   The Department of Environmental Protection has taken the following actions on applications received under the Pennsylvania Safe Drinking Water Act (35 P. S. §§ 721.1--721.17) for the construction, substantial modification or operation of a public water system.

   Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary of the Board at (717) 787-3483. This paragraph does not, in and of itself, create any right of appeal beyond that permitted by applicable statutes and decision law.

HAZARDOUS SITES CLEAN-UP UNDER THE ACT OF OCTOBER 18, 1988

Proposed Consent Order and Agreement

Vandor Manufacturing Site, Doylestown Township, Bucks County

   The Department of Environmental Protection (Department), under the authority of Section 1113 the Hazardous Sites Cleanup Act (HSCA) (35 P. S. of § 6020.1113), has entered into a Consent Order and Agreement with the Estate of Francis Dring Wetherill (Estate) for reimbursement of certain response costs incurred to remediate hazardous substances released and threatened to be released at the Vandor Manufacturing Site (site) in Bucks County.

   Between 1962 and 1994, Neshaminy Transformer Corporation (also known as Neshaminy Electronics Corporation) manufactured transformers and other electronic componants at the site. Francis Dring Wetherill (Wetherill) owned a portion of the site from 1962 until 1984. The Department's investigation of this site indicated the presence of trichloroethylene and perchloroethylene contamination. The Department has performed an environmental assessment and characterization of the site and anticipates conducting future response actions to address hazardous substances released at the site.

   As a former owner of a portion of the site, Wetherill was a responsible party under section 701 of the HSCA (35 P. S. § 6018.701). Consequently, the Department had a claim against the Estate for response costs incurred at the site. It is in the public interest for the Department to resolve its claim against the Estate. The Department and the Estate have negotiated in good faith and the Estate has agreed to reimburse the Department for certain response costs in the amount of $236,000. The Estate shall receive contribution protection from claims related to Wetherill's past ownership of a portion of the site.

   This notice is provided under section 1113 of the HSCA which states that, ''settlement shall become final upon the filing of the Department's response to significant written comments.'' The Consent Order and Agreement, which contains the specific terms of the agreement, available for public review and comment. The agreement can be examined from 8 a.m. to 4 p.m. at the Department's Southeast Regional Office, 2 East Main Street, Norristown, PA by contacting either David Minsker, PhD., (484) 250-5731, dminsker@state.pa.us or Gina M.
