LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995

PREAMBLE 3


The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of 25 Pa. Code § 250.8, administration of the Land Recycling and Environmental Remediation Standards Act (act), require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by provisions of the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media, benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by provisions of the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

   For further information concerning the plans and reports, contact the Environmental Cleanup Program manager in the Department regional office before which the notice of the plan or report appears. If information concerning a final report is required in an alternative form, contact the Community Relations Coordinator at the appropriate regional office.    The Department has received the following plans and reports:

   Southeast Region: Environmental Cleanup Program Manager, 2 East Main Street, Norristown, PA 19401.

   Symphony House, City of Philadelphia, Philadelphia County. Paul Martino, Pennoni Assoc., Inc., One Drexel Plaza, 3001 Market St., Philadelphia, PA 19104 has submitted a Final Report concerning the remediation of site soil and groundwater contaminated with unleaded gasoline. The Final Report demonstrated attainment of the Statewide Health Standard and was approved by the Department on August 19, 2005.

   Elliot Res., Lower Pottsgrove Township, Montgomery County. Heath Brown, Environmental Standards, Inc., 1140 Valley Forge Rd., P. O. Box 810, Valley Forge, PA 19482 on behalf of Dennis Elliott, 567 Evans Rd., Pottstown, PA 19464 has submitted a Final Report concerning the remediation of site soil contaminated with unleaded gasoline. The Final Report demonstrated attainment of the Statewide Health Standard and was approved by the Department on August 17, 2005.

   Northeast Regional Field Office, Joseph A. Brogna, Environmental Cleanup Program Manager, 2 Public Square, Wilkes-Barre, PA 18711-0790, (570) 826-2511.

   Dumitru and Viccaro Residences, Borough of Stroudsburg, Monroe County. Alana Kopicz, Environmental Scientist, Patriot Environmental Management, LLC, P. O. Box 629, Douglassville, PA 19518 submitted a Final Report (on behalf of Adrian Dumitru and Anthony Viccaro, both of Lee Avenue, Stroudsburg, PA 18360) concerning the remediation of soils found or suspected to have been impacted by an accidental release of home heating oil. The report demonstrated attainment of the residential Statewide health soil standard and was approved on July 28, 2005.

   Former Penn Fuel Gas Manufactured Gas Plant--Ashland site, Ashland Borough, Schuylkill County. John Mahfood, Corporate Environmental Solutions, 260 Millers Run Road, Bridgeville, PA 15017 submitted a combined Risk Assessment Report and Cleanup Plan (on behalf of his client, PPL Gas Utilities, Inc, Two North Ninth St., Allentown, PA 18101) concerning the risk assessment of and proposed remediation for soils and groundwater found or suspected to have been contaminated with inorganics, polycyclic aromatic hydrocarbons and other organic compounds related to historic manufactured gas plant operations. The reports were submitted in partial fulfillment of a combination of both the Statewide Health and the Site-Specific Standards, and were approved on August 17, 2005.

   Former Allen Hardware (1941 Hamilton Street), City of Allentown, Lehigh County. MEA, Inc., 1365 Ackermanville Road, Bangor, PA 18013 submitted a Final Report (on behalf of their client, St. Luke's Hospital, 801 Ostrum Street, Bethlehem, PA 18015) concerning the remediation of soils and groundwater found or suspected to have been contaminated with gasoline constituents presumably as the result of leakage from underground storage tanks related to historical site operations. The report document attainment of the Statewide Health Standard and was approved on August 3, 2005.

   PPL Distribution Pole No. 64751S47824 (corner of Glendale & Keystone Avenues), Bethlehem Township, Lehigh County. Jennifer Sedora, PPL Services, Two North 9th Street, Allentown, PA 18101 submitted a Final Report concerning the remediation of soils found or suspected to have been contaminated with PCB Arochlor 1260 oil as the result of an accidental release. The report documented attainment of the residential Statewide Health Standard and was approved on August 8, 2005. The report was submitted within 90 days of the May 2, 2005 release.

   Southcentral Region: Environmental Cleanup Program Manager, 909 Elmerton Avenue, Harrisburg, PA 17110.

   Agway Lebanon Surplus Property, West Lebanon Township, Lebanon County. Groundwater Sciences Corporation, 2601 Market Place Street, Suite 310, Harrisburg, PA 17110, on behalf of Agway, Inc., 333 Butternut Drive, Syracuse, NY, 13214, submitted a Remedial Investigation Report concerning remediation of site soils and groundwater impacted by petroleum hydrocarbons, pesticides, herbicides, and coal tar. The site is being remediated to a Site Specific Standard. The Department on August 15, 2005, approved the report.

   Turkey Hill Store 185, West Earl Township, Lancaster County. Environmental Consulting, Inc., 500 East Washington Street, Norristown, PA 19401, on behalf of Turkey Hill Minit Markets, 257 Centerville Road, Lancaster, PA 17603, submitted a Final Report concerning remediation of site soils contaminated with unleaded gasoline. The report had been submitted within 90 days of a release. The final report demonstrated attainment of the residential Statewide Health standard, and was approved by the Department on August 18, 2005.

HAZARDOUS WASTE TREATMENT, STORAGE AND DISPOSAL FACILITIES


Permit issued under the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003) and regulations to operate a hazardous and residual waste storage and treatment facility

RESIDUAL WASTE GENERAL PERMITS


Permit issued under the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003), the Municipal Waste Planning, Recycling and Waste Reduction Act (53 P. S. §§ 4000.101--4000.1904), and residual waste regulations for a General Permit to operate residual waste processing facilities and the beneficial use of residual waste other than coal ash.

   General Permit No. WMGR104. Vortex Recycling, 526 South Jefferson Street, New Castle, PA 16101. The permit was issued by Central Office on June 15, 2005.

The initial permit was originally issued on May 4, 2000. Duferco owns two steam boilers, three slab reheat furnaces, 60" hot strip mill, 60" hot strip hand scarfing, No. 21 slitter, No. 2 shot blast, No. 7 pickle line, No. 4 tandem mill, twelve anneal furnaces, No. 28 tamper mill, No. 2 shear, No. 26 slitter, No. 1 tension leveler, slab cutting torch, emergency diesel engine, No. 35 temper mill and IT building standby generator. As a result of potential emissions of NOx and VOC, the facility is minor for NOx but is major for VOC, and is therefore subject to Reasonable Available Control Technology. The facility is subject to Title V permitting requirements adopted in 25 Pa. Code Chapter 127, Subchapter G. No sources at the facility are subject to Compliance Assurance Monitoring (CAM) under 40 CFR Part 64. The proposed Title V operating permit contains all applicable regulatory requirements including monitoring, recordkeeping and reporting conditions.

   This is in reference to the information submitted to our office on April 5, 2005, requesting an amendment to Permit No. E51-193, which authorized the Fairmount Park Commission to construct and maintain the Schuylkill River Park project in the City and County of Philadelphia.

   Be advised that the request has been approved, and Permit No. E51-193 is hereby amended to authorize the construction and maintenance of a 10-foot by 45-foot floating dock, 40-foot by 3-foot gangway and associated appurtenances located just north of the Chestnut Street Bridge and connecting to the Schuylkill River Park.    Work will include:

   1.  To construct and maintain a 5/8 mile Oval Harness Racetrack, a portion of which lies within the 100-year floodway of the Delaware River.

   2.  To modify Pier 1 and Pier 2 by constructing and maintaining an approximately 37,508 square foot concrete pile-supported, high deck platform to support the racetrack overtop a tidally flowed slip (former Wet Dock No. 1) located within the Delaware River (WWF, MF).

   3.  To construct and maintain the following stormwater outfalls:

   (a)  Five 24-inch and one 48-inch diameter HDPE stormwater outfalls with riprap outlet protection along and discharging into Ridley Creek (WWF, MF).

   (b)  Two 24-inch stormwater HDPE outfalls with riprap outlet protection along and discharging into the Delaware River.

   (c)  One 18-inch, one 24-inch and one 30-inch stormwater HDPE outfalls discharging into the tidal Wet Dock (slip).

   4.  To place and maintain fill in 0.24 acre of wetland (PEM) and approximately 940 linear feet of riprap bank protection below the high tide line and along the perimeter of previously filled submerged lands. Work will also include minor grading and riparian corridor improvements.

   5.  To remove several old industrial structures within the Delaware River, including two crane rail supports, a sunken steel barge, a steel dock, and pile-supported timber low deck structure (Pier No. 3). Also, to remove approximately 0.59 acre of structure and fill for conversion to open water, including 0.38 acre of inter-tidal shallow water wetland. These activities are being performed as compensation for shading impacts for the new high deck racetrack support platform.

   6.  To maintain an existing dock and three 24-foot diameter breasting dolphins extending into the Delaware River at the mouth of Ridley Creek.

   The site is located at One Morton Avenue on the Delaware River Waterfront, just west of Ridley Creek, which forms the municipal boundary with Eddystone Borough (Bridgeport, PA-NJ, Quadrangle N:  18.0 inches; W:  14.0 inches) in the City of Chester, Delaware County.

   The issuance of this permit also constitutes approval of a Water Quality Certification under section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).

   To construct and maintain: (1) an 11-foot wide by 40-foot long breakaway truss pedestrian bridge over Scott Creek (TSF); (2) a 4-foot wide by 64-foot long wooden boardwalk elevated by concrete pilings over a UNT to Scott Creek and associated PFO wetlands; (3) an 8-inch water line crossing of a UNT to Scott Creek; (4) a 6-inch sewer force main crossing of Scott Creek and associated PEM wetlands; (5) a 6-inch sewer force main crossing of Scott Creek and an associated PSS wetland; (6) replace an existing culvert under Split Rock Drive with a 88.1 linear foot 24-inch HDPEP; (7) 8-inch PVC water line and an 18-inch storm sewer under Split Rock Road; (8) 2 outfall swales to UNTs to Scott Creek; (9) 8-inch PVC water line crossing of Scott Creek at Dooley Road; and (10) an 8-inch PVC water line crossing under an existing 54-inch CMP under Line Road. The proposed Delta Ridge subdivision is located adjacent to the town of Delta and is bordered by Bunker Hill Road and Line Road (Delta, PA Quadrangle Latitude 39/43/36.8 and Longitude 76/20/12.3) in Peach Bottom Township, York County. The wetlands are considered of exceptional value in accordance with 25 Pa. Code § 105.17(1)(iii). The project impacts total 0.11 acre of temporary wetland impacts, 0.02 acre of permanent wetland impacts, 4,275 square feet of temporary stream impacts and 105 linear feet of permanent stream impacts, for which compensatory mitigation is not required.

Planning Grant Awards Under Section 901 of the Municipal Waste Planning Recycling and Waste Reduction Act of 1988, Act 101

   The Department of Environmental Protection (Department) announces the following grants to counties under the Pennsylvania Municipal Waste Planning, Recycling and Waste Reduction Act of 1988, Act 101, P. L. 556, section 901 and section 208 of the Waste Tire Recycling Act/Small Business and Household Pollution Prevention Act (Act 190 of 1996).

   Planning grants are awarded to counties for 80% of approved costs for preparing municipal waste management plans as required by Act 101, for carrying out related studies, surveys, investigations, inquiries, research and analysis, including those related to siting, environmental mediation, education programs on pollution prevention and household hazardous waste and providing technical assistance to small businesses for pollution prevention. Grants may be awarded for feasibility studies and project development for municipal waste processing or disposal facilities, except for facilities for the combustion of municipal waste that are not proposed to be operated for the recovery of energy. All grant awards are predicated on the receipt of recycling fees required by sections 701 and 702 of Act 101 and the availability of monies in the Recycling Fund.

   Description:  The Mahanoy City Sewer Authority (MCSA) is planning to complete upgrades to the 25 year old Wastewater Treatment Plant (WWTP) located in Mahanoy Township, Schuylkill County. The project involves replacing malfunctioning and outdated WWTP equipment, located at the headworks, sludge digester, clarifiers and sludge drying reed beds. Other improvements include electrical upgrades, installation of flow meters, utility water system improvements and administrative and laboratory office upgrades. The Pennsylvania Infrastructure Investment Authority, which administers the Commonwealth's State Revolving Fund, is intended to be the funding source for this project. The Department of Environmental Protection's (Department) review of the project has not identified any significant, adverse environmental impacts resulting from the proposal. The Department hereby categorically excludes the project from the State Environmental Review Process.

Pennsylvania Wetland Replacement Project Public Notice

   The Department of Environmental Protection (Department) has approved the following wetland restoration project for funding under the Pennsylvania Wetland Replacement Project (PWRP). The PWRP is a jointly managed fund between the Department and the National Fish and Wildlife Foundation established to offset wetland losses. Construction for the following project is anticipated to begin in the Fall 2005.    The primary objective of the landowner and Ducks Unlimited sponsored 0.5 acre wetland creation in Subbasin 1 of the Delaware River Basin is to provide habitat for waterfowl and improve water quality of the East Branch of Bridge Creek and the East Branch Wallenpaupack watershed by intercepting runoff from upland slopes and trapping nutrients and sediment. The wetland project will expand an existing wetland and will be surrounded by a large buffer area. The project is located in Green Township, Pike County (Newfoundland, PA Quadrangle, N:  10.75 inches, W:  6.25 inches).
