PUBLIC WATER SUPPLY (PWS) PERMITS The Department of Environmental Protection has taken the following actions on applications received under the Safe Drinking Water Act for the construction, substantial modification or operation of a public water system.
Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create any right of appeal beyond that permitted by applicable statutes and decision law.
For individuals who wish to challenge an action, appeals must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

HAZARDOUS SITES CLEAN-UP UNDER THE ACT OF OCTOBER 18, 1988
Proposed Consent Order and Agreement
Quaker City Gear Site
Lower Moreland Township, Montgomery CountyThe Department of Environmental Protection (Department), under the authority of section 1113 of the Hazardous Sites Cleanup Act (HSCA) (35 P. S. § 6020.1113), has entered into a Prospective Purchaser Consent Order and Agreement (CO&A) with Nolan Brothers of Texas, Inc. (Nolan Bros.) for reimbursement of certain response costs incurred to remediate hazardous substances released and threatened to be released at the Quaker City Gear Site, 351 Red Lion Road, Huntingdon Valley, Lower Moreland Township, Montgomery County (Site). This Site is the former location of metal working and gear manufacturing operations. The Department has performed response actions at this Site including an environmental assessment and field investigation of the Site, the characterization of abandoned drums of liquid hazardous substances on the Site and the removal and lawful disposal of these drums at a permitted facility.
Nolan Bros. wishes to purchase the Site and intends to develop it for use as a self-storage facility. In connection with its purchase of the Site, Nolan Bros. wishes to resolve its potential liability to the Department for reimbursement of certain response costs incurred to investigate and remediate abandoned drums of hazardous substances on the Site. The Department has determined that it is in the public interest to resolve its claim against Nolan Bros. Therefore, Nolan Bros. has agreed to reimburse the Department for certain response costs in the amount of $5,000 and shall receive contribution protection from claims related to its future ownership of this property.
This notice is provided under section 1113 of the HSCA, which states that ''settlement shall become final upon the filing of the Department's response to the significant written comments.'' The CO&A, which contains the specific terms of the agreement, is available for public review and comment. The CO&A can be examined from 8 a.m. to 4 p.m. at the Department's Southeast Regional Office, Lee Park, Suite 6010, 555 North Lane, Conshohocken, PA 19428 by contacting David Ewald, (610) 832-6200, dewald@state.pa.us or Gina M. Interim Response under the Hazardous Sites Cleanup Act
Smiley Drum Garage Site
East Pennsboro Township, Cumberland CountyThe Department, under the authority of the HSCA (35 P. S. §§ 6020.102--6020.1303), is initiating a prompt interim response at the Smiley Garage Drum Site (Site) at the intersection of Enola Road (Route 11/15) and Susquehanna Avenue (a/k/a North Enola Road) in East Pennsboro Township, Cumberland County. The Site is an inactive automobile repair garage and service station with a mailing address of 101 North Enola Road. The property and buildings are part of the Ross H. Smiley Estate.
For the past several years, 21 55-gallon drums of used motor oil (nonaqueous) sludge have been abandoned on the Site. The sludge was generated from the clean-out of an onsite sludge pit. The drums are currently stored on the property, but the building is in disrepair and not secure. Sampling of the drummed motor oil sludge has shown it to contain hazardous substances. East Pennsboro Township officials have concerns for safety and protection of public health with respect to the abandoned drums.
The Department considered two alternatives: (1) no action, which allows the drums to remain in place; and (2) drum removal and disposal at an appropriate treatment/disposal facility. The Department chose alternative 2 and removed the drums prior to developing the Administrative Record to be protective of human health and safety and the environment. The cost of this action is estimated at $12,215.
The Department is providing this notice under sections 505(b) and 506(b) of the HSCA (35 P. S. §§ 6020.505(b) and 6020.506(b)) and the publication of this notice starts the Administrative Record period under the HSCA. The Administrative Record, which contains information about the Site and supports the Department's decision to perform this action at the Site, is available for public review and comment. The Administrative Record can be examined from 8 a.m. to 4 p.m. at the Department's Southcentral Regional Office, 909 Elmerton Avenue, Harrisburg, PA 17110 by contacting Asuquo Effiong, (717) 705-4853.
The Administrative Record will be open for comment from November 1, 2003, and will remain open for 90 days. Persons may submit written comments regarding this action to the Department before January 24, 2003, by mailing them to Asuquo Effiong at the previous address.
The public will have an opportunity to present oral comments regarding the proposed action at a public hearing, scheduled for December 15, 2003, at 7 p.m. at the Southcentral Regional Office, 909 Elmerton Avenue, Harrisburg, PA. An informational meeting will be held following the hearing.
