Order And Now, August 17, 2004, it is hereby Ordered And Decreed that the following local Rule for Jury Costs On Continuance Of A Cause Of Action in the 23rd Judicial District composed of Berks County be, and the same is, promulgated herewith, to become effective thirty (30) days after the publication of the rule in the Pennsylvania Bulletin; that seven (7) certified copies shall be filed with the Administrative Office of Pennsylvania Courts; that two (2) certified copies shall be filed with the Legislative Reference Bureau for publication in the Pennsylvania Bulletin; that one (1) certified copy shall be filed with the Civil Procedural Rules Committee; and that one (1) copy shall be filed with the Clerk of Courts of Common Pleas of Berks County.
Rule 217.3 Jury Costs on Continuance of a Cause of Action
When a continuance is granted upon application, the Court may impose on the party making the application for continuance, the reasonable costs actually incurred by the County and/or the jurors in impaneling a jury.
When a continuance has been granted and costs imposed, the party upon whom such costs have been imposed may not, so long as such costs remain unpaid, take any further step in such or any other suit without prior leave of court.
