THE CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT
APPLICATIONS FOR NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS This notice provides information about persons who have applied for a new, amended or renewed NPDES or WQM permit, a permit waiver for certain stormwater discharges or submitted a Notice of Intent (NOI) for coverage under a general permit. The applications concern, but are not limited to, discharges related to industrial, animal or sewage waste, discharges to groundwater, discharges associated with municipal separate storm sewer systems (MS4), stormwater associated with construction activities or concentrated animal feeding operations (CAFOs). This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92 and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P. S. §§ 691.1--691.1001) and the Federal Clean Water Act.

For applications for new NPDES permits and renewal applications with major changes listed in Section II, as well as applications for MS4 individual permits and individual stormwater construction permits in Sections IV and VI, the Department, based upon preliminary reviews, has made a tentative determination of proposed effluent limitations and other terms and conditions for the permit applications. These determinations are published as proposed actions for comments prior to taking final actions.
Unless indicated otherwise, the EPA Region III Administrator has waived the right to review or object to proposed NPDES permit actions under the waiver provision at 40 CFR 123.24(d).
Persons wishing to comment on an NPDES application are invited to submit a statement to the contact office noted before the application, within 30 days from the date of this public notice. Persons wishing to comment on a WQM permit application are invited to submit a statement to the office noted before the application within 15 days from the date of this public notice. Comments received within the respective comment periods will be considered in the final determinations regarding the applications. Comments should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.
The Department will also accept requests for a public hearing on applications and a public hearing may be held if the responsible office considers the public response significant. If a hearing is scheduled, a notice of the hearing will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. The Department will postpone its final determination until after any public hearings are held.

PA0026689, PA0026662 and PA0026671, Sewage, City of Philadelphia Water Department, 1101 Market Street, 4th Floor, Philadelphia, PA 19107. The Department is amending the NPDES permits to discharge treated sewage from Northeast, Southeast and Southwest Water Pollution Control Plants in Philadelphia, PA. These are existing discharges to Delaware River Zones 3 and 4.
The receiving stream is classified for WWF, aquatic life, water supply and recreation.
The amendments to the three water pollution control plants adjust the total residual chlorine (TRC) limitation from 0.2 to 0.5 mg/l as a monthly average and an instantaneous maximum of 1.0 mg/l TRC. This change is the result of chlorine minimalization study conducted by the Philadelphia Water Department.

Description of Proposed Activity: The facility is a municipal wastewater treatment facility. This permit amendment is to include stormwater outfall of this facility.
The receiving stream, unnamed tributary to the West Branch of Neshaminy Creek, is in the State Water Plan watershed 2F and is classified for WWF and MF. The nearest downstream public water supply intake for Philadelphia Suburban Water Company is on the Neshaminy Creek, approximately 20 miles below the point of discharge.

PAI120501, CAFO, Andrew Laffey--Glenville Farms, 2391 Glenville Road, Cochranville, PA 19330. Andrew Laffey has submitted an application for an individual NPDES permit for an existing and proposed addition to CAFO known as Glenville Farms, 2391 Glenville Road Cochranville, PA 19330 in West Fallowfield Township, Chester County.
The CAFO is situated near Muddy Run in Watershed 7K (TSF, MF). The CAFO will be designed to maintain an animal population of approximately 2,154 AEUs consisting of 1,000 milking cows, 400 dry cows and 475 heifers.
Dairy cows will be housed in the proposed free stall barn, which will have the capacity to hold 1,200 cows. Approximately 200 dry cows and approximately 475 heifers will stay in the existing covered barn. Manure will be managed through proposed passive sand separator, mechanical solids separator, solid stacking and handling pad and a two stage HDPE-lined manure storage which will hold approximately 5.8 million gallons of manure. Existing manure management system will remain in placed and will be used for dry cows and heifers. The existing HDPE-lined manure storage has the capacity of 1.66 million gallons will stay continued in use while two, earthen manure storage lagoons, one at 2391 Glenville Road, has a capacity of 1.2 million gallons and another at 650 Gum Tree Road has a capacity of approximately 0.38 million gallons will be modified by the end of 2005. An HDPE liner with leak detection system similar to the one proposed for the new storage lagoon will be installed at these two lagoons. The total capacity of the manure storage facilities will be 9.12 million gallons which will be adequate per nutrient management plan.
Prior to operation of the manure storage facilities, the design engineer will be required to submit certification that the facilities were constructed in accordance with appropriate Pennsylvania Technical Guide Standards. A release or discharge to waters of this Commonwealth under normal operating conditions is not expected. Normal operating conditions are defined as conditions below a 25-year, 24-hour storm event.
The Department has conducted administrative and technical reviews of the application. Based on the preliminary review and application of lawful standards and regulations, the Department has made a tentative determination to issue an NPDES permit for the operation subject to the terms and conditions and monitoring and reporting requirements specified in the permit.
The permit application and draft permit are on file at the Southeast Regional Office of the Department. Individuals may make an appointment to review the files by calling the File Review Coordinator at (610) 832-6003.
Persons wishing to comment on the proposed permit are invited to submit written comments to the previous address within 30 days from the date of this public notice. Comments received within this 30-day period will be considered in formulating the Department's final determination regarding the application. Comments should include the name, address and telephone number of the writer and a concise statement to inform the Department of the basis of the comment and the relevant facts upon which it is based.
Following the 30-day comment period, the water management program manager will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time the determination may be appealed to the Environmental Hearing Board.
The EPA permit waiver provision under 40 CFR 123.24(e) does not apply to this NPDES permit.

The receiving stream, Buffalo Creek, is in the State Water Plan watershed 10C and is classified for CWF. The nearest downstream public water supply intake for Sunbury Municipal Authority is on the Susquehanna River, 23.7 miles below the point of discharge. Approximately 0.02 million gallons per day of stormwater will be discharged through stormwater Outfalls S01 and S02 during a rainfall intensity of 1 inch per hour.
