48 inch RCP stream enclosure downstream connecting to an existing 72 inch stream enclosure, which conveys Mill Creek under Souderton Road, then place fill the abandoned channel.

   2.  The eastern enclosure consists of 12 linear feet of 48 inch RCP and 149 linear feet of 54 inch RCP that starts at manhole cleanout SW23, includes inlet manhole cleanout SW2 and joins the existing structure at inlet manhole cleanout SW1.

   3.  To relocate 130 linear feet of the western unnamed tributary by extending an existing 72 inch stream enclosure, which conveys Mill Creek under Souderton Road, upstream to the proposed inlet at endwall SW10 and then place fill in the abandoned channel.

   4.  The western enclosure consists of 17 linear feet of 48 inch RCP and 105 linear feet of 66 inch RCP that starts at end-wall SW10, includes inlet cleanouts SW10, SW22 and SW9 and joins the existing structure at inlet cleanout SW1.

   5.  To construct an outfall structure from a subsurface stormwater management facility adjoining the existing 72 inch stream enclosure at inlet cleanout SW1, which conveys Mill Creek under Souderton Road.

   6.  To construct approximately 150 linear feet of retaining wall along the bank and within the assumed 100-year floodway of the western unnamed tributary. The wall is immediately upstream of SW1.

   The project will impact 435 linear feet of watercourse. The site is located approximately 400 feet west of the intersection of Souderton Road (SR 0113) and Bethlehem Pike (SR 4085) (Telford, PA Quadrangle N:  13.8 inches; W:  7.6 inches).

   E46-936. Horsham Township, 1025 Horsham Road, Horsham, PA 19044, Montgomery County, ACOE Philadelphia District.

   Deep Meadow Park Pedestrian Bridge Replacement Project. The applicant proposes to replace the existing bridge and appurtenant structures over Park Creek (WWM-MF).

   1.  To construct and maintain a single span wooden deck bridge with a 78 foot span and 7 foot underclearance and 6 foot bridge width.

   2.  To temporarily place approximately 19 cubic yards soil stockpile in the floodplain.

   3.  To place approximately 6 cubic yards of fill on both left and right floodplain and floodway associated with bridge footings construction and road approach grading.

   The project proposes to temporarily affect 90 linear feet and directly affect a total of 20 linear feet of stream banks. The project site is located approximately 3,620 feet southeast of the intersection of SR 0463/Horsham Road and SR 0152/Limekiln Pike (Ambler, PA Quadrangle N:  14.87 inches; W:  6.98 inches).

   E15-704. Wawa Inc., 260 West Baltimore Pike, Wawa, PA 19063, East Brandywine Township, Chester County, ACOE Philadelphia District. Horseshoe Pike (SR 0322) and Bondsville Road (SR 4015) intersection improvements.

   The applicant proposes the following water obstructions and encroachments associated with the road widening and traffic improvements to facilitate access to a proposed Wawa Food Market.

   1.  To relocate 155 linear feet of the unnamed tributary to Beaver Creek (TSF, MF) then place fill in the abandon channel.

   2.  To remove 35 linear feet of existing 48 inch CMP culvert, which conveys an unnamed tributary of Beaver Creek under an existing driveway access.

   3.  To remove 65 linear feet of existing retaining wall and fill from the floodplain to facilitate channel relocation noted in item 1.

   4.  To modify and extend an existing stream enclosure, which conveys unnamed tributary to Beaver Creek under Horseshoe Pike and Bondsville Road intersection. The enclosure consists of 40 additional feet of 6 foot by 8 foot arch culvert.

   5.  To construct approximately 330 linear feet of gravity retaining wall along the west bank and within the assumed 100-year floodway of the unnamed tributary adjacent to the widened Bondsville Road.

   6.  To construct approximately 330 linear feet of gravity retaining wall along the east bank and within the assumed 100-year floodway of the unnamed tributary adjacent to the proposed Wawa Food Market parking area.

   7.  To modify and extend three outfall structures from road surfaces through the proposed retaining walls previously noted discharging to the unnamed tributary of Beaver Creek.

   8.  To construct and maintain 50 linear feet of 16 foot by 4 foot open bottom culvert spanning the relocated channel noted in item 1. The structure will serve as the access to the proposed Wawa Food Market.

   9.  To construct a sewer line and force main under the proposed culvert noted in item 8.

   10.  To construct a sewer line and force main across an unnamed tributary of Beaver Creek and to construct, operate and maintain sewage pump station within the 100-year floodplain.

   Items 1, 2, 4, 5 and 7 will take place within a Department of Transportation right-of-way. Items 9 and 10 will fall under the responsibility of the municipal sewer authority. The remaining items (items 3, 6 and 8) are solely the responsibility of the applicant, Wawa, Inc.

   The project will impact 420 linear feet of watercourse. The site is located immediately southeast of the intersection of Horseshoe Pike (SR 0322) and Bondsville Road (SR 4015) (Wagontown, PA Quadrangle N:  5.9 inches; W:  1.9 inches).

   Northeast Region:  Water Management Program Manager, 2 Public Square, Wilkes-Barre, PA 18711-0790.

   E52-184. Tennessee Gas Pipeline, 197 Tennessee Road, Coudersport, PA 16915, in Lackawaxen, Shohola and Milford Townships, Pike County, U. S. Army Corps of Engineers, Philadelphia District.

   To repair and maintain an existing 24-inch-diameter high-pressure natural gas pipeline, known as the TGP 300-1 Line. Work will involve excavation to expose sections of the pipeline, removal of the external coating and reapplication of a new coating at multiple locations along the pipeline. Approximately 14 of the work locations include utility line crossings and/or temporary road crossings, involving temporary impacts to wetlands or streams (tributary to West Falls Creek (HQ-CWF), Twin Lakes Creek (HQ-CWF), Savantine Creek (EV), Dimmick Meadow Brook (EV) and Deep Brook (EV)). The temporary impacts total approximately 2.02 acres (1,600 linear feet). The project is located within the existing pipeline right-of-way, extending southeasterly from a point approximately 2,000 feet northwest of Little Teedyuskung Lake (Narrowsburg, NY-PA Quadrangle N:  2.1 inches; W:  14.4 inches).

   E45-446. Tobyhanna Township, HC 89, Box 289, Pocono Pines, PA 18350, in Tobyhanna Township, Monroe County, U. S. Army Corps of Engineers, Philadelphia District.

   To place fill in 0.13 acre of PSS Wetlands within the Tobyhanna Creek Watershed (HQ-CWF) for the purpose of constructing the Mackes Street Extension Project. The project is located 0.3 mile northwest of the intersection of SR 0115 and SR 0940 (Blakeslee, PA Quadrangle N:  17.0 inches; W:  13.5 inches).

   E48-334. Lower Mount Bethel Township, P. O. Box 257, Martins Creek, PA 18063, in Lower Mount Bethel Township, Northampton County, U. S. Army Corps of Engineers, Philadelphia District.

   To construct and maintain a 1.6 acre gravel parking lot within the 100-year floodplain of the Delaware River (WWF, MF) to serve recreation fields between the Martins Creek-Belvidere Highway and the Delaware River. The project is located 1,000 feet southwest of the Riverton-Belvidere Highway Bridge across the Delaware River (Belvidere, PA-NJ Quadrangle N:  13.5 inches; W:  12.0 inches).

   Southcentral Region:  Water Management Program Manager, 909 Elmerton Avenue, Harrisburg, PA 17110.

   E05-310:  Dixie L. Tew, 3001 Teaberry Road, Bedford, PA 15522 in Bedford Township, Bedford County, ACOE Baltimore District.

   To fill and relocate an existing stream channel from a spring then construct and maintain 60 feet of 12-inch pipe which will discharge into an unnamed tributary of Shrobers Run (HQ-CWF) (Rainsburg, PA Quadrangle N:  15.4 inches; W:  7.7 inches) in Bedford Township, Bedford County.

   E05-311:  James S. Claycomb, 1532 Gordon Hall Road, Osterburg, PA 16667 in West St. Clair Township, Bedford County, ACOE Baltimore District.

WATER OBSTRUCTION AND ENCROACHMENT SMALL PROJECTS PERMIT

   E5914-001. Borough of Elkland, 105 Parkhurst Avenue, Elkland, PA 16920 in the Borough of Elkland, Tioga County, ACOE Baltimore District, Small Projects Permit Application.

   To remove concrete bridge abutments from the former Penn Central Railroad bridge along Camp Brook (WWF) located at the end of Proctor Avenue and approximately 400 feet downstream of the Industrial Road bridge. This existing encroachment restricts the channel width of Camp Brook resulting in higher backwater depths during high flows. The project would include removing and disposing, offsite, a stonewall, concrete abutments, wingwalls and retaining walls, including all reinforcement, then shaping the streambanks on a 1:2 slope. Remove and dispose, offsite, a concrete slab plus all reinforcement located in the streambed within the project limits. The approximate size of the slab is 20 feet wide by 25 feet long. Finish grade disturbed areas then install erosion control mating on sloped areas of the streambanks and place topsoil and seed these areas. All other disturbed areas will be graded, seeded and mulched. The project would impact approximately 200 feet of the channel. All work under this project will be confined within the stream banks of Camp Brook (Elkland, PA Quadrangle N:  21.25 inches; W:  8.05 inches).
