Proposed Revision to the State Implementation Plan for the Enhanced Vehicle Emissions Inspection/Maintenance Program for the Philadelphia Area; Public Hearing

   The Philadelphia Severe Ozone Nonattainment Area is comprised of five counties in the southeastern portion of this Commonwealth--Bucks, Chester, Delaware, Montgomery and Philadelphia Counties. The Federal Clean Air Act requires this area to conduct emissions testing on certain motor vehicles registered in that area. To comply with this requirement, the Commonwealth employs a tailpipe testing method known as Acceleration Simulation Mode 5015 as a component of its Enhanced Vehicle Emissions Inspection/Maintenance Program.

   The tailpipe emissions testing program employed in the Philadelphia area incorporates exhaust emissions standards, measured as a concentration of pollutants. If a vehicle subject to testing has emissions higher than the standard, the vehicle fails the emissions test. These standards, or cutpoints, vary by model year.

   The Environmental Protection Agency (EPA) allows states to use an overall less stringent set of cutpoints during the start-up of a new tailpipe testing program. These ''interim'' cutpoints must then be replaced with ''final'' cutpoints to be used for the duration of the program.

   On August 16, 2002, the EPA released ''revised final'' cutpoints giving states the option to use either the original final or the revised final cutpoints in their tailpipe emissions programs. The Commonwealth is proposing to exercise its option, through a revision of the State Implementation Plan (SIP), to implement the revised final cutpoints for the tailpipe testing program in the Philadelphia area.

   This proposal is available on the Department's website at http://www.dep.state.pa.us (choose Information by Subject/Air Quality/State Implementation Plans) or through the following contact persons.

   The Department will hold a public hearing to receive comments on the SIP revision on Wednesday, July 2, 2003, at 1:30 p.m. at the Southeast Regional Office Hearing Room, Lee Park, 555 North Lane, Suite 6010, Conshohocken, PA.

   Persons wishing to present testimony at the hearing should reserve a time by contacting Susan Ferree, P. O. Box 8468, Harrisburg, PA 17105, (717) 787-9495. Persons who do not reserve a time will able to testify after pre-registrants. Witnesses should keep testimony to 10 minutes and should provide two written copies at the hearing. Persons with a disability who wish to attend the hearing and require an auxiliary aid, service or other accommodation to participate in the proceeding should contact Wick Havens, (717) 787-9495.
