THE CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT

APPLICATIONS FOR NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS

   This notice provides information about persons who have applied for a new, amended or renewed NPDES or WQM permit, a permit waiver for certain stormwater discharges or submitted a Notice of Intent (NOI) for coverage under a General Permit. The applications concern, but are not limited to, discharges related to industrial, animal or sewage waste, discharges to groundwater, discharges associated with municipal separate storm sewer systems (MS4), stormwater associated with construction activities or concentrated animal feeding operations (CAFOs). This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92 and 40 CFR Part 122, implementing The Clean Streams Law (35 P. S. §§ 691.1--691.1001) and the Federal Clean Water Act.

   For NPDES renewal applications in Section I, the Department of Environmental Protection (Department) has made a tentative determination to reissue these permits for 5 years subject to effluent limitations and monitoring and reporting requirements in their current permits, with appropriate and necessary updated requirements to reflect new and changed regulations and other requirements.

   For applications for new NPDES permits and renewal applications with major changes in Section II, as well as applications for MS4 individual permits and individual stormwater construction permits in Sections IV and VI, the Department, based upon preliminary reviews, has made a tentative determination of proposed effluent limitations and other terms and conditions for the permit applications. These determinations are published as proposed actions for comments prior to taking final actions.

   Unless indicated otherwise, the EPA Region III Administrator has waived the right to review or object to proposed NPDES permit actions under the waiver provision in 40 CFR 123.24(d).

   Persons wishing to comment on an NPDES application are invited to submit a statement to the contact office noted before the application within 30 days from the date of this public notice. Persons wishing to comment on a WQM permit application are invited to submit a statement to the office noted before the application within 15 days from the date of this public notice. Comments received within the respective comment periods will be considered in the final determinations regarding the applications. Comments should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.

   The Department will also accept requests for a public hearing on applications. A public hearing may be held if the responsible office considers the public response significant. If a hearing is scheduled, a notice of the hearing will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. The Department will postpone its final determination until after any public hearings are held.

II. Applications for New or Expanded Facility Permits, Renewal of Major Permits and EPA Nonwaived Permit Applications

   Southeast Region:  Water Management Program Manager, Lee Park, Suite 6010, 555 North Lane, Conshohocken, PA 19428.

   PA0055913 Amendment No. 1, Industrial Waste, SIC 2819, Corco Chemical Corporation, Tyburn Road and Cedar Lane, Fairless Hills, PA 19030. This proposed facility is in Falls Township, Bucks County.

   Description of Proposed Activity:  Groundwater remediation system and noncontact cooling water discharge.

   The receiving stream, Corco Lake Nos. 1 and 2, is in the State Water Plan watershed 2E and is classified for WWF. The nearest downstream public water supply intake for Lower Bucks County Joint Municipal Authority is on the Delaware River, 3 miles below the point of discharge.

   The proposed effluent limits for Outfall 002 are based on a design flow of 115,000 gallons per day.

   Based on the effluent analysis report, the monitoring requirements for aluminum and zinc are removed from the Outfall 002.

   In addition to the effluent limits, the permit contains the following major special conditions:  groundwater monitoring; and test methods.

   PA0050016, Industrial Waste, SIC 3082, Markel Corporation, 435 School Lane, Plymouth Meeting, PA 19462. This proposed facility is in Plymouth Township, Montgomery County.

   Description of Proposed Activity:  Renewal of an NPDES permit to discharge 60,000 gpd of contact and noncontact cooling water.

   The receiving stream, Diamond Run, is in the State Water Plan watershed 3F and is classified for WWF, aquatic life, water supply and recreation. The nearest downstream public water supply intake for the City of Philadelphia is on the Schuylkill River, 10.9 miles below the point of discharge.

   The proposed effluent limits for Outfall 001 are based on a design flow of 60,000 gpd.

   In addition to the effluent limits, the permit contains the following major special conditions:  DMR to the Department; small stream discharge; no chemical additives; required test methods; change in ownership; and additional submission for TMDL analysis.

   The EPA waiver is in effect

   PA0056014, Industrial Waste, AMETEK, U. S. Gauge Division, Plant 2, 900 Clymer Avenue, Sellersville, PA 18960. SIC 3823. This application is for renewal of an NPDES permit to discharge treated groundwater from a groundwater remediation system serving AMETEK U. S. Gauge, Plant 2 in Sellersville Borough, Bucks County. This is an existing discharge to a dry swale to East Branch Perkiomen Creek.

   East Branch Perkiomen Creek is classified for TSF, aquatic life, water supply and recreation. The State Water Plan Watershed is 3E, Perkiomen. The nearest downstream public water supply intake for the Audubon Water Company is on the Perkiomen Creek, approximately 18 miles below the point of discharge.

   The proposed effluent limits for Outfall 001, based on an average flow of 0.108, are as follows:

   Major Permit Conditions:

   1.  Discharge is directed to a dry stream. If effluent creates a health hazard or nuisance, the permittee may be required to provide additional treatment as required by the Department.

   2.  No discharge of stripper tower cleaning wastewaters are permitted to waters of this Commonwealth.

   3.  The permittee shall monitor the groundwater quality in accordance with the Final Administrative Order of Consent.

   The EPA waiver is in effect.

   PA0013391, Industrial Waste, Tuscan/Lehigh Valley Dairies, Inc., 880 Allentown Road, Lansdale, PA 19446. This application is for issuance of an NPDES permit to discharge cooling water and stormwater from the Dairy Processing Plant, 880 Allentown Road, Lansdale, PA 19446 in Upper Gwynedd, Montgomery County. This is an existing discharge to an unnamed tributary to Towamencin Creek.

   The receiving stream is classified for TSF, HQ TSF, aquatic life, water supply and recreation.

   The proposed effluent limits for Outfall 001, based on an effluent discharge of 0.065 MGD and stormwater runoff from building roofs and parking areas are as follows:

   Outfalls 002--004 receive stormwater from grassy/gravel areas, parking areas and building roofs and shall be monitored once per 6 months for CBOD5, total kjeldahl nitrogen and total phosphorus.

   PA0024180, Sewage, Berks-Montgomery Municipal Authority, 136 Municipal Drive, Gilbertsville, PA 19525-0370. This application is for renewal of an NPDES permit to discharge treated sewage from the Berks-Montgomery Swamp Creek Sewage treatment plant in Douglass Township, Montgomery County. This is an existing discharge to Swamp Creek.

   The receiving stream is classified for TSF, aquatic life, water supply and recreation. Swamp Creek is in State Water Plan Watershed 3E (Perkiomen). The nearest downstream public water supply intake for the Audubon Water Company is on the Perkiomen Creek, approximately 19 miles below the point of discharge.

   The present effluent limits for Outfall 001, based on an average flow of 1.9 MGD, are applicable through completion of plant expansion, are as follows:

   2.  The permittee shall conduct whole effluent toxicity testing within 180 days after completion of plant expansion.

   3.  UV disinfection shall be utilized after completion of plant expansion.

   The proposed effluent limits for Outfall 001, based on an average flow of 2.3 MGD, will be applicable after completion of plant expansion, are as follows:

   PA0002488, Industrial Waste, SIC, 4911, Pennsylvania Power Company, P. O. Box 128, Shippingport, PA 15077-0128. This application is for renewal of an NPDES permit to discharge untreated stormwater and miscellaneous water from washing of gravel from its borrow pit in Georgetown Borough, Beaver County.

   The following effluent limitations are proposed for discharge to the receiving waters, Ohio River, classified as a WWF with existing and/or potential uses for aquatic life, water supply and recreation. The first existing/proposed downstream potable water supply is in Steubenville, OH, 24 miles below the discharge point.

   Outfall 001:  existing discharge, design flow of variable mgd.

   PA0002941, Industrial Waste, SIC, 4911, Allegheny Energy Supply Company, LLC, 4350 Northern Pike, Monroeville, PA 15146. This application is for renewal of an NPDES permit to discharge treated process water, sewage, stormwater, leachate and untreated cooling water and stormwater from Hatfield's Ferry Power Station in Monongahela Township, Greene County.

   The following effluent limitations are proposed for discharge to the receiving waters, of Monongahela River (Outfalls 001--006, 009, 010 and 013) and Little Whiteley Creek (Outfall 007), both classified as a WWF with existing and/or potential uses for aquatic life, water supply and recreation. The first existing/proposed downstream potable water supply is the Dunkard Valley Joint Municipal Authority, in Greensburg, PA, 6.46 miles below the discharge point.

   Outfall 001:  existing discharge, flow of 0.0023 mgd.

   PA0025950-A1, Sewage, Municipal Authority of the City of Monongahela, 521 West Main Street, Monongahela, PA 15063. This application is for amendment of an NPDES permit to discharge treated sewage from the City of Monongahela STP in Monongahela, Washington County.

   Description of Proposed Activity:  Existing discharge of treated sewage.

   For the purpose of evaluating effluent requirements for TDS, NO2-NO3, fluoride, phenolics, sulfate and chloride, the existing/proposed downstream potable water supply (stream and public water supplier) considered during the evaluation is the Hawthorn Borough Water Company on Redbank Creek, approximately 17 miles below point of discharge.

   The receiving stream, Redbank Creek, is in watershed 17-C and classified for TSF, aquatic life, water supply and recreation.

   The proposed effluent limits for Outfall 001 are based on a design flow of 1.25 MGD.
