COAL AND NONCOAL MINING ACTIVITY APPLICATIONS

   Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); and The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). Mining activity permits issued in response to the applications will also address the applicable permitting requirements of the following statutes:  the Air Pollution Control Act (35 P. S. §§ 4001--4015); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003).

   The following permit applications to conduct mining activities have been received by the Department of Environmental Protection (Department). A copy of the application is available for inspection at the District Mining Office indicated before an application. Where a 401 Water Quality Certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for certification.

   Written comments, objections or requests for informal conferences on applications may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34.

   Where any of the mining activities listed will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. NPDES permits will contain, at a minimum, technology-based effluent limitations as identified in this notice for the respective coal and noncoal applications. In addition to the previous, more restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit, when necessary, for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). Persons or agencies who have requested review of the NPDES permit requirements for a particular mining activity within the previously mentioned public comment period will be provided with a 30 day period to review and submit comments on those requirements.

   Written comments or objections should contain the name, address and telephone number of the person submitting comments or objections; application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor; application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor wishes to have the conference conducted in the locality of the proposed mining activities.

Coal Applications Received

   Effluent Limits--The following coal mining applications that include an NPDES permit application will be subject to, at a minimum, the following technology-based effluent limitations for discharges of wastewater to streams:

   A settleable solids instantaneous maximum limit of 0.5 ml/l applied to:  (1) surface runoff (resulting from a precipitation event of less than or equal to a 10-year 24-hour event) from active mining areas, active areas disturbed by coal refuse disposal activities and mined areas backfilled and revegetated; and (2) drainage (resulting from a precipitation event of less than or equal to a 1-year 24-hour event) from coal refuse disposal piles.

There are no potable surface water supply intakes within 10 miles downstream. Transfer from Urey Coal Company. Application received May 12, 2003.

   33030106 and NPDES Permit No. PA0242373. Falls Creek Energy Co., Inc. (R. D. 6, Box 231, Kittanning, PA 16201). Commencement, operation and restoration of a bituminous surface strip and auger operation in Porter Township, Jefferson County affecting 163.5 acres. Receiving streams:  unnamed tributaries to Pine Run to Pine Run (CWF). There are no potable surface water supply intakes within 10 miles downstream. Application received May 7, 2003.

   Cambria District Mining Office:  286 Industrial Park Road, Ebensburg, PA 15931, (814) 472-1900.

   56030104 and NPDES Permit No. PA0249459. Elk Lick Energy, Inc., P. O. Box 240, Friedens, PA 15541, for commencement, operation and restoration of a bituminous surface mine in Jenner and Quemahoning Townships, Somerset County, affecting 171.9 acres. Receiving streams:  Two Mile Run (CWF) to Quemahoning Reservoir (CWF). The first downstream potable water supply intake from the point of discharge is Cambria-Somerset Authority. Application received May 2, 2003.

   11823004 and NPDES Permit No. PA0124842. M. B. Energy, Inc., 175 McKnight Road, Blairsville, PA 15717-7961, permit renewal for continued operation of a bituminous surface and auger mine and for discharge of treated mine drainage in Elder Township, Cambria County, affecting 1458.5 acres. Receiving streams:  Little Brubaker Run to Brubaker Run to Chest Creek (CWF). There are no potable water supply intakes within 10 miles downstream. Application received May 12, 2003.

   11980202 and NPDES Permit No. PA0234788. Smith Energy, Inc., 1075 Chestnut Street, Nanty Glo, PA 15943, permit revision to change the land use from wildlife habitat to unmanaged natural habitat in Blacklick Township, Cambria County, affecting 10.0 acres. Receiving streams:  Coalpit Run (CWF). Application received May 15, 2003.

   14940101 and NPDES Permit No. PA0219932. American Compliance Coal, Inc., P. O. Box 260, Brockway, PA 15824. Transfer of an existing bituminous surface mine-auger permit from Power Operating Co., Inc. The permit is in Rush Township, Centre County and affects 522 acres. Receiving streams:  unnamed tributary to Moshannon Creek (CWF). Application received April 18, 2003.

   14030101 and NPDES Permit No. PA0243493. AMFIRE Mining Company, LLC, One Energy Place, Latrobe, PA 15650. Commencement, operation and restoration of a bituminous surface mine permit in Snow Shoe Township, Centre County affecting 235.2 acres. Receiving streams:  Sandy Run and unnamed tributaries to Sandy Run (CWF) to Beech Creek to Bald Eagle Creek to the West Branch of the Susquehanna River. Application received May 13, 2003.

   17030108 and NPDES Permit No. PA0243507. Larry D. Baumgardner Coal Co., Inc., P. O. Box 186, Lanse, PA 16849. Commencement, operation and restoration of a bituminous surface mine permit in Woodward and Decatur Townships, Clearfield County, affecting 176 acres. Receiving streams:  North Branch, unnamed tributary of North Branch (CWF), Wolf Run. There is no downstream potable water intake from the point of discharge. Application received May 14, 2003.

   17990103 and NPDES Permit No. PA0238244. River Hill Coal Co., Inc., P. O. Box 141, Kylertown, PA 16847. Revision to an existing bituminous surface mine-auger permit to include the beneficial use of coal ash as structural fill and an alkaline addition material. The permit is in Bigler Township, Clearfield County. Application received April 25, 2003.

Noncoal Applications Received

   Effluent Limits--The following noncoal mining applications that include an NPDES permit application will be subject to, at a minimum, the following technology-based effluent limitations for discharges of wastewater to streams:

If coal will be extracted incidental to the extraction of noncoal minerals, at a minimum, the technology-based effluent limitations identified under coal applications will apply to discharges of wastewater to streams.

Receiving streams:  unnamed tributary to Jamison Run and Jamison Run (CWF). There are no potable surface water supply intake within 10 miles downstream. FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

   The following permit applications and requests for Environmental Assessment approval and requests for Water Quality Certification have been received by the Department of Environmental Protection. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341(a)), requires the State to certify that the involved projects will not violate the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) as well as relevant State requirements. Initial requests for 401 Water Quality Certification will be published concurrently with the permit application. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment must submit comments, suggestions or objections within 30 days of the date of this notice, as well as any questions, to the office noted before the application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

   The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Individuals will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on each working day at the office noted before the application.

Applications Received under the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27) and section 302 of the Flood Plain Management Act (32 P. S. § 679.302) and requests for certification under section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).

WATER OBSTRUCTIONS AND ENCROACHMENTS

   Southeast Region:  Water Management Program Manager, Lee Park, Suite 6010, 555 North Lane, Conshohoc- ken, PA 19428.

   E09-853. Kennedy Automotive Group, Inc., 620 Bustleton Pike, Feasterville, PA 19053, Lower Southampton Township, Bucks County, ACOE Philadelphia District.

   To perform the following activities in and along an unnamed tributary to the Poquessing Creek (WWF-MF):

   1.  To construct and maintain a 95-foot long open-bottom arch culvert with associated wing-walls.

   2.  To construct and maintain a 30-foot wide spanning bridge structure with associated abutments.

   3.  To construct and maintain a 30-foot wide spanning bridge structure with associated abutments.

   4.  To construct and maintain an additional 15 linear feet to the Philmont Avenue crossing.

   5.  To remove an existing nonjurisdictional, off-stream dam.

   The project proposes to directly affect 0.021 acre of wetlands. The project site is at the intersection of County Line Road and Bustleton Pike (Hatboro, PA Quadrangle; N:  2 inches; W:  1.15 inches).

   Northeast Region:  Water Management Program Manager, 2 Public Square, Wilkes-Barre, PA 18711-0790.

   E45-448. Department of Transportation, Engineering District 5-0, 1713 Lehigh Street, Allentown, PA 18103 in Smithfield and Middle Smithfield Townships, Monroe County, U. S. Army Corps of Engineers, Philadelphia District.

   To construct and maintain a four-lane, limited access highway, known as the Marshalls Creek Traffic Relief Study Project (US 209, Sec. 007), consisting of 76 various temporary and permanent water obstructions and encroachments in and along Marshalls Creek (HQ-CWF), Pond Creek (HQ-CWF) and tributaries thereof (HQ-CWF), Sandhill Creek (HQ-CWF) and 2.37 acres of wetlands. The project begins along SR 0209 near Gap View Road (East Stroudsburg, PA Quadrangle N:  3.6 inches; W:  0.6 inch) in Smithfield Township, Monroe County, continues north to SR 0402 at White Heron Lake (Bushkill, PA-NJ Quadrangle N:  11.4 inches; W:  15.8 inches) in Middle Smithfield Township and extends northeast along SR 0209 to SR 1016 (Sellersville Drive) (Bushkill, PA-NJ Quadrangle N:  10.0 inches; W:  12.7 inches) in Middle Smithfield Township, Monroe County. The project also includes roadway improvements at the intersection of SR 0209 and River Road (Bushkill, PA-NJ Quadrangle N:  14.2 inches; W:  3.8 inches) in Middle Smithfield Township, Monroe County (Bushkill, PA-NJ Quadrangle N:  9.1 inches; W:  16.7 inches).

   E64-241. Stephen and Maureen E. Camasta, HCI Box 830, Lakeville, PA 18438 in Scott Township, Wayne County, U. S. Army Corps of Engineers, Philadelphia District.

   To construct and maintain a single-span bridge, having a span of approximately 25 feet and an underclearance of approximately 7 feet, across Balls Creek (HQ-CWF). The purpose of the project is to provide access to a home. The project is on the north side of SR 4014, approximately 1.0 mile east of Scott Center (Starrucca, PA-NY Quadrangle N:  12.0 inches; W:  0.2 inch).

   E54-306. Pine Grove Treatment Authority, P. O. Box 426, Pine Grove, PA 17963 in Pine Grove Township, Schuylkill County, U. S. Army Corps of Engineers, Baltimore District.

   To construct and maintain:  (1) a sanitary sewer interceptor pump station within the floodplain along the right bank of Swatara Creek (CWF), occupying an area of approximately 0.02 acre; (2) a 20-inch-diameter HDPE sanitary sewer interceptor force main crossing of wetlands, temporarily impacting 0.02 acre (approximately 145 linear feet) of wetlands; (3) eight stream crossings (20-inch diameter force main) of tributaries to Swatara Creek, temporarily impacting approximately 0.12 acre (530 LF) of stream channel; (4) a 36-inch diameter effluent line crossing of PEM wetlands, temporarily impacting 0.14 acre (approximately 590 LF) of wetlands; and (5) a 36-inch effluent outfall along the right bank of Swatara Creek. The project, known as the Pine Grove Wastewater Treatment Plant and interceptor project, extends from the existing wastewater treatment plant (location of the proposed interceptor pump station), westward approximately 2 miles to SR 0081 (Pine Grove, PA Quadrangle N:  5.9 inches; W:  5.3 inches).

   E13-137. Kovatch Enterprises, Inc., 1 Industrial Complex, Nesquehoning, PA 18240 in Nesquehoning Borough, Carbon County, U. S. Army Corps of Engineers, Philadelphia District.

   To construct and maintain a stream restoration project in a 1,400 foot reach of First Hollow Run (HQ-CWF). The projects purpose is to stabilze the channel, improve aquatic resources and establish riparian habitat. The project will create a step-pool channel using O-weirs and M-weirs constructed of varying size boulders. The reach begins at First Hollow Run's confluence with Nesquehoning Creek (Nesquehoning, PA Quadrangle N:  20.8 inches; W:  9.6 inches) and continues upstream 1,400 feet (Nesquehoning, PA Quadrangle N:  21.2 inches; W:  10.1 inches) in Nesquehoning Borough, Carbon County.

   E58-254. Gary Schweppenheiser, Jr., R. R. 1, Box 1378, Nicholson, PA 18446 in Lenox Township, Susquehanna County, U. S. Army Corps of Engineers, Baltimore District.

   To construct and maintain a single span bridge, having a span of approximately 35 feet and an underclearance of approximately 6.6 feet, across a tributary to East Branch Tunkhannock Creek (CWF), to provide access to a future home. The project is along the west side of Township Road T-460, approximately 1,500 feet north of the intersection of T-460 and SR 0374 (Lenoxville, PA Quadrangle N:  5.8 inches; W:  7.0 inches).

   Southcentral Region:  Water Management Program Manager, 909 Elmerton Avenue, Harrisburg, PA 17110.

   E50-214:  Penn Township Municipal Authority, 102 Municipal Building Road, Duncannon, PA 17020 in Penn Township, Perry County, ACOE Baltimore District.

   To install and maintain 59,000 linear feet of 1.5-inch PVC sewer piping to be located within the 100 year floodplain of the Susquehanna River and to cross five unnamed tributaries to the Susquehanna River (WWF) within the Cove and Perdix Villages (Harrisburg West and Wertzville, PA Quadrangles N:  19.0 and 19.2 inches:  W:  15.0 and 0.6 inch, respectively) in Penn Township, Perry County.

   E21-351:  Shippensburg Properties, L. P., One Atlantic Ave., Pittsburgh, PA 15202 in Shippensburg Township, Cumberland County, ACOE Baltimore District.

   To install and maintain an open bottom culvert, relocate and maintain existing utility lines, install and maintain new utility lines and to remove and restore an existing culvert, all crossing Burd Run (CWF), on a 53-acre parcel of land to the north side of SR 174 (Walnut Bottom, PA Quadrangle N:  11.15 inches; W:  17.2 inches) in Shippensburg Township, Cumberland County.

   Northcentral Region:  Water Management Program Manager, 208 West Third Street, Williamsport, PA 17701, (570) 327-3574.

   E12-132. L & M Lumber, 923 Sizerville Road, Emporium, PA 15834. L & M Lumber structure in floodway in Shippen, Cameron County, ACOE Baltimore District (Emporium, PA Quadrangle N:  2.7 inches; W:  12.4 inches).

   To operate and maintain a 6,300 square foot material storage building placed on 7 feet of fill and a 280 square foot concrete storage bin. The structures and fill are in the floodway of the Sinnemahoning Portage Creek (CWF). The permit also authorizes the enclosure of an existing building by construction of one wall and containing the entire property with chain link fencing. All materials shall be stored above the 100-year floodwater elevation. The permitted site is on Sizerville Road (SR 155), 1.2 miles north of the intersection with SR 120.

   E14-444. Gregg Township, P. O. Box 184, Spring Mills, PA 16875. T-464 over Muddy Creek in Gregg Township, Centre County, ACOE Baltimore District (Spring Mills, PA Quadrangle N:  14.8 inches; W:  8.6 inches).

   To:  (1) stabilize the right abutment of an existing public bridge with the placement of Class C concrete under the abutment and R-6 riprap around the abutment; and (2) 40 feet of geotextile-lined New Jersey parapet cofferdam, 1,600 feet north on T-464-3 (Harter's Lane) from T-419-1 (Lower Georges Valley Road). This project proposes to impact 45 linear feet of Muddy Run (CWF).

   E41-527. Shrewsbury Township, 218 Deer Lake Road, Hughesville, PA 17737. Standard Joint Water Obstruction and Encroachment Permit in Shrewsbury Township, Lycoming County, ACOE Susquehanna River Basin District (Picture Rocks, PA Quadrangle N:  15.1 inches; W:  2.2 inches).

   To remove an existing bridge and construct and maintain a single span prestressed concrete spread box beam bridge having a clear span of 53.63 feet, with an minimum underclearance of 5.58 feet on a skew of 45° over Rock Run (HQ-CWF) and realign an existing drainage ditch along far upstream roadway embankment along T-686, 1.5 miles north of SR 0220 and to construct, maintain and remove a temporary stream crossing consisting of clean R-4 rock in Shrewsbury Township, Lycoming County. This project proposes to have a minimal impact on Rock Run. This project does not propose to impact any jurisdictional wetlands.

   E53-390. Department of Conservation and Natural Resources, Bureau of Forestry District 15, 3150 East Second Street, P. O. Box 673, Coudersport, PA 16915-0673. Water Obstruction and Encroachment Joint Permit Application in Ulysses Township, Potter County, ACOE Susquehanna River Basin District (Brookland, PA Quadrangle N:  6.0 inches; W:  11.3 inches).

   To construct and maintain a single span bridge having a span of 20 feet, width of 4.0 feet and a minimum underclearance of 2.0 feet over Commissioner Run (HQ-CWF) within the Susquehannock State Forest. This project does not propose to impact Commissioner Run and does not propose to impact any jurisdictional wetlands.

   E59-413A. Department of Transportation, District 3-0, P. O. Box 218, Montoursville, PA 17754. Permit Amendment for SR 6015, Section D52 project. The amendment applies to a site in Covington Township, Tioga County, ACOE Baltimore District (Blossburg, PA Quadrangle N:  19.8 inches; W:  10.05 inches).

   To place approximately 2,500 cubic yards of earthen fill into an area which contains two PEM wetlands, totaling 0.4 acre. The fill area is needed to dispose of excess material from roadway cut operations and is associated with the construction of SR 6015 between Blossburg and Canoe Camp. The applicant proposes to meet the wetland replacement requirement by constructing replacement wetlands in two areas adjacent to the highway project. The project fill site is approximately 0.8 mile southwest of Covington Borough.

   The Department of Environmental Protection has taken the following actions on previously received permit applications and requests for plan approval.

   Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. APPROVALS TO USE NPDES AND/OR OTHER GENERAL PERMITS

   The following parties have submitted:  (1) Notices of Intent for Coverage under (1) General NPDES Permits to Discharge Wastewater into the Waters of the Commonwealth. The approval for coverage under these general NPDES permits is subject to applicable effluent limitations. Monitoring, reporting requirements and other conditions set forth in the general permit:  (2) General Permits for Beneficial Use of Sewage Sludge or Residential Septage by Land Application in this Commonwealth; (3) General NPDES Permit Authorizing the Discharge of Stormwater Associated with Construction Activities to Waters of the Commonwealth; (4) Notification for First Use Application of Sewage Sludge.

   The approval of coverage for land application of sewage sludge or residential septage under these general permits is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions set forth in the respective permit. The Department of Environmental Protection approves the following coverage under the specific General Permit.

   The EPA Region III Administrator has waived the right to review or object to this permit action under the waiver provision 40 CFR 123.23(d).

   The application and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted.
