THE CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT
APPLICATIONS FOR NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS This notice provides information about persons who have applied for a new, amended or renewed NPDES or WQM permit, a permit waiver for certain stormwater discharges or submitted a Notice of Intent (NOI) for coverage under a general permit. The applications concern, but are not limited to, discharges related to industrial, animal or sewage waste, discharges to groundwater, discharges associated with municipal separate storm sewer systems (MS4), stormwater associated with construction activities or concentrated animal feeding operations (CAFOs). This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92 and 40 CFR Part 122, implementing The Clean Streams Law (35 P. S. §§ 691.1--691.1001) and the Federal Clean Water Act.

For applications for new NPDES permits and renewal applications with major changes in Section II, as well as applications for MS4 individual permits and individual stormwater construction permits in Sections IV and VI, the Department, based upon preliminary reviews, has made a tentative determination of proposed effluent limitations and other terms and conditions for the permit applications. These determinations are published as proposed actions for comments prior to taking final actions.
Unless indicated otherwise, the EPA Region III Administrator has waived the right to review or object to proposed NPDES permit actions under the waiver provision in 40 CFR 123.24(d).
Persons wishing to comment on an NPDES application are invited to submit a statement to the regional office noted before an application within 30 days from the date of this public notice. Persons wishing to comment on a WQM permit application are invited to submit a statement to the regional office noted before the application within 15 days from the date of this public notice. Comments received within the respective comment periods will be considered in the final determinations regarding the applications. Comments should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.
The Department will also accept requests for a public hearing on applications. A public hearing may be held if the responsible office considers the public response significant. If a hearing is scheduled, a notice of the hearing will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. The Department will postpone its final determination until after a public hearing is held.

Description of Proposed Activity: Discharge of treated filter backwash from the water filtration plant.
The receiving stream, Perkiomen Creek, is in the State Water Plan Watershed 3E and is classified for TSF. The nearest downstream public water supply intake for the Philadelphia Suburban Water Company is on the Perkiomen Creek, 26.84 miles below the point of discharge.
The following proposed effluent limits for Outfall 001 are based on a design flow of 16,000 gpd:

This application is for issuance of an NPDES permit to discharge treated sewage from a single residence STP in Upper Salford Township, Montgomery County. This is an existing discharge to an unnamed tributary to Vaughns Run.
The receiving stream is classified for WWF, aquatic life, water supply and recreation. The discharge is in State Water Plan 3E, Perkiomen Watershed. The nearest downstrem public water supply intake is on the Perkiomen Creek, approximately 8 miles below the discharge point.
The proposed effluent limits for Outfall 001, based on an average flow of 400 gpd, are as follows:

Description of activity: Renewal of an NPDES permit for existing discharge of treated sewage.
The receiving stream, Little Juniata River, is in Watershed 11-A and classified for trout stocking, water supply, recreation and fish consumption. The nearest downstream public water supply intake for the Newport Borough Water Authority is on the Juniata River, approximately 118 miles downstream. The discharge is not expected to affect the water supply.

PA0246379, CAFO, Blevins Blue Mountain Finishing Farm, LLC (Blue Mountain Finishing Farm), 10315 Otterbein Church Road, Newburg, PA 17240. Blevins Blue Mountain Finishing Farm, LLC has submitted an application for an Individual NPDES permit for an existing CAFO known as Blue Mountain Finishing Farm, 10391 Otterbein Church Road, Lurgan Township, Franklin County.
The CAFO is situated near an unnamed tributary of Clippingers Run in Watershed 7-B (WWF). The CAFO is designed to maintain an animal population of approximately 579 AEUs consisting of 4,800 finishing swine, 20 beef cows and 15 beef calves. The swine are housed in four finishing barns. Manure drains into an HDPE-lined manure storage facility. The total capacity of the manure storage facility is approximately 4 million gallons.
The Department has conducted administrative and technical reviews of the application. Based on the preliminary review and application of lawful standards and regulations, the Department has made a tentative determination to issue an NPDES permit for the operation subject to the terms and conditions and monitoring and reporting requirements specified in the permit.
The permit application and draft permit are on file at the Southcentral Regional Office. Individuals may make an appointment to review the files by calling the File Review Coordinator at (717) 705-4732.
Persons wishing to comment on the proposed permit are invited to submit written comments to the previous address within 30 days from the date of this public notice. Comments received within this 30-day period will be considered in formulating the Department's final determination regarding the application. Comments should include the name, address and telephone number of the writer and a concise statement to inform the Department of the basis of the comment and the relevant facts upon which it is based.
Following the 30-day comment period, the water management program manager will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time the determination may be appealed to the Environmental Hearing Board.
The EPA permit waiver provision under 40 CFR 123.24(e) does not apply to this NPDES permit.
Northcentral Region: Water Management Program Manager, 208 West Third Street, Williamsport, PA 17701.PA0024406, Sewage 4952, Mount Carmel Municipal Authority, 18 East Fifth Street, P. O. Box 365, Mount Carmel, PA 17851-0365. This existing facility is in Mount Carmel Borough, Northumberland County.
Permit No. PA0024406 is being amended for the following reasons:
--To correct a technical mistake or mistaken interpretation of law in Part C Special Condition 4--management and control of combined sewer overflows. Special Condition 4 has been amended to clarify that compliance with the requirements of EPA guidance documents no. 832-B-95-002 entitled ''Guidance For Long Term Control Plan'' and no. 832-B-95-003 entitled ''Guidance For Nine Minimum Control Measures'' is required. There are no changes to effluent limits.
--To correct the latitudes and longitudes on pages 2a and 2b of the permit.
--To remove abandoned combined sewer overflow Outfall 011 from the permit.
--To add two site stormwater outfalls, S01 and S02, as required by the EPA's Phase II stormwater regulations. New Part C Special Condition 5--requirements applicable to stormwater outfalls. Annual stormwater inspection certification will be required, instead of chemical monitoring.
PA0021814, Sewage 4952, Mansfield Borough, 19 East Wellsboro, Mansfield, PA 16933. This existing facility is in Mansfield Borough, Tioga County.
This proposed action is for the renewal of an NPDES permit for the discharge of treated sewage to the Tioga River in Mansfield Borough, Tioga County. The receiving stream is classified for CWF, aquatic life, water supply and recreation.
For the purpose of evaluating effluent requirements for TDS, NO2-NO3, fluoride and phenolics, the existing downstream potable water supply considered during the evaluation is the NY/PA state border, approximately 17.0 river miles downstream.

The receiving stream, the Stillwater Creek, is in watershed 16-B and classified for CWF, aquatic life, water supply and recreation.
The proposed effluent limits for Outfall 001 are based on a design flow of 0.2 MGD.

Description of Size and Scope of Proposed Operation/Activity: The Mark E. Leinbach farm is an existing hog operation with intent to expand a facility with a total AEUs of 795.15. The operation will include 5,860 finishing hogs and 150 Jersey heifers with an estimated total annual manure production of 15,084 tons. The manure storage system consists of three barns with shallow pit manure storages that flow from the shallow pits to an outside HDPE-lined lagoon. For 2 months in the summer, a neighboring farmer grazes approximately 150 head of heifers on a 45-acre mixed hay field. The 243 tons of heifer manure produced is used on the farm. Of the 3,576,205 gallons of swine manure generated, 2,001,600 gallons is used on the farm with the remaining 1,574,605 gallons being exported from the farm.
The receiving stream, Muddy Run, is in watershed 7-A and classified for WWF.
The proposed effluent limits for the operation/activity include: Except for the chronic or catastrophic rainfall events defined as over the 25-year/24-hour rain storms, the CAFO general permit is a nondischarge NPDES permit. Where applicable, compliance with 40 CFR Federal effluent limitation guidelines is required. The general permit requires no other numeric effluent limitations and compliance with the Pennsylvania Nutrient Management Act and The Clean Streams Law constitutes compliance with the State narrative water quality standards.
