HAZARDOUS SITES CLEAN-UP UNDER THE ACT OF OCTOBER 18, 1988

Proposed Consent Order and Agreement

William Taylor Estate Site

Wheatland Borough, Mercer County

   Under section 1113 of the Hazardous Sites Cleanup Act (HSCA) (35 P. S. § 6020.1113), the Department of Envi-ronmental Protection (Department) has agreed to a Consent Order and Agreement (CO&A) with the Wheatland Conservation Authority (Authority) concerning the acquisition of the property containing the William Taylor Estate Site (Site) in Wheatland Borough, Mercer County. The Site is approximately 42 acres and includes a portion formerly utilized as a mixed waste landfill in a residential/industrial area. The landfill operated at the Site from approximately 1958 until mid-1970s and accepted industrial wastes containing hazardous substances from several industrial manufacturing operations.

   These wastes and other materials containing hazardous substances were dumped, spilled or otherwise disposed at the Site and these hazardous substances contaminated the soils and sediments at the Site. These substances are defined in section 103 of the HSCA (35 P. S. § 6020.103) as a ''hazardous substance.'' The presence of these hazardous substances at the property constitutes a ''release'' and a ''threat of release'' of a hazardous substance, as defined in section 103 of the HSCA.

   Two response actions were conducted at the Site. In 1991, the Department implemented an Interim Response at the Site that included, among other things, erection of a fence to control access to known areas of contamination. In 1998, a group of responsible persons, as defined in section 103 of the HSCA implemented a Remedial Response at the Site. That Response included, among other things, excavation and consolidation of areas of contamination, followed by capping, then regrading with an extension and maintenance of the fence installed in 1991. The Authority intends to obtain ownership of the property that includes the Site and utilize the property for nonintrusive, recreational usage by the public without profit by the Authority. By virtue of this ownership, the Authority will not become a ''responsible person'' as defined in sections 103 and 701 of the HSCA (35 P. S. § 6020.701).

   The specific terms of this settlement are set forth in the CO&A with the Authority. The Department will receive and consider comments relating to the CO&A for 60 days from the date of this notice. The Department has the right to withdraw its consent to the CO&A if the comments concerning the CO&A disclose facts or considerations which indicate that the CO&A is inappropriate, improper or not in the public interest. After the public comment period, the Department's settlement with Authority shall be effective upon the date that the Department notifies Authority, in writing, that this CO&A is final and effective in its present form and that the Department has filed a response to significant written comments to the CO&A, or that no comments were received.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995

PREAMBLE 2


The following final reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site where one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected.

   For further information concerning a final report, contact the environmental cleanup program manager in the Department regional office after which the notice of receipt of a final report appears. If information concerning a final report is required in an alternative form, contact the community relations coordinator at the appropriate regional office. ARCADIS Geraghty & Miller, 3000 Cabot Boulevard West, Suite 3004, Langhorne, PA 19047, on behalf of JMH, Inc. c/o Stevens & Lee, PC, P. O. Box 679, Reading, PA 19603-0679, submitted a combined Remedial Investigation and Final Report concerning remediation of site soils and groundwater contaminated with lead, heavy metals, solvents, BTEX, PHCs, PAHs, sulfate and chloride. The report is intended to document remediation of the site to a combination of the Statewide Health and Site-Specific Standards.

INFECTIOUS AND CHEMOTHERAPEUTIC WASTE GENERAL PERMITS


Permit Issued under the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003), the Municipal Waste Planning, Recycling and Waste Reduction Act (53 P. S. §§ 4000.101--4000.1904) and municipal waste regulations for a general permit to operate infectious and chemotherapeutic waste processing facilities.

Merck & Co. Inc., which has been authorized to operate under General Permit No. WMGI005 at two other locations since August 19, 1996, provided notice of their intent to operate at this new location. Merck & Co. Inc. was authorized by the Central Office on July 29, 2003, to operate under General Permit No. WMGI005 at the Wayne location.
