Required Licensure of Cervidae Livestock Operations

   The act of December 9, 2002 (P. L. 1495, No. 190) amended the Domestic Animal Law, 3 Pa.C.S. §§ 2303 and 2380.1--2380.9, by adding Subchapter G.1 (relating to cervidae livestock operations). Cervidae livestock operations are farm operations which: (1) contain behind fences privately owned members of the genus and species Cervus elaphus involved in the production, growing, breeding, using, harvesting, transporting, exporting, importing or marketing of cervidae species or cervidae products; and (2) do not allow captive bred or captive held cervidae species to be harvested through hunting anywhere on the farm operation. Animals having the genus and species Cervus elaphus are elk, red deer or hybrids of the two.

   Subchapter G.1 requires the Department of Agriculture (Department) to license and inspect cervidae livestock operations and to issue permits prior to importation of elk or red deer into this Commonwealth.

   Subchapter G.1 requires that cervidae livestock operations maintain a current inventory that includes the sources of new herd additions and the destinations of animals leaving the herd. The subchapter also specifies that pens, shelters or enclosures used to hold elk or red deer be no less than 10 feet from the ground to the top.

   The Department has sent license applications to all known cervidae operations in this Commonwealth that it believes might fit within the statutory definition of ''cervidae livestock operation.'' Owners of elk, red deer or elk/red deer hybrid farm operations who have not received a license application from this Department should immediately contact the Department at (717) 705-2106. The deadline for licensure is June 30, 2003.
