COAL AND NONCOAL MINING ACTIVITY APPLICATIONS

   Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); and The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). Mining activity permits issued in response to the applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P. S. §§ 4001--4015); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003).

   The following permit applications to conduct mining activities have been received by the Department of Environmental Protection (Department). A copy of the application is available for inspection at the District Mining Office indicated before an application. Where a 401 Water Quality Certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for certification.

   Written comments, objections or requests for informal conferences on applications may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34.

   Where any of the mining activities listed will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. NPDES permits will contain, at a minimum, technology-based effluent limitations as identified in this notice for the respective coal and noncoal applications. In addition to the previous, more restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit, when necessary, for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). Persons or agencies who have requested review of the NPDES permit requirements for a particular mining activity within the previously mentioned public comment period will be provided with a 30 day period to review and submit comments on those requirements.

   Written comments or objections should contain the name, address and telephone number of the person submitting comments or objections; application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor; application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor wishes to have the conference conducted in the locality of the proposed mining activities.

Coal Applications Received

   Effluent Limits--The following coal mining applications that include an NPDES permit application will be subject to, at a minimum, the following technology-based effluent limitations for discharges of wastewater to streams:

ABANDONED MINE RECLAMATION

   Under Act 181 of 1984, the Department of Environmental Protection solicits letters of interest from the landowners and/or licensed mine operators for the reclamation of the following abandoned strip mine project:

   Project No. BF 465-101.1, Clinton Township, Venango County, 23.5 acres

   Letters of interest must be received by Roderick A. Fletcher, P. E., Director, Bureau of Abandoned Mine Reclamation, Department of Environmental Protection, 400 Market Street, P. O. PROJECTS UNDER THE ENVIRONMENTAL GOOD SAMARITAN ACT

   The Environmental Good Samaritan Act (27 Pa.C.S. §§ 8001--8114) provides certain protections and immunities from civil liability for landowners and persons who voluntarily undertake reclamation and abatement projects to address land and water adversely affected by mining or oil or gas extraction or exploration for natural resources and left in an unreclaimed condition or left discharging water pollution. For landowners and persons to qualify for immunity, the projects must be approved by the Department of Environmental Protection (Department).

   The following project proposals have been received by the Department. A copy of the proposals is available for inspection at the office indicated before each proposal.

   Written comments or objections may be submitted by any person or any office or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication.

   Written comments or objections should contain the name, address and telephone number of the person submitting comments or objections, the proposal identification number and a statement of sufficient detail to inform the Department of the basis of the comment or objection and the relevant facts upon which it is based.

Project Proposals Received

   Cambria District Mining Office: 286 Industrial Park Road, Ebensburg, PA 15931, (814) 472-1900.

   EGS 56006, Wells Creek Watershed Association, 1019 Pompey Hill Road, Stoystown, PA 15563. A water pollution abatement project to construct a passive abandoned mine drainage treatment system on 0.2 acre of the Robert and Mary Buterbaugh property and on 10.5 acres of the Ralph W. and David R. Moore property, 1 mile northeast of Listie on the east side of T-575 near the intersection of T-575 and T-610 in Somerset Township, Somerset County. Wells Creek is the receiving stream for this Adams Station No. 7 Project proposal. Project received October 2, 2003.

FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

   The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department of Environmental Protection (Department). Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the State to certify that the involved projects will not violate the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA or to the issuance of a Dam Permit, Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment must submit comments, suggestions or objections within 30 days of the date of this notice, as well as questions, to the office noted before the application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

   The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Individuals will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on each working day at the office noted before the application.

   E39-426. North Whitehall Township, 3256 Levans Road, Coplay, PA 18037 in North Whitehall Township, Lehigh County, U. S. Army Corps of Engineers, Philadelphia District.

   To remove the existing structure and to construct and maintain an open-bottom bridge having a 14-foot span and a 5.7-foot underclearance across Copeechan Creek (HQ-CWF). The project is on Copeechan Road (T-713), approximately 0.6 mile west of its intersection with SR 0873 (Slatedale, PA Quadrangle N:  10.6 inches; W:  0.3 inch).

   E40-626. City of Wilkes-Barre, 40 East Market Street, Wilkes-Barre, PA 18711 in City of Wilkes-Barre, Luzerne County, U. S. Army Corps of Engineers, Baltimore District.

   To remove the existing structure and to construct and maintain a single-span prestressed concrete spread box beam bridge, having a clear normal span of 39.0 feet and an underclearance of 12.0 feet, across Mill Creek (CWF). The bridge is along West Sidney Street, approximately 0.8 mile upstream of SR 0309 (Pittston, PA Quadrangle N:  3.3 inches; W:  13.2 inches).

   Southcentral Region: Water Management Program Manager, 909 Elmerton Avenue, Harrisburg, PA 17110.

   E44-124: Derry Township Board of Supervisors, 15 West Mill Street, P. O. Box 445, Yeagertown, PA 17099 in Burnham Borough and Derry Township, Mifflin County, ACOE Baltimore District.

   To remove the existing structure and then to construct and maintain a new bridge with a single clear span of 30 feet on a 75 degree skew with a minimum underclearance of 3.2 feet across Hungry Run (TSF) on T-430 (North Ridge Street) (Burnham, PA Quadrangle N:  2.9 inches; W:  8.0 inches) in Burnham Borough and Derry Township, Mifflin County.

   Northcentral Region: Water Management Program Manager, 208 West Third Street, Williamsport, PA 17701, (570) 327-3636.

   E17-391. Department of Transportation, District 2-0, 1924-30 Daisy Street, P. O. Box 342, Clearfield, PA 16830. US 219 Improvements in City of DuBois and Sandy Township, Clearfield County, ACOE Pittsburgh District (Falls Creek, PA Quadrangle N:  1.85 inches; W:  3.9 inches).

   The applicant proposes to widen SR 219 to accommodate a center turning lane and updated shoulders, intersection improvements at the SR 219/SR 4019 intersection, vertical and horizontal curve improvements, correction of mine subsidence failure area, along with the replacement of curb, sidewalk, drainage system and guide rail as required.

   De minimis impacts (0.049 acre) are proposed to an isolated palustrine wetland along the highway right of way, as a result of the widening.

   E41-529. Department of Transportation, Engineering District 3-0, P. O. Box 218, Montoursville, PA 17754-0218. Streambed paving under SR 0287 in Cogan House Township, Lycoming County, ACOE Susquehanna River Basin District (English Center, PA Quadrangle N:  3.1 inches; W:  0.4 inch).

   To perform streambed paving in an unnamed tributary to Second Fork of Larry's Creek along SR 0287, Segment 0300, Offset 0199. This project proposes to permanently impact 50 linear feet of the unnamed tributary (HQ-CWF) and does not propose to impact any jurisdictional wetlands.

   Southwest Region: Water Management Program Manager, 400 Waterfront Drive, Pittsburgh, PA 15222-4745.

   E02-1439. Allegheny County Department of Public Works, 501 County Office Building, 524 Forbes Avenue, Pittsburgh, PA 15219-2904. Scotia Hollow Road Bridge No. 1 in West Elizabeth Borough, Allegheny County, Pittsburgh ACOE District (Glassport, PA Quadrangle N:  4.4 inches; W:  4.3 inches) (Latitude: 40°16`30"--Longitude: 79°54`30"). The applicant proposes to remove the existing structures and to construct and maintain a 9-foot by 3-foot 4.5-inch concrete box culvert for a dis-tance of approximately 99.5 feet with a gabion lined channel for 34 feet on the downstream side and 32 feet on the upstream side and a soldier pile lagging wall on the upstream right bank side in and along a tributary to the Monongahela River (WWF), locally known as Scotia Run. The project is across Scotia Hollow Road approximately 1,500 feet north of its intersection with State Road. This project will impact approximately 271 feet of stream channel.

   E04-240 A1. Beaver Falls Municipal Authority, 1425 Eighth Avenue, P. O. Box 400, Beaver Falls, PA 15010. Eastvale Water Treatment Plant, New Clear Well Project in Eastvale Borough and Daugherty Township, Beaver County, Pittsburgh ACOE District (Latitude: 40°45`40" and Longitude: 80°18`46") (Beaver Falls, PA Quadrangle N:  2.0 inches; W:  8.7 inches). The applicant proposes to amend Permit E04-240, which authorized the construction and maintenance of an intake structure with necessary appurtenance to improve intake capacity, to construct and maintain a backwash water tank and a riprap outlet channel and to place and maintain fill in 0.16 acre of wetlands to improve discharge to the Beaver River. This permit amendment will authorize the construction and maintenance of a new clear well facility and ancillary system with it associated fill and to relocate and maintain two stormwater outfalls to the Beaver River (WWF). The facility is along the left bank side of the Beaver River at the existing Eastvale Water Treatment Plant. This project will place fill in the floodway of the left bank of the Beaver River for a distance of approximately 370 feet.

   E32-453. P. C. Exploration, Inc., 502 Keystone Drive, Warrendale, PA 15086. Clark Stream Culvert in Grant Township, Indiana County, Pittsburgh ACOE District (Rochester Mills, PA Quadrangle N:  5.7 inches; W:  7.1 inches) (Latitude: 40°46`53"--Longitude: 78°55`35"). The applicant proposes to operate and maintain an existing stream crossing having 14 1-foot diameter pipes in Rairigh Run (HQ CWF) for the purpose of gaining access to a natural gas well. The existing temporary stream crossing was authorized under General Permit No. 083202208. The project is approximately 1,600 feet downstream from T-932.

   E56-324. Texas Eastern Transmission, LP, 5400 Westheimer Court, Houston, TX 77056. Texas Eastern Transmission Dominion Expansion Project in Allegheny, Brothersvalley and Somerset Townships, Somerset County, Pittsburgh ACOE District (Start: Latitude: 39°56`12" and Longitude: 79°0`5.4" and End: Latitude: 39°55`59" and Longitude: 78°46`16.32") (Start: Murdock, PA Quadrangle N:  11.25 inches; W:  0.3 inch and End: New Baltimore, PA Quadrangle N:  10.55 inches; W:  2.9 inches). The applicant proposes to remove the existing pipeline and to install and maintain a 36-inch CRP pipeline system and distribute natural gas. The utility line will reportedly cross 88 feet of watercourse including Millers Run (CWF), Stony Creek (CWF), an unnamed tributary to Stony Creek (CWF) and unnamed tributary to Reitz Creek (CWF), Raystown Branch Juniata River (CWF), an unnamed tributary to Raystown Branch Juniata River (CWF), Hillegas Run (HQ-CWF) and unnamed tributaries to Hillegas Run (HQ-CWF) and will impact 3.9 acres of PEM, PSS and PFO wetlands.

   E56-326. Conemaugh Township Supervisors, 1120 Tire Hill Road, Johnstown, PA 15905-7707. Tire Hill sewage treatment plant in Conemaugh Township, Somerset County, Pittsburgh ACOE District (Johns-town, PA Quadrangle N:  4.9 inches; W:  6.0 inches) (Latitude: 40°16`36"--Longitude: 78°55`04"). The applicant proposes to construct and maintain the Tire Hill Sewage Treatment Plant in the 100-year flood plain along the left side of Stony Creek (WWF). The sewage treatment plant will occupy approximately 1.83 acres. The project is at the end of Greenhouse Park Road, 1500 feet east of Tire Hill Road (SR 403).

   E63-553. City of Monongahela, 449 West Main Street, Monongahela, PA 15063. Sanitary Sewer System in the City of Monongahela, Washington County, Pittsburgh ACOE District (Monongahela, PA Quadrangle N:  13.5 inches; W:  7.5 inches) (Latitude: 40°11`56"-- Longitude: 79°55`44"). The applicant proposes to construct and maintain a sanitary sewer line in, along and across the channels of Pigeon Creek and Dry Run (WWF) for the purpose of providing sewer services to residents. The project is on the east side of Nelson Street, just north from the intersection of East Main Street and Nelson Street.

   E65-826. Salem Township, Congruity Road, R. D. 4, Box 200, Greensburg, PA 15601. Mark Drive Pipe Replacement in Salem Township, Westmoreland County, Pittsburgh ACOE District (Latitude: 40°24`0"--Longitude: 79°34`22") (Slickville, PA Quadrangle N:  4.5 inches; W:  11.3 inches). The applicant proposes to rehabilitate and maintain an existing 75-foot long, 72-inch reinforced concrete pipe culvert in an unnamed tributary to Beaver Run (HQ-CWF) including the placement of an endwall at the culvert outlet as part of the SR 0022, Section B02 improvement project. The project will directly impact 75 linear feet of perennial stream. No vegetated wetlands will be impacted. The project is on Mark Drive (T-710), approximately 200 feet from its intersection with SR 0022.

   E65-827. Department of Transportation, District 12-0, P. O. Box 459, Uniontown, PA 15401. SR 0022 section BO2 Widening Project from Murrysville to Delmont in the Municipality of Murrysville and Salem Township, Westmoreland County, Pittsburgh ACOE District. The applicant proposes to conduct the following activities as part of the SR 0022 Section B02 mainline widening project:

   1.  SR 0022, Station 182+25 (Structure 1) (Latitude: 40°24`57"; Longitude 79°38`2.44") to extend and maintain an existing 312.0-foot long concrete arch culvert having a normal span of 12.0 feet and a rise of 8.24 feet in kind 21.25 feet downstream in an unnamed tributary to Turtle Creek (TSF).

   2.  SR 0022, Station 226+25 (Structure A) (Latitude: 40°24`44"; Longitude: 79°37`38") to extend and maintain an existing 276.0-foot long concrete arch culvert having a normal span of 4.0 feet and a rise of 3.55 feet, in kind 5.0 feet upstream and 43.0 feet downstream in an unnamed tributary to Turtle Creek.

   5.  SR 0022, Station 314+80 (Structure 6) (Latitude: 40°24`14"; Longitude: 79°35`39") to extend and maintain an existing 134.0-foot concrete arch culvert having a normal span of 8.0 feet and a rise of 7.0 feet in kind 167.75 feet upstream in an unnamed tributary to Turtle Creek.

   6.  SR 4026, Station 12+64 (Structure B) (Latitude: 40°24`15"; Longitude: 79°36`01") to remove the existing structure and to construct and maintain an 88.0-foot long, 1.0-foot depressed, concrete box culvert having a normal span of 7.0 feet and an underclearance of 3.5 feet in an unnamed tributary to Turtle Creek.

   7.  SR 0022, Station 295+25 left (Jughandle SR 9429) (Latitude: 40°24`31"; Longitude: 79°36`16") to place and maintain fill along 58.0 feet of an unnamed tributary to Turtle Creek.

   8.  SR 0022, Station 366+00 (Latitude: 40°24`00"; Longitude: 79°34`22") to construct and maintain a bottom slab 1.0 foot thick for an existing concrete arch culvert having a normal span of 8.0 feet and a rise of 6.0 feet and to extend and maintain the existing 158.0-foot culvert in kind 230.53 feet upstream in an unnamed tributary to Beaver Run (HQ-CWF).

   9.  To permanently place and maintain fill in 10 wetland areas: (a) 0.752 acre of PEM; (b) 0.121 acre of PSS; (c) 0.05 acre of PFO; and (d) 0.01 acre of POW and to construct 0.923 acre of replacement wetlands as compensation for wetland impacts.

   The applicant proposes to remove the existing structure and to construct and maintain steel beam bridge no. 2812 having a clear span of 42.96 feet and an underclearance of 8 feet across Hogback Run (WWF, perennial) on Haywood Street approximately 0.4 mile southeast of the intersection of U. S. Interstate 80 and SR 18.

FINAL ACTIONS TAKEN FOR NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS

   The Department of Environmental Protection (Department) has taken the following actions on previously received applications for new, amended and renewed NPDES and WQM permits, applications for permit waivers and Notices of Intent for coverage under General Permits. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92 and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P. S. §§ 691.1--691.1001) and the Federal Clean Water Act.

Section VII contains notices for parties who have submitted Notices of Intent (NOI) for coverage under General NPDES Permits. The approval for coverage under these General NPDES Permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions set forth in each general permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions set forth in the respective permit. The permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

   Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period.
