   PA-63-00922A, Robinson Power Company, LLC, Beach Hollow Power Project, Robinson Township, Washington County. As per 25 Pa. Code § 127.48 notice is hereby given that the Department of Environmental Protection (Department) will hold a public hearing on March 7, 2005, at 6 p.m. at the Burgettstown Grange, 643 Creek Road, Bulger, PA, 15019.

   The hearing is to take testimony concerning the Department's intent to issue a Plan Approval to the Robinson Power Company, LLC. for the installation of a 272 net megawatt waste coal fired, circulating fluidized bed boiler to be located in Robinson Township, Washington County. Other air emission sources at the facility include material handling operations for coal, ash and limestone, an emergency generator, firewater pump and a cooling tower. The proposed facility will include several structures such as the boiler building, turbine building, concrete stack, material storage building, run-of-mine crusher building, coal refuse dryer building and the administrative office buildings.

The Title V operating permit will contain appropriate monitoring, recordkeeping and reporting requirements designed to keep the facility operating within all applicable air quality requirements. This is a renewal of their Title V operating permit.

   22-05005: NRG Energy Center Paxton, LLC (100 North Tenth Street, Harrisburg, PA 17105-2151) for a Title V Operating Permit Renewal in the City of Harrisburg, Dauphin County. The facility's major sources of emissions include four boilers, natural gas and No. 6 oil fired and two dual fuel engines, natural gas and No. 2 oil fired. The sources primarily emit NOx. COAL AND NONCOAL MINING ACTIVITY APPLICATIONS

   Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). Mining activity permits issued in response to applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P. S. §§ 4001--4015); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003).

   The following permit applications to conduct mining activities have been received by the Department of Environmental Protection (Department). A copy of an application is available for inspection at the district mining office indicated before an application. Where a 401 Water Quality Certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for certification.

   Written comments, objections or requests for informal conferences on applications may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the district mining office indicated before an application within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34.

   Where any of the mining activities listed will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. NPDES permits will contain, at a minimum, technology-based effluent limitations as identified in this notice for the respective coal and noncoal applications. In addition, more restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit, when necessary, for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). Persons or agencies who have requested review of NPDES permit requirements for a particular mining activity within the previously mentioned public comment period will be provided with a 30-day period to review and submit comments on the requirements.

   Written comments or objections should contain the name, address and telephone number of the person submitting comments or objections; the application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor; the application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor wishes to have the conference conducted in the locality of the proposed mining activities.

FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

   The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department of Environmental Protection (Department). Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the State to certify that the involved projects will not violate the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA or to the issuance of a Dam Permit, Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment must submit comments, suggestions or objections within 30 days of the date of this notice, as well as questions, to the regional office noted before the application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

   The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Individuals will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. WATER OBSTRUCTIONS AND ENCROACHMENTS

   E09-881. PA DOT, 7000 Geerdes Boulevard, King of Prussia, PA 19406, Bedminster Township, Bucks County, ACOE Philadelphia District.

   Deep Run Bridge Replacement Project (SR4023, Section BU1)

   To replace two arch structures along Deep Run Road with one box culvert and a bridge. The proposed bridge spans 36 feet and the box culvert spans 20 feet, both over the Deep Run (WWF) with an underclearance of 6.75 feet. The work will include the following activities:

   1.  Construction of temporary diversion devices within the stream.

   2.  Construction of temporary road crossing to accommodate material and equipment movement across the workspace perimeter.

   3.  Grading of streambed to compliment new stream alignment, removal of gravel bar and to increase hydraulic conveyance of the stream.

   4.  Removal of all abutments and construction of new ones to improve stream alignment.

   5.  Construction and placement of a total of approximately 357 cubic yards of riprap of sizes R-5 and R-8 for scour protection at critical segments along the abutments, exit and entry points of the two hydraulic structures.

   6.  Placement of approximately 410 cubic yards fill material for grading and to accommodate roadway approach widening and adjustment of vertical alignment to new structures.

   7.  To place and maintain fill in 0.0034 acre of wetland.

   8.  Modify stream alignment by increasing it by 6 feet on the south side running approximately 36 linear feet.

   The project proposes to affect a total of approximately 202 linear feet of stream, of which 64 linear feet is permanent impact. This site is located approximately 1,350 feet northeast of the intersection of Deep Run and Keller Church Roads in Bedminster Township, Bucks County. (Bedminster, PA Quadrangle N:  1.86 inches; W:  8.79 inches.

   E09-564. Forest Park Water--North Penn & North Wales Water Authority, 144 Park Avenue, P. O. Box 317 Chalfont, PA 18914-0317.

   To construct and maintain a 16-inch pipeline extending 71-feet across and temporarily impacting 0.05 acre of forested wetland (PFO) and to construct and maintain a rip rapped outfall structure to Pine Creek (TSF-MF). The proposed modification is associated with the expansion of the Forest Park Water Treatment Plant, which is needed to meet increasing demand for public water in the region. The project includes upgrades and replacements to the water treatment process equipment. A small building is being constructed to house chemical storage and feed equipment to the south of the existing treatment plant building, within the 100-year floodplain.

   The site is located approximately 2000 feet northeast of intersection of Route 152 and Park Avenue (Doylestown, PA. USGS Quadrangle N: 7.80 inches W: 11.04 inches) in Chalfont Borough, Bucks County.

   E46-969. Pennypack Ecological Restoration Trust, 2955 Edge Hill Road, Huntingdon Valley, PA 19006-5099, Upper Moreland Township, Montgomery County, ACOE Philadelphia District.

   To modify an existing 1.34-acre reservoir and outlet works of an off-stream nonjurisdictional dam known as Crossroads Marsh. The am and reservoir is located within the 100-year floodway of the Pennypack Creek (TSF-MF). The proposed work will include the following activities:

   1.  To dewater the existing reservoir and temporarily disturb 1.22 acres of wetland (PEM).

   2.  To remove accumulated sediment and organic material from a portion of the reservoir.

   3.  To excavate and deepen a portion of the reservoir impacting 0.34 acre of wetland (PEM).

   4.  To redistribute excavated material along the margins and within the reservoir to create wetland and riparian shelf habitat zones.

   5.  To construct 0.34 acre of replacement wetlands at two locations adjacent to the existing reservoir.

   The site is located along the northwestern side of the intersection of Creek Road and Papermill Road (Hatboro, PA USGS Quadrangle N:  2.75 inches; W:  10.75 inches.

   E23-448. First Blackhawk, LLC, P. O. Box 467, Concordville, PA 19331, Middletown Township, Delaware County, ACOE Philadelphia District.

   To perform the following activities in and along an UNT of Ridley Creek (TSF-HQ) watershed associated with the proposed Bittersweet Way, a single-family residential subdivision:

   1.  To modify and extend an existing 36-inch CMP stormwater outfall structure and to backfill approximately 80 linear-foot reach of abandoned eroded stormwater channel, to facilitate the construction of lots 3 and 4. The pipe will start at Manhole No. 2, consist of approximately 153 linear feet of 29-inch by 45-inch Elliptical R.C.P., extend to end wall EW No. 2, including a riprap apron where it rejoins the existing channel. Work also includes installation and maintenance of an 8-inch PVC sanitary sewer line and a waterline crossing of the stormwater pipe.

   2.  To modify and extend a stormwater outfall situated in and along an UNT to Ridley Creek (TSF-HQ) for the widening of SR 4004 (Barren Road) to accommodate the required turning lanes into the subdivision. Work also includes installation and maintenance of the 8-inch PVC sanitary sewer line placed under the storm sewer extension.

   3.  To construct and maintain 51 linear feet of 24-inch R.C.P. culvert in and along an UNT to Ridley Creek and impacting 0.02 acre of wetland (PFO) associated with a common drive for lots 2--4. The work also includes installation and maintenance of an 8-inch PVC sanitary sewer line placed under the proposed culvert.

   The applicant also requests an Environmental Assessment approval to construct an earthen embankment and appurtenant out let works impacting 90 linear feet of stream and 0.02 acre of wetland (PEM) associated with the reconstruction of a currently breached on-stream nonjurisdictional dam, which will be utilized as a stormwater management facility. The operation of the dam will result in the secondary impact to 0.14 acres of wetland as a result of incidental and temporary backwater.

   The project will impact 680 linear feet of watercourse and 0.18 acre of wetland. The site is located on the northeast corner of the Route 352 and Barren Road (Media, PA USGS Quadrangle N: 7.9 inches; W: 9.2 inches.

   E46-970. Toll Brothers, Inc., Regency @ Northampton, 445 St. Leonard's Road, Holland, PA 18966, Lower Moreland Township, Montgomery County, ACOE Philadelphia District.

   To perform grading activities and to construct and maintain an approximately 1,200-linear foot long concrete retaining wall within the 100-year floodway of Pennypack Creek (TSF, MF) and Mill Race Creek (TSF, MF) associated with the proposed Huntingdon Valley Club Condominiums. This work also includes the construction and maintenance of a stormwater basin and its associated intake/outfall structures and an outfall structure associated with the collection system and interior drainage of this project. The site is located just northwest of the intersection of Huntingdon Pike (SR 0232) and welsh Road (SR 0063), (Frankford, PA USGS Quadrangle N:  21.8 inches; W:  9.8 inches).

   E51-212. USACOE, Wanamaker Building, 100 Penn Square East, Philadelphia, PA 19107-3390, City and County of Philadelphia, ACOE Philadelphia District.

   To perform the following activities associated with Phase 1 of the proposed transloading facility and rail spur at the existing Fort Mifflin Confined Dredge Material Disposal Facility.

   To construct and maintain a railroad crossing which will impact 0.15 acre of wetland (PEM). The crossing includes fill to support the rail and three 24-inch HDPE cross drain pipes to maintain hydrologic connectivity of the wetland.

   The site is located 300 feet northeast of the Enterprise Avenue exist of I-95, (Philadelphia, PA USGS Quadrangle, N:  3.7 inches; W:  3.7 Inches).

   To remove the existing structure and then to construct and maintain a 14-foot by 8.5-foot box culvert on a 75° skew at the channel of an UNT to Wiconisco Creek (WWF) and associated improvements on SR 0225, Section 015, Segment 0430, Offset 1611 to improve the traffic safety condition located about 0.7 mile south of Berrysburg Borough (Elizabethville, PA Quadrangle N:  12.0 inches; W:  10.0 inches) in Mifflin Township, Dauphin County.

   E22-488: Waverly Woods Associates, Capitol View Development Co. Inc., 1300 Market Street, Lemoyne, PA 17043-0622, in Susquehanna Township, Dauphin County, ACOE Baltimore.

   To permanently impact a 0.26 acre and temporarily impact 0.19 acre of wetland and associated improvements in order to construct Phase 7 of the Waverly Woods Subdivision located on North Progress Avenue about 0.5 mile north from its intersection with Linglestown Road (Harrisburg, PA Quadrangle N: 16.1 inches; W: 15.25 inches) in Susquehanna Township, Dauphin County.

   E50-226: Richard M. Nolt, 29 Lyons Road, Millerstown, PA 17062 in Tuscarora Township, Perry County, ACOE Baltimore.

   To construct and maintain a single span bridge with a clear span of 16.0 feet, a rise of 1.75 feet and an instream length of 11.25 feet within the channel of Raccoon Creek (CWF), a perennial stream, approximately 1,200 feet downstream of the Tuscarora and Saville Township line at a point (Ickesburg, PA Quadrangle N:  19.4 inches; W:  9.1 inches) in Tuscarora Township, Perry County. The project will result in 11.25 linear feet of direct impacts to the channel of Raccoon Creek.

   To construct and maintain seven dry hydrants within the Fishing Creek Watershed for the purpose of fire protection at the following locations: No. 1--Tylersville Hatchery, No. 2--Sugar Value Lions Club Ballfield, No. 3--Daniel C. Schrack property, No. 4--Richard Herman property, No. 5--Richard Thompson property, No. 6--Jay and Nichole Bechdel property, No. 7--Doris J. Lamey property. This project proposes to permanently impact 28 linear feet of Fishing Creek, which is classified as a HQ- CWF and no wetland impacts.

   E17-405. Pennsylvania Department of Transportation, Engineering District 2-0, P. O. Box 342 1924-30 Daisy Street, Clearfield, PA 16830. SR 2014, Section A01 Bridge Replacement, Decatur Township, Clearfield County, ACOE Baltimore District (Houtzdale, PA Quadrangle N:  19.8 inches; W:  9.8 inches).

   To remove an existing structure and to construct, operate and maintain a single span concrete box beam bridge to carry SR 2014, Section A01 across Coal Run (CWF) and to change the channel of UNT to Coal Run (CWF) for highway safety improvements. The bridge across Coal Run shall be constructed with a minimum span of 40-feet, width of 30-feet and an underclearance of 5-feet. All construction and future repair work shall be completed during stream low flow. Construction of the bridge will permanently impact 80-feet of Coal Run while impacting 0.2-acre of wetland; whereas, the channel change of the UNT to Coal Run will permanently impact 193-feet of stream. The bridge replacement project is located along the western right-of-way SR 0053 approximately 1.1-miles west of SR 2014 and SR 0053 intersection. This permit also authorizes construction, operation, maintenance and removal of temporary construction road crossings, cofferdams and stream diversions. Upon completion of the bridge replacement project, all temporary structures shall be removed and all disturbed areas shall be restored to original contour and elevation with final stabilization applied.

   E63-568. Washington County Commissioners, 100 West Beau Street, Suite 702, Washington, PA 15301. To construct a bridge in Hanover Township and Robinson Township, Washington County, Pittsburgh ACOE District. (Clinton, PA Quadrangle N:  11.3 inches; W:  15.9 inches and Latitude:  40° 26` 14"--Longitude:  80° 21` 51"). The applicant proposes to remove the existing structure and to construct and maintain a single span bridge having a normal clear span of 73` 9" at a 70 skew angle and an underclearance of approximately 11` 7" over Raccoon Creek (WWF), to construct and maintain various outfalls to Raccoon Creek and to place and maintain fill in a de minimus area of palustrine emergent wetland equal to 0.0001 acre. The bridge (T-500, Donaldson Bridge Raccoon Creek No. 7) is located on Raccoon Creek Road. The project will permanently impact 0.0001 acre of PEM wetlands and 50` of perennial stream channel.

   E63-569. Thomas B. McCloskey, 6316 Irishtown Road Extension, Bethel Park, PA 15102. To construct 3 culverts in Peters Township, Washington County, Pittsburgh ACOE District. (Bridgeville, PA Quadrangle N:  0.1 inches; W:  6.9 inches and Latitude:  40° 16` 00"--Longitude:  80° 02` 56". The applicant proposes to construct and maintain three 5-foot diameter culverts in an UNT to Peters Creek (TSF) to provide access to the proposed Rees Manor Plan Parcel ''A.'' The project is located on the west aside of McCombs Road, approximately 6,000 feet southeast from the intersection of Bower Hill Road and McCombs Road and will impact 65.0 linear feet of stream channel.

   E65-864. Coal and Coke Trail Corporation, P. O. Box 360, Scottdale, PA 15683. To construct a bridge in Mt. Pleasant Township and also to construct a bridge in East Huntingdon Township, Westmoreland County, Pittsburgh ACOE District. The applicant proposes to reconstruct two railroad crossings for a rail trail. For both crossings the existing abutments will be used and a new bridge deck will be constructed and maintained. The first crossing is located over Shupe Run (WWF), (Mt. Pleasant, PA Quadrangle N:  0.5 inches; W:  5.1 inches and Latitude: 40° 7` 40"--Longitude: 79° 32` 1"), the bridge will have a clear span of approximately 38 feet at a 38 skew give a normal opening of approximately 28' and an underclearance of approximately 4.9 feet. The bridge is located approximately 1,500 feet upstream of its confluence with Jacob Creek. The second crossing is located over Sherrick Run (WWF), (Connellsville, PA Quadrangle N:  20.8 inches; W:  7.8 inches and Latitude:  40° 6` 5"--Longitude:  79° 33` 2"). The bridge will have a span of approximately 51feet and underclearance of approximately 10'. The bridge is located approximately 1,000 feet upstream of its confluence with Jacobs Creek in East Huntingdon Township. The total proposed impacts are 10` to Shupe Run and 18` to Sherrick Run.
