Rescission Order By the Commission:
On September 16, 2002, the Commission entered a Tentative Order against Dialaround Enterprises, Inc. (Dialaround), an IXC reseller certificated at A-311125, for failure to file with the Commission an annual assessment report for the year ending December 31, 2001. The Tentative Order, which sets forth a process to cancel Dialaround's certificate of public convenience, was published on September 28, 2002, at 32 Pa.B. 4794.
Since the issuance of the Tentative Order, Dialaround has filed the annual assessment report for the year ending December 31, 2001. In a separate letter dated September 26, 2002, to Secretary James McNulty, Dialaround stated that it had no Pennsylvania customers or revenues for 2001, and apologized for the late filing. Dialaround stated that it has experienced intermittent postal delivery problems where mail has not been delivered or delivered to another communications company located in the same building. Dialaround requests that the Tentative Order be rescinded.
The Commission is satisfied that Dialaround's non-response was inadvertent and that future filings will be made on time; Therefore,
It Is Ordered That:
1. The Tentative Order entered September 16, 2002, is hereby rescinded.
2. A copy of the Order be published in the Pennsylvania Bulletin.
