This permit was issued under a Project XL agreement between the Department and the United States Environmental Protection Agency (EPA). Project XL is EPA's program to test innovative approaches to environmental protection using regulatory flexibility to achieve superior environmental performance. Under Project XL, a Consent Order and Agreement between River Hill Coal Company, Inc. and the Department was executed on December 23, 2004. The purpose of this agreement is to improve water quality in the UNT-E to Conemaugh River (Indiana County) through encouraging remining and acid mine drainage abatement measures. The agreement will base compliance on in-stream water quality and the implementation of best management practices, instead of numeric effluent limitations measured at individual discharge points. The agreement applies only to this surface mining permit. UNT-E to Conemaugh River is one of up to eight acid mine drainage impacted watersheds where this approach under Project XL will be evaluated. FEDERAL WATER POLLUTION CONTROL ACT SECTION 401 The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).
Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.
Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. To remove the existing structure and to construct and maintain an 11.0-foot wide, five-span bridge having normal spans of 11.0 feet, 12.0 feet, 14.0 feet, 14.0 feet, and 13.0 feet and a minimum underclearance of 2.1 feet across Jacobs Creek, and to place and maintain riprap along the outer abutments. The project is located off of SR 1027, 1 mile south of its intersection with SR 819.

To remove the existing bridge and to construct and maintain a 43-foot wide prestressed concrete I-beam bridge having two clear spans 137 feet, one span of 122 feet and an underclearance of 44.5 feet across Pine Hollow Run on SR 0518, Section A00, Segment 0160, Offset 0575 approximately 1,500 feet east of SR 18. The proposed bridge is on a new alignment upstream of the existing bridge and involving realignment of a total of approximately 2,700 feet of roadway. Two temporary stream crossings will be utilized consisting of a series of six 35-foot long culverts and clean rock fill located approximately 200 and 350 feet upstream of the existing SR 518 bridge.
