APPLICATIONS

   Under the Federal Clean Water Act and The Clean Streams Law, the following parties have applied for an NPDES permit or to renew their current permit to discharge controlled wastewaters into the waters of this Commonwealth or to conduct other activities required by the NPDES permit. For renewal applications listed in Section I, the Department of Environmental Protection (Department) has made a tentative determination to reissue these permits for 5 years subject to effluent limitations and monitoring and reporting requirements in their current permits, with appropriate and necessary updated requirements to reflect new and changed regulations and other requirements. For new permit applications, renewal applications with major changes or applications for permits not waived by the EPA, the Department, based upon preliminary reviews, also made a tentative determination of proposed effluent limitations and other terms and conditions for the permit applications listed in Section II. These determinations are published as proposed actions for comments prior to taking final actions.

   Unless indicated otherwise, the EPA Region III Administrator has waived the right to review or object to this proposed permit action under the waiver provision 40 CFR 123.24(d).

   Persons wishing to comment on a proposed permit are invited to submit a statement, to the office noted before the application, within 30 days from the date of this public notice. Comments received within this 30-day comment period will be considered in the formulation of the final determinations regarding the application. The comment should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held if the responsible office considers the public response significant. Following the comment period, the Department's Water Management Program Manager will make a final determination regarding these applications. Notice of this final determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

   Renewal applications, including proposed effluent limitations and special conditions, are available on file. For new permit applications, information submitted with the applications is available on file. The information may be inspected and arrangements made for copying at the office indicated before the application.

   Description of Proposed Activity:  Renewal of a treated minor discharge from a privately owned sewage treatment works.

   For the purpose of evaluating effluent requirements for TDS, NO2-NO3, fluoride, phenolics, sulfate and chloride, the existing/proposed downstream potable water supply (stream and public water supplier) considered during the evaluation is the Beaver River and Beaver Falls Municipal Authority at River Mile 3.76, 29.77 miles below point of discharge.

   The receiving stream, unnamed tributary to Big Run, is in watershed 20-A and classified for WWF, aquatic life, water supply and recreation.

   Description of Proposed Activity:  Renewal of municipal separate stormwater system consisting of 165 miles of storm sewer pipe with 227 outfalls to the Lehigh River, Little Lehigh Creek, Trout Creek, Cedar Creek, Little Cedar Creek and Jordan Creek.

   The permittee must develop, implement and maintain programs to characterize the outfalls and minimize their impact on water quality.

   Permit requirements include:  establishing legal authority; source identification; discharge characterization; stormwater management programs including implementation of appropriate best management practices; assessment of controls; adequate fiscal resources; submission of annual report.

   PA0027553, Sewerage, SIC 4952, Pine Creek Municipal Authority, P. O. Box 608, Avis, PA 17721. This existing facility is in Pine Creek Township, Clinton County.

   Description of Proposed Activity:  Amendment of an NPDES permit for an existing discharge of treated sewage wastewater.

   The receiving stream, West Branch Susquehanna River, is in the State Water Plan watershed 9B and classified for WWF. The nearest downstream public water supply intake for the Pennsylvania American Water Company is on West Branch Susquehanna River, 51 miles below the point of discharge.

   The proposed effluent limits for Outfall 001 based on a design flow of 1.3 MGD.

   The receiving stream, Susquehanna River, is in the State Water Plan watershed 5D and classified for WWF. The nearest downstream public water supply intake for the Danville Municipal Water Authority is on the Susquehanna River, 10 miles below the point of discharge.

   Description of Proposed Activity:  Pending issuance of an amended NPDES permit to include discharge of site stormwater through Outfall S01. Existing limits for wastewater through Outfall 001 remain unchanged.

   The receiving stream for Outfall 001, the Susquehanna River, is in the State Water Plan watershed 5E and is classified for WWF. The nearest downstream public water supply surface water intake, owned by Merck and Company, Inc., is on the Susquehanna River, 2.35 miles below the discharge.

   The existing effluent limits for Outfall 001 will remain the same and were based on a design flow of 0.1 MGD.

   The receiving stream for Outfall S01, an unnamed tributary to the Susquehanna River, is in the State Water Plan watershed 5E and is classified for CWF. The nearest downstream public water supply surface water intake, owned by Merck and Company, Inc., is on the Susquehanna River, 2.39 miles below the discharge. Approximately 0.084 MGD of stormwater will be discharged through Outfall S01 from an average storm event. Annual Inspection Certification will be required.

   PA0028461, Sewerage, 4952, Mifflinburg Borough Municipal Authority, 333 Chestnut Street, Mifflinburg, PA 17844. This facility is in Mifflinburg Borough, Union County.

   Description of Proposed Activity:  Issuance of an amended NPDES permit to include discharge of site stormwater through Outfalls S01 and S02. The existing limits for treated effluent through Outfall 001 remain unchanged.

   Outfalls S01 and S02 will discharge via sheet flow onto a gravel driveway area onsite. The nearby receiving stream, Buffalo Creek, is in the State Water Plan watershed 10C and is classified for CWF. The nearest downstream public water supply intake for Sunbury Municipal Authority is on the Susquehanna River, approximately 23.7 miles below the point of discharge. Approximately 0.02 million gallons per day of stormwater will be discharged through Outfalls S01 and S02 during a rainfall intensity of 1 inch per hour.

   PA0032514, Sewage, 4952, Department of Conservation and Natural Resources, Denton Hill State Park, 262 Sizerville Road, Emporium, PA 15834. This facility is in Ulysses Township, Potter County.

   Description of Proposed Activity:  The Department of Conservation and Natural Resources is proposing to change the receiving stream of Outfall 001 from Elm Hollow Run (HQ-CWF) to Nine Mile Run (HQ-CWF). The Department of Conservation and Natural Resources intends to replace the existing sewage treatment plant at Denton Hill State Park with a new sewage treatment plant. All of the existing permit conditions and effluent limitations will remain the same except for the previously mentioned change of the receiving water.

   PA0005037-A3, Industrial Waste, SIC 4911, EME Homer City Generation LP, 1750 Power Plant Road, Homer City, PA 15748-9558. This application is for an amendment of an NPDES permit to discharge treated process water from the flue gas desulfurization wastewater plant in Center Township, Indiana County.

   The following effluent limitations are proposed for discharge to the receiving waters, Blacklick Creek, classified as a WWF with existing and/or potential uses for aquatic life, water supply and recreation. The first existing/proposed downstream potable water supply is the Saltsburg Municipal Water Authority--Saltsburg, 28 miles below the discharge point.

   Outfall 027:  existing discharge, design flow of 0.179 mgd.

   The following effluent limitations are proposed for discharge to the receiving waters, known as South Branch of Maple Creek, which are classified as a WWF with existing and/or potential uses for aquatic life, water supply and recreation. The first downstream potable water supply intake from this facility is the Charleroi Municipal Authority on the Monongahela River.

   Description of Proposed Activity:  New discharge of treated sewage.

   For the purpose of evaluating effluent requirements for TDS, NO2-NO3, fluoride, phenolics, sulfate and chloride, the existing/proposed downstream potable water supply (stream and public water supplier) considered during the evaluation is the point of discharge to Little Buffalo Run in Clearfield Township, Butler County.

   The receiving stream, unnamed tributary to Little Buffalo Run, is in watershed 18F and classified for HQ-TSF, aquatic life, water supply and recreation.

   The proposed effluent limits for Outfall 001 are based on a design flow of 0.0004 MGD.
