This work is part of a proposed commercial development known as Tannersville Factory Stores which includes approximately 480,000 S. F. of retail factory outlets, 2 restaurants and a 102-unit hotel. Recycling Grant Awards under the Municipal Waste Planning, Recycling and Waste Reduction Act of 1988, Act 101 The Department of Environmental Protection announces the following grants to municipalities for recycling programs under the Pennsylvania Municipal Waste Planning, Recycling and Waste Reduction Act of 1988, Act 101, P. L. 556, Section 902.
Grant funds are used to develop and implement recycling programs. Municipalities and counties are eligible for up to 90% funding of approved recycling program costs. Municipalities considered financially distressed under the Financial Distressed Communities Act (P. L. 246, No. 47 of 1987) are eligible to receive funding for an additional 10% of approved costs. All grant awards are predicated on the receipt of recycling fees required by sections 701 and 702 of Act 101 and the availability of monies in the Recycling Fund.

PA0088595 Amendment No. 1, CAFO, Hostetter Management Co. (Wide Awake Farm), P. O. Box 526, Ephrata, PA 17522. Joe Gulick has submitted a permit amendment application for an Individual NPDES permit for an expanding CAFO known as Wide Awake Farm, 488 Jay Road, Monroe Township, Bedford County.
The CAFO is situated near West Branch Sideling Hill Creek in Watershed 13-B (EV). The CAFO will be designed to maintain an animal population of approximately 1,360.6 AEUs consisting of 336 sows with litter, 2,800 gestating sows, 15 boars, 320 nursery pigs and 450 finishing pigs. The animals will be housed in two existing animal husbandry buildings and two proposed animal husbandry buildings and also an existing isolation building. Manure will be collected beneath the slatted floors of the animal husbandry buildings and conveyed by gravity to the one existing and one proposed HDPE lined manure storage facilities. In addition, the manure from the isolation building is stored beneath the building in a concrete storage pit. The capacity of the manure storage facilities is as follows: existing HDPE lined lagoon (3.29 million gallons); existing isolation building pit (.0308 gallon); and proposed HDPE lined lagoon (2.3 million gallons). A Water Quality Management Part II application was submitted to the Department for the proposed HDPE lined lagoon. Prior to operation of the proposed manure storage facilities, the design engineer will be required to submit certification that the facilities were constructed in accordance with appropriate Pennsylvania Technical Guide Standards. A release or discharge to waters of this Commonwealth under normal operating conditions is not expected. Normal operating conditions are defined as conditions below a 25-year, 24-hour storm event.
The Department has conducted administrative and technical reviews of the application. Based on the preliminary review and application of lawful standards and regulations, the Department has made a tentative determination to issue an NPDES permit for the operation subject to the terms and conditions and monitoring and reporting requirements specified in the permit.
The Department has scheduled a public hearing to receive testimony and comments on the proposed CAFO NPDES permit. The hearing will be held on Wednesday, September 10, 2003, at 7 p.m. at the Monroe Township Municipal Building, 247 Rock Hill Church Road, Clearville, PA 15535.
Persons intending to testify at the hearing should register by Friday, September 5, 2003, by calling Karen Sitler, (717) 705-4904. If no person registers to present oral comments by this deadline, the hearing will not be held. In addition, persons wishing to submit testimony, but cannot attend the hearing, may do so in writing by Wednesday, September 17, 2003. Written comments should be sent to Edward Muzic, Water Management Program, Permit Section, Southcentral Regional Office, 909 Elmerton Avenue, Harrisburg, PA 17110-8200.
All testimony should be to the point. Each individual will have between 5 and 10 minutes for the presentation, depending on the number of people registered. To ensure that all speakers have a fair and equal opportunity to present their testimony, relinquishing of time will be prohibited. Further details relating to the procedures to be followed at the hearing will be outlined at the beginning of the proceedings.

All comments received will be considered in formulating the Department's final determination regarding the application. Comments should include the name, address and telephone number of the writer and a concise statement to inform the Department of the basis of the comment and the relevant facts upon which it is based.
Following the 30-day comment period, the water management program manager will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time the determination may be appealed to the Environmental Hearing Board.
The EPA permit review waiver provision under 40 CFR 123.24(e) does not apply to this NPDES permit.
BUREAU OF DEEP MINE SAFETY
APPROVAL OF REQUEST FOR VARIANCE The Bureau of Deep Mine Safety (Bureau) has approved T. J. S. Mining, Inc.'s request for a variance from the requirements of section 242(c) of the Pennsylvania Bituminous Coal Mine Act (act) at the Rossmoyne No. 1 Mine. This notification contains a summary of this request and the basis for the Department's approval. Summary of the Request: T. J. S. Mining, Inc. requested a variance from section 242(c) of the act to allow for the common ventilation of belt conveyor entry with other entries at the Rossmoyne No. 1 Mine. The proposal accords protections to persons and property substantially equal to or greater than the requirements set forth in the act.
The basis for the Bureau's approval is summarized as follows:
1. The Pyott-Boone 9500 CO Monitoring System will provide advance warning of a developing mine fire originating in the conveyor belt entry. When maintained and operating correctly, this system provides warnings much earlier than the point type heat sensors.
2. Common entries would permit the larger section mantrip and scoops access to belt entry for transportation of personnel and supplies.
3. The operator will maintain a separate isolated intake escapeway that is at a higher air pressure than the belt and common entries.
4. The plan provides for the common entries to serve as an alternate intake escapeway. There will be a total of three separate, isolated escape routes.
This approval is limited to a variance from the requirements in section 242(c) of the act requiring that the belt entry is isolated from other entries. All other terms and requirements of section 242(c) of the act shall remain in effect. Continued authorization for operation under the approval is contingent upon compliance with the measures described in the plan and the following conditions:
1. All mine employees shall be task trained in the Pyott Boone Model 9500 CO monitoring system alert and alarm response procedures. These procedures shall also be included in the 8-hour annual retraining.
2. A test button shall be installed to allow a daily function check of the outside surface alarm system. A competent person shall make this daily function test and a record of this test maintained.
3. As part of the requirements of section 228 of the act, all belt entries, common entries and unfenced roadways shall be preshifted in their entirety.
4. A preshift date board should be placed at each CO sensor location.
5. Designated areas shall be established a strategic locations along the belt entry and common entry to determine whether the air is traveling in the proper course and normal volume. This air reading shall be taken by a scientific means (anemometer, chemical smoke tube, velometer).
