   Plan Description:  The plan revision in Warriors Mark Township, Huntingdon County for SRO Subdivision, Phase II (Ridge View Estates) was disapproved because the applicant failed to meet 25 Pa. Code § 71.62(c)(3)(ii) and (iii). Specifically, the hydrogeologist did not properly assess background nitrate-nitrogen concentrations currently in the groundwater under the lots proposed for subdivision. In addition, the report supplied information indicating the need for a detailed hydrogeologic study under 25 Pa. Code § 71.62(c)(4) since the hydrogeologist's report identifies a conflict between the proposal and existing or potential future uses of the groundwater adjacent to the proposed lots.

HAZARDOUS SITES CLEAN-UP UNDER THE ACT OF OCTOBER 18, 1988

Proposed Consent Order and Agreement

East Tenth Street Site, Marcus Hook, Marcus Hook Borough, Delaware County

   The Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6020.101--6020.1305), has entered into a Consent Order and Agreement (CO&A) with FMC Corporation (FMC) to investigate and remediate certain hazardous substances at the East Tenth Street HSCA Site (Site), Marcus Hook Borough, Delaware County.

   The Department has conducted a prompt interim response action at the Site, documented in a public hearing held on September 27, 2000, and a Final End of Project Report dated August 13, 2001, and a site investigation documented in a Final Report dated June 2002. Based on the findings of the investigation, the Department has selected an Interim Response, documented in a Statement of Decision and Response to Comments (SOD) issued December 19, 2002, and an expanded investigation into certain conditions at the Site.

   By this agreement, FMC agrees to complete the actions described in the SOD with regard to the Interim Response action and to perform the work described to complete the expanded investigation.

   Under section 1113 of the HSCA (35 P. S. § 6020.1113), the Department is publishing notice of this CO&A and will provide a 60-day period for public comment on the CO&A commencing on July 5, 2003. Copies of the CO&A may be examined at the Southeast Regional Office, Lee Park, Suite 6010, 555 North Lane, Conshohocken, PA 19428. Comments should be submitted to April Flipse, Project Officer, at the previous address.

   The Department has reserved the right to withdraw its consent to the CO&A if comments submitted during the public comment period disclose facts or considerations which indicate, in the Department's discretion, that the CO&A is inappropriate or not in the public interest.

Pennsylvania Priority List of Hazardous Sites For Remedial Response

1.  Background

   The HSCA was enacted in 1988 to provide for the cleanup of sites in this Commonwealth that are releasing or threatening the release of hazardous substances. Section 502(a) of the HSCA requires that the Department publish in the Pennsylvania Bulletin a priority list of sites with releases or threatened releases for the purpose of taking remedial response. This list is called the Pennsylvania Priority List of Hazardous Sites for Remedial Response (PAPL).

2.  Placement of Sites on the PAPL

   The Department places sites on the PAPL when the Department has determined through investigation that there are releases or threatened releases of hazardous substances or releases or substantial threatened releases of contaminants which present a substantial danger. In accordance with the requirements of section 502(a) of the HSCA, the Hazard Ranking System (HRS) (40 CFR Part 300, Appendix A), established under the Federal Superfund Act, is utilized to rank the sites for placement on the PAPL. The HRS uses mathematical formulas that reflect the relative importance and interrelationships of the various human health and environmental factors to arrive at a final score on a scale of 0 to 100. The values are assigned using information obtained from site investigations. Section 502(a) of the HSCA also directs the Department to consider its administrative, enforcement and financial capabilities when placing sites on the PAPL.

   Placement of a site on the PAPL is used to identify sites which require a remedial response to address threats to the public health, safety or the environment. The Department will decide on a case-by-case basis whether to take enforcement or other actions under the HSCA or other authorities or to proceed directly with HSCA-funded remedial response actions and seek cost recovery after the cleanup. Remedial response actions will not necessarily be taken in the same order as a site's ranking on the PAPL. The investigation conducted to place a site on the PAPL may not be sufficient to determine either the extent of contamination or the appropriate response actions for a site. The Department may undertake further investigations to determine appropriate response actions. The length of time needed to complete these studies will vary due to the complexity of a site. The Department may decide not to immediately proceed with an HSCA remedial action or that no remedial action is necessary.

3.  Removal of Sites from the PAPL

   Sites are removed from the PAPL in accordance with the requirements section 502(d) of the HSCA. Section 502(d) of the HSCA requires that sites shall be removed from the list upon determination by the Department that the remedial response has been initiated. In cases where a responsible person will be conducting the remedial response under the terms of a settlement with the Department, section 502(d) of the HSCA states that the site ''shall be removed upon the determination by the Department that the responsible person has complied with the terms of the settlement and has initiated a cleanup.''

4.  Statutory Authority

   The PAPL is published under the authority of section 502(a) of the HSCA. Under section 502(b) of the HSCA, a decision to place a site on the list or to remove a site from the list is not a final action subject to review under the Environmental Hearing Board Act (35 P. S. §§ 7511-7515), nor shall it confer a right or duty upon the Department or any person.

5.  Review and Public Comment

   The HSCA provides for a 30-day public comment period subsequent to publication of the PAPL. This announcement opens a 30-day comment period for the sites being removed with this publication. Written comments should be submitted to the regional office in which the site is located. The contact person for each region and their address can be found in the Additional Information section.

   The regional office site files contain all information considered by the Department in placing a site on the list or removing a site from the list. The regional office files are available for review in the appropriate regional office, by appointment only, from 8 a.m. to 4 p.m. Monday through Friday, excluding State holidays. Arrangements to review the site file can be scheduled by contacting the regional office in which the site is located. The regional contact person for each region and their address can be found in the Additional Information section.

   The Department considers all written comments received during the comment period. Written comments and the Department's responses will be placed into the site file and will later be incorporated into the Administrative Record.

6.  Contents of the PAPL

   This notice removes two sites from the PAPL. The site summaries for the sites addressed by this notice are listed as follows. Table 1 lists the sites being removed by this notice. Table 2 lists all sites remaining on the PAPL. The name of the sites, HRS score, municipality, county and region are included in this table. The sites are listed in decreasing order of HRS score.

7.  Site Summaries

   H. K. Porter Site, Hopewell Township, Beaver County--The H. K. Porter Site is on property that includes approximately 17.5 acres approximately 1/4 mile west of the Ohio River. The property is owned by Mount Olivet Catholic Cemetery and consists of a steep ravine with an unnamed tributary flowing through it to the Ohio River. The site consisted of an unpermitted landfill where bulk wastes and drums were end-dumped over the hillside. The Department excavated approximately 95,000 cubic yards of PCB and RCRA contaminated waste and soils from the site and shipped these materials to a permitted offsite facility. Underlying soils were sampled to confirm that established soil cleanup levels were met. Based on this information, the Department determined that no further action was necessary to protect human health or the environment at the Porter site. Wetland areas affected by the Department's action were re-established and continue to be monitored by Department staff to confirm the growing success of the re-established plants. Prior to the Department undertaking an action at this site, the Department entered into a CO&A with the H. K. Porter Company (Porter), which required Porter to commit $5.3 million towards the cleanup of the site. No further enforcement action could be taken against Porter based on the stipulations spelled out in the CO&A.

   Quakertown Foundry Site, Quakertown Borough and Richland Township, Bucks County--The Quakertown Foundry Site is a 22-acre property used as a foundry from 1929 to 1984 when ownership was transferred to the Borough of Quakertown. Waste materials including casting sands and bag house dust were used as fill both on the original foundry property and on a portion of an adjacent public park used for athletic fields. During the site characterization, the Department determined that these waste materials were from historic foundry operations and contained hazardous levels of lead, cadmium, mercury and chromium. In 1991, the Department conducted an Interim Response Action to erect a security fence around the site. The Department completed the Final Response Action in 2000. The Final Response Action involved the excavation and offsite disposal of contaminated soil and waste material. The Department continues to work with the municipality to help facilitate reuse of the property.

Proposed Consent Order and Agreement

Fayette Equipment/Pete Claim Site, South Union Township, Fayette County

   Under section 1113 of the HSCA, the Department is proposing a settlement for the Fayette Equipment/Pete Claim Site (Site). The Site comprises approximately 1 acre located off of Jamison Lane, South Union Township, Fayette County.

   From the mid-1950s--1961, Pete Claim (Claim) was authorized by the Site's property owner to operate the Site as a facility at which Claim reclaimed lead cores from used automobile batteries. Claim broke open the batteries, drained the batteries' acid onto the ground and removed the lead contents to be sold for profit. Claim disposed of broken and whole battery casings, empty drums, copper wire, scrap metal, paint cans, tires and other materials at the Site.

   The Department's soil and waste samples showed that the Site had areas of lead and cadmium contamination resulting from Claim's disposal activities. The Department's surface water samples showed that the unnamed tributary of Lick Run contained pollutants above Water Quality Criteria for iron, lead, manganese and cadmium resulting from Claim's disposal activities.

   In 1998, the Department conducted an interim response under the authority of the HSCA to clean up the waste Claim disposed of at the Site and to clean up soil contamination related to the waste. The Department subsequently entered into negotiation with Claim over reimbursement of costs the Department expended during its interim response at the Site. As a result of those negotiations, the Department executed a proposed Consent Order and Agreement (CO&A) with Claim on May 30, 2003.

   This notice is being provided under section 1113 of the HSCA to advise that the proposed CO&A is now available for public review and comment. A copy of the CO&A can be obtained by contacting Terry Goodwald, (412) 442-4000.

   The proposed CO&A will be open for comment from July 5, 2003, until September 5, 2003. Proposed Interim Response

Washington County Drum Dump, Robinson Township, Washington County

   The Department, under the HSCA, is proposing an interim response at the Washington County Drum Dump (Site), Robinson Township, Washington County.

   The Site is off of the Bulger-Candor Road approximately 1 mile southwest of the McDonald Interchange on U. S. Route 22. A disposal area in a ravine that affects approximately 2 acres of the property. There are approximately 30 drums disposed of at the site. The drums contain a white powder material, resin-like material or black liquid. Some of the drums are open and/or leaking. In addition to the drums, construction/demolition waste, household appliances and trash are present. The Department completed an investigation of the site in March 1999 and determined that a release or a threat of a release of hazardous substances exists from waste in open and leaking drums dumped in a ravine at this Site. The waste disposed of at this Site poses a direct contact threat to the public and a threat of soil and groundwater contamination.

   The Department considered several alternatives at the Site, including: no action, securing of the site and removal and disposal of the hazardous substances at the Site. The Department has determined that removal and disposal of the hazardous materials at the site is the appropriate course of action. This alternative was selected because it complies with all applicable laws and regulations and is determined to be the most environmentally sound procedure for this site.

   This notice is being provided under section 506(b) of the HSCA. The administrative record which contains the information that forms the basis and documents the selection of this response action is available for public review and comment. The administrative record is at the Department's Southwest Regional Office in Pittsburgh and is available for review Monday through Friday from 8 a.m. to 4 p.m.

   The administrative record will be open for comment from July 5, 2003, until October 4, 2003. The following final reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site where one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected.

   For further information concerning the final report, contact the Environmental Cleanup Program Manager in the Department Regional Office after which the notice of receipt of a final report appears. If information concerning a final report is required in an alternative form, contact the Community Relations Coordinator at the appropriate Regional Office listed. GeoServices, Ltd., 1525 Cedar Cliff Drive, Camp Hill, PA 17011, on behalf of Allfirst Bank, 2055 South Queen Street, MC 182-00-01, York, PA 17402, submitted a combined Remedial Investigation and Final Report concerning remediation of site soils and groundwater contaminated with chlorinated solvents and fuel oil no. 2. The report is intended to document the remediation of the site to the Site-Specific Standard.

   Sunoco Station 0003-7382, Susquehanna Township, Dauphin County. GES, Inc., 410 Eagleview Boulevard, Suite 110, Exton, PA 19341, on behalf of Gelder Realty, 2456 Mercedes Court, Harrisburg, PA 17112, resubmitted a combined Remedial Investigation and Final Report concerning remediation of site soils and groundwater contaminated with benzene, toluene, ethylbenzene, xylenes (total), MTBE, isopropyl benzene and naphthalene. The report is intended to document the remediation of the site to a combination of Statewide Health and Site-Specific Standards.

   Former Mobil Service Station AN788, Lower Paxton Township, Dauphin County. B & B Diversified Enterprises, Inc., 125 Analomink Street, East Stroudsburg, PA 18301, on behalf of Corner Associates, LLC, 4800 Linglestown Road, Harrisburg, PA 17112, submitted a combined Remedial Investigation and Final Report concerning remediation of site soils and groundwater contaminated with unleaded gasoline and MTBE. The report is intended to document remediation of the site to the Site Specific Standard.

   Joy Curry Residence, Derry Township, Mifflin County. GemChem, Inc., P. O. Box 384, Lititz, PA 17543-0384, on behalf of Joy Curry, 1947 Glenwood Avenue, Lewistown, PA 17044, submitted a Final Report concerning remediation of site soils contaminated with fuel oil no. 2. The report was submitted within 90 days of a release and is intended to document remediation of the site to the Statewide Health Standard.

Marshall Miller and Associates, on behalf of Pickelner Fuel Company, Inc., has submitted a Final Report concerning soil contaminated with no. 2 fuel oil.    James Brown Property, Athens Township, Bradford County. Teeter Environmental Services, Inc., on behalf of James Brown, R. R. 2, Box 491, Athens, PA 18810, has submitted a Final Report concerning soil contaminated with no. 2 fuel oil. This Final Report is intended to demonstrate remediation of the site to meet the Statewide Health Standard. See additional entry in the Applications section of this Pennsylvania Bulletin.

   Bernardi Italian Foods, Town of Bloomsburg, Columbia County. Keystone Environmental Services, Inc., on behalf of Bernardi Italian Foods, 595 West 11th Street, Bloomsburg, PA 17815, has submitted a Final Report concerning soil and groundwater contaminated with other organics.    Caparo Steel Co. (AOC-3) (former Labor Ditch Area), City of Farrell, Mercer County. 15 Roemer Blvd., Farrell, PA 16121 (on behalf of Richard A. Herman, Caparo Steel Co., 15 Roemer Blvd., Farrell, PA 16121) has submitted a Final Report concerning remediation of soil contaminated with inorganics, lead and other organics. LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995

PREAMBLE 3


The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of 25 Pa. Code § 250.8 and the administration of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by provisions of the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media, benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by provisions of the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

The applicant proposes to remediate the site to meet a combination of the requirements for the Site-Specific and Statewide Health Standards. The Cleanup Plan was approved by the Department on May 21, 2003.

   Former Federal Paperboard Plant, West Manchester Township, York County. EPSYS Corporation, 1414 North Cameron Street, Suite A, Harrisburg, PA 17103, on behalf of International Paper Company, 6400 Poplar Avenue, Tower II, 5-023, Memphis, TN 38197 and Caraustar Industries, Inc., submitted a combined Remedial Investigation and Final Report concerning remediation of site soils and groundwater contaminated with BTEX, PHCs and PAHs. The final report demonstrated attainment of the Site-Specific and Nonresidential Statewide Health Standards and the combined report was approved by the Department on June 16, 2003.

   Lancaster Malleable Castings Company, Manheim Township, Lancaster County. Armstrong World Industries, Inc., P. O. Box 3001, Lancaster, PA 17604, on behalf of Lancaster Malleable Castings Corporation, 1046 Manheim Pike, Lancaster, PA 17601, submitted a Final Report concerning remediation of site groundwater contaminated with benzene, toluene, ethylbenzene and xylene. The final report did not demonstrate attainment of the Statewide Health Standard and was disapproved by the Department on June 2, 2003. This corrects an entry published at 33 Pa.B. 2922 (June 21, 2003) in which an incorrect disapproval date was given.

   Kauffman Residence, Conoy Township, Lancaster County. Groundwater and Environmental Services, Inc., on behalf of NiSource, Inc., 801 E. 86th Avenue, Merrillville, IN 46410, submitted a Final Report concerning the remediation of site soils contaminated with benzene, toluene, ethylbenzene, xylenes (total), PAHs, isopropyl-benzene and napthalene. The final report demonstrated attainment of the Statewide Health Standard and was approved by the Department on June 5, 2003.

   Koch Hydrocarbon Facility, Heidelberg Township, Lebanon County. ARCADIS G & M, Inc., 26451 Curtiss Wright Parkway, Suite 100, Cleveland, OH 44143, on behalf of Reiss Remediation Company, 4111 East 37th Street North, Wichita, KS 67220, submitted a combined Remedial Investigation and Final Report concerning remediation of site soils and groundwater contaminated with lead, BTEX, PHCs and PAHs. The final report demonstrated attainment of a combination of the Statewide Health and Site-Specific Standards and the combined report was approved by the Department on June 11, 2003.
