Intent to Issue Title V Operating Permits under the Air Pollution Control Act (35 P. S. §§ 4001--4015) and 25 Pa. Code Chapter 127, Subchapter G.

   23-00023: United Parcel Service--UPS, Philadelphia Air HUB (1 Hog Island Road, Philadelphia, PA 19153) for renewal of a Title V facility in Tinicum Township, Delaware County. The permit is. No changes have taken place at this facility since the previously issued TV Operating Permit, issued June 4, 2001. The facility's sources includes 33 Space Heaters, 4 Emergency Generators, Gasoline, Diesel and Jet Fuel Storage and Dispensing, Parts Washer Solvent, VM Washing, Vehicle Repair, Jet Deicing Operations and Damaged Packages. The major emissions of from the facility are VOC and NOx. The total VOC emissions from all of the air contamination sources at this facility shall not exceed a facility wide limit of 24.93 tons per year in any consecutive 12-month period. This facility is not subjected to CAM. The permit will include monitoring, recordkeeping and reporting requirements designed to keep the facility operating within all applicable air quality requirements.

   22-05047: Dura-Bond Pipe, LLC (2716 South Front Street, Steelton, PA 17113) for their pipe and structural shapes manufacturing facility in Steelton Borough, Dauphin County. The facility's major sources of emissions are from manufacturing and coating operations. The emissions at this facility include HAPs and VOCs emissions from the coating operations, NOx, SOx and CO emissions from combustion of natural gas, PM from surface cleaning operations and emissions from welding. The facility is designated as a Title V facility because it has the potential to emit more than 25 tons of combined HAP. The Title V Operating Permit, number 22-05047, will contain monitoring, recordkeeping and reporting requirements designed to keep the facility operating within all applicable air quality requirements.

   V05-008: Inolex Chemical Co. (Jackson and Swanson Streets, Philadelphia, PA 19148) for operation of a chemical manufacturing facility in the City of Philadelphia, Philadelphia County. The facility's air emission sources include a 52 mmBtu/hr boiler (limited to 49 mmBtu/hr), a 20 mmBtu/hr boiler, a 6.5 mmBtu/hr boiler, 7 reactors, a reactor tank, a distillation column, a deodorizer tank, two preblend tanks, a vent condenser and an adipic silo. The facility's air emission control devices include two scrubbers and two baghouses.

   The operating permit will be issued under 25 Pa. Code, Philadelphia Code Title 3 and Air Management Regulation XIII.    Persons wishing to file protest or comments on this operating permit must submit the protest or comments within 30 days from the date of this notice. Protests or comments filed with AMS must include a concise statement of the objections to the permit issuance and the relevant facts upon which the objections are based. Based upon the information received during the public comment period, AMS may modify the operating permit or schedule a public hearing. The hearing notice will be published in the Pennsylvania Bulletin and a local newspaper at least 30 days before the hearing.

   38-03016: PA Precision Cast Parts, Inc. (521 North 3rd Street, P. O. Box 1429, Lebanon, PA 17042) for an operating permit to manufacture steel investment castings at their site in the City of Lebanon, Lebanon County. Emissions are estimated to be less than 10 tons per year of VOCs. The State-only Operating Permit will contain additional recordkeeping and reporting requirements designed to keep the facility operating within all applicable air quality requirements.

   Northcentral Region: Air Quality Program, 208 West Third Street, Williamsport, PA 17701, David Aldenderfer, Program Manager, (570) 327-3637.

   17-00008: Triangle Suspension Systems, Inc. (P. O. Box 425, Du Bois, PA 15801) for operation of an automotive and truck spring manufacturing facility in Sandy Township, Clearfield County.

   The facility incorporates two rust inhibitor dip tanks, 18 natural gas-fired annealing, draw, and the like furnaces, 67 natural gas-fired heaters and two solvent cold cleaning machines. The VOC emissions from the facility will be limited to less than 50 tons per year and the nitrogen oxides, CO, PM including PM10 and SOx emissions are not expected to exceed 21.61, 4.54, 1.62 and .13 tons per year, respectively.

   The facility is not a major (Title V) facility for any air contaminant.

   The Department of Environmental Protection (Department) proposes to incorporate into the operating permit to be issued conditions requiring compliance with all applicable regulatory requirements pertaining to air contamination sources and the emission of air contaminants as well as conditions previously established in Operating Permit 17-318-016, issued on December 21, 1995.

   The previously-established conditions include:

   1.  A condition limiting the total combined VOC emissions from the entire facility to less than 50 tons in any 12-consecutive month period.

   2.  A condition limiting the amount of thinner added to the amber dip tank to no more than 1 gallon for every 2.75 gallons of rust inhibitor coating material added to the tank (on an annual average basis).

   3.  A condition requiring the springs coated in the amber dip tank to be drained over the dip tank for as long as possible before moving them to the drying area.

   4.  A condition limiting the rust inhibitor coating materials and thinners used in the amber dip tank to those identified in Plan Approval Application 17-318-016 unless prior Department approval is obtained to use other coatings and thinners.

   5.  A condition requiring the maintenance of records of rust inhibitor coating material and thinner usage in the amber dip tank.

   The Department additionally proposes to incorporate into the operating permit to be issued a number of new conditions including:

   1.  A condition limiting the total combined emission of any single HAP from the entire facility to less than 10 tons in any 12-consecutive month period and the total combined emission of all HAPs to less than 25 tons in any 12-consecutive month period.

   2.  A condition requiring the maintenance of records as are necessary to verify compliance with the VOC and HAP facility-wide emission limitations.

   3.  A condition limiting the total combined amount of rust inhibitor coating materials used in the two dip tanks to 11,891 gallons in any 12-consecutive month period, of which no more than 10,899 gallons shall have a VOC content in excess of 2.80 pounds per gallon and none shall have a VOC content in excess of 3.14 pounds per gallon.

   4.  A condition limiting the total combined amount of thinners used in the two dip tanks to 1,048 gallons in any 12-consecutive month period, of which no more than 948 gallons shall have a VOC content in excess of 7.40 pounds per gallon and none shall have a VOC content in excess of 7.94 pounds per gallon.

   5.  A condition prohibiting the use of the two dip tanks to apply coatings other than rust inhibitor coatings unless prior Department approval is obtained.

   6.  A condition requiring the maintenance of rust inhibitor coating material and thinner usage in the black dip tank.

   7.  A condition requiring the semi-annual submission of reports of rust inhibitor coating material and thinner usage in each of the two dip tanks.

   8.  Conditions limiting the fuel used in the furnaces and heaters to natural gas.

   17-00061: Junior Coal Contracting, Inc. (2330 Six Mile Road, Philipsburg, PA 16866) for operation of coal processing facility (Leslie Tipple) in Decatur Township, Clearfield County.

   The facility incorporates a raw coal feed bin, a rotary breaker, a radial stacking conveyor, five additional conveyors, various coal stockpiles, truck and railcar loading operations and a 375 horsepower diesel engine/generator. The air contaminant emissions from the facility are not expected to exceed 5.66 tons of NOx, 5.53 tons of CO, .81 ton of VOCs, .34 ton of SOx and 27.58 tons of PM including PM10 per year.

   The facility is not a major (Title V) facility for any air contaminant.

   The Department of Environmental Protection (Department) proposes to incorporate into the operating permit to be issued conditions requiring compliance with all applicable regulatory requirements pertaining to air contamination sources and the emission of air contaminants as well as conditions previously established in Plan Approval 17-305-020A, issued on October 5, 2004.

   These previously-established conditions include:

   1.  A condition limiting the amount of coal processed by the facility to no more than 437,500 tons in any 12-consecutive month period.

   2.  A condition requiring all trucks entering or exiting the facility by means of a public roadway to be tarped or otherwise covered unless empty.

   3.  A condition requiring the first 300 feet of the facility entrance road to be paved and the remainder up to the tipple area to be covered with 1B limestone.

   4.  A condition limiting vehicle speed on facility roadways to no more than 5 miles per hour.

   5.  A condition requiring an operable water truck equipped with a pressurized spray bar and pressurized hose or nozzle connection to be maintained on site for the control of dust from roadways and stockpile areas.

   6.  A condition requiring the rotary breaker to be enclosed except for a feed opening and a discharge opening.

   7.  A condition requiring the raw coal feed bin to be equipped with a roof and three sides.

   8.  A condition requiring the height of the stacking conveyor to be adjusted to maintain a maximum coal free-fall distance of less than 5 feet at all times.

   9.  A condition limiting the maximum height of any coal stockpile to 30 feet above grade.

   10.  A condition requiring all conveyors to be partially or fully enclosed and all material transfer points to be enclosed.

   11.  A condition requiring the front-end loader bucket-to-truck bed and bucket-to-railcar height to be kept to a minimum during loading operations.

   12.  A condition prohibiting the operation of the diesel engine for more than 2,500 hours in any 12-consecutive month period.

   13.  A condition limiting the sulfur content of the diesel fuel used in the diesel engine to .3% by weight.

   14.  A condition limiting the emissions from the diesel engine to 5.66 tons of NOx, 5.53 tons of CO, .81 ton of VOCs and .34 ton of SOx in any 12-consecutive month period.

   15.  A condition requiring the maintenance of records of the amount of coal loaded out from the facility each month and the number of hours the diesel engine operates each month.

   25-00984: Harrison Machine Co. (3118 Station Road, Erie, PA 16510-6502) for a Natural Minor Operating Permit to operate a metal products fabrication and surface coating operation in Wesleyville Borough, Erie County.

COAL AND NONCOAL MINING ACTIVITY APPLICATIONS

   Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). Mining activity permits issued in response to applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P. S. §§ 4001--4015); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003).

   The following permit applications to conduct mining activities have been received by the Department of Environmental Protection (Department). A copy of an application is available for inspection at the district mining office indicated before an application. Where a 401 Water Quality Certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for certification.

   Written comments, objections or requests for informal conferences on applications may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the district mining office indicated before an application within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34.

   Where any of the mining activities listed will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. NPDES permits will contain, at a minimum, technology-based effluent limitations as identified in this notice for the respective coal and noncoal applications. In addition, more restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit, when necessary, for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). Persons or agencies who have requested review of NPDES permit requirements for a particular mining activity within the previously mentioned public comment period will be provided with a 30-day period to review and submit comments on the requirements.

   Written comments or objections should contain the name, address and telephone number of the person submitting comments or objections; the application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor; the application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor wishes to have the conference conducted in the locality of the proposed mining activities.

FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

   The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department of Environmental Protection (Department). Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the State to certify that the involved projects will not violate the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA or to the issuance of a Dam Permit, Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment must submit comments, suggestions or objections within 30 days of the date of this notice, as well as questions, to the regional office noted before the application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

   The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Individuals will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on each working day at the regional office noted before the application.

   To construct, operate and maintain a surface water intake, raw water transmission lines and treated drinking water distribution lines to extend and supplement the Houtzdale Municipal Authority's existing public drinking water supplies. Construction of the surface water intake, raw water transmission lines and treated drinking water distribution lines will result in a raw water transmission line crossing Moshannon Creek (TSF). Raw water transmission and treated drinking water distribution lines shall be installed beneath streambeds so there will be a minimum of 3 feet of cover between the top of the pipe and the lowest point in the streambed or concrete encased. Trench plugs or clay dikes shall be used at every waterway and wetland crossing to ensure the existing hydrology is not altered. Construction of the surface water intake and monitoring weir shall be conducted during stream low flow and in dry work conditions by dams and pumping or fluming stream flow around work area. Since Moshannon Creek is a wild trout stream, no construction or future repair work of the surface intake and monitoring weir shall be done in or along the stream channel between October 1 and December 31 without the prior written approval of the Fish and Boat Commission. In its entirety, the project will only temporarily impact 1,400 square feet of wetland while permanently impacting 255 feet of waterway that is located along eastern right-of-way of SR 0153 approximately 1.2 miles east of Woodward Township (Clearfield County) Road T-650 and SR 0153.

   E17-415. Department of Transportation, Engineering District 2-0, 1924-30 Daisy Street, Clearfield, PA 16830. Realignment of Water Street and Construction of a Flood Control Levee, in Westover Borough, Clearfield County, ACOE Baltimore District (Westover, PA Quadrangle N:  0.45 inch; W:  5.90 inches).

   To relocate Westover Borough Water Street; to construct, operate and maintain 1,400 feet of earthen levee within the 100-year floodplain of Chest Creek (CWF); and to install, operate and maintain rock scour protection at SR 3006 Bridge abutments for flood protection. The earthen levee shall be constructed with side slopes that shall not exceed 2 feet horizontal to 1 foot vertical, a top width no less than 10 feet and an elevation that provides for 1 foot of freeboard during the 100-year frequency flood. The project will permanently impact 0.016 acre of wetland and 75 feet of Chest Creek that is located along the eastern right-of-way of SR 0036 upstream of SR 3006 and SR 0036 intersection. The Department of Environmental Protection deems the 0.016 acre of wetland permanently impacted by the project de minimis, and so the permittee shall not be required to mitigate the impact with replacement wetlands. This permit also authorizes construction, operation, maintenance and removal of temporary cofferdams or stream diversions for the installation of the rock scour protection. Installation of the rock scour protection shall be completed during stream low flow and dry work conditions by diverting stream flow around work area. Demolition of all structures between Chest Creek and the levee shall include any existing septic tanks or other waste disposal facilities. Demolition waste, including septic tanks, shall be properly removed, handled and disposed to eliminate any future public health risk.

   E17-416. Houtzdale Municipal Authority, 561 Kirk Street, Houtzdale, PA 16651-1209. Moshannon Creek and Henderson Area Water System Improvements, Bigler, Gulich and Woodward Townships and Brisbin and Houtzdale Boroughs, Clearfield County, ACOE Baltimore District (Tipton, PA Quadrangle N:  20.8 inches; W:  16.3 inches).

   To construct, operate and maintain a surface water intake, raw water transmission lines and treated drinking water distribution lines to extend and supplement the Houtzdale Municipal Authority's existing public drinking water supplies. Construction of the surface water intake, raw water transmission lines and treated drinking water distribution lines will result in four stream and two wetland impacts that are as follows:

   E47-083. PPL Montour, LLC, PPL, Generation, LLC, 2 N. Ninth Street, Allentown, PA 18101-1179. Flue Gas Desulfurization Scrubber Project in Derry Township, Montour County, Baltimore ACOE District (Washingtonville PA Quadrangle N:  12.5 inches, W:  4.5 inches).

   The applicant proposes the retrofit construction of two flue gas desulfurization scrubbers at the Montour Stream Electric Station and to permanently fill 0.97 acre of emergent and 0.85 acre of scrub-shrub wetlands. The wetlands are tributary to Mud Creek, a perennial stream classified as a WWF. The applicant will create 1.9 acres of wetland onsite as mitigation for project impacts.

   E49-292. Thomas Gates, R. D. 5, Box 99G, Selinsgrove,PA, 17870. Stone School Manor in Point Township, Northumberland County, Baltimore ACOE District (Northumberland PA Quadrangle N:  8.6 inches, W:  6.9 inches).

   The applicant proposes a 59 lot residential subdivision with roadways, utilities and related infrastructure on a 50.1 acre parcel. The project would result in 0.18 acre of direct and 0.24 acre of indirect impact to emergent wetlands in an agricultural field. The wetlands are in the watershed of a UNT to Johnson Creek, a perennial stream classified as a CWF. A $7,500 contribution to the Pennsylvania Wetland Replacement Project is proposed as compensation for the wetland impact.

   E02-1522. Lowries Run Road Trust Agreement, 500 Lowries Run Road, Pittsburgh, PA 15237. To install a concrete block wall in Ross Township, Allegheny County, Pittsburgh ACOE District. (Emsworth, PA Quadrangle N:  6.0 inches; W:  7.99 inches and Latitude: 40° 31` 59"--Longitude: 80° 3` 27"). The applicant proposes to install a Duro block jumbo concrete block wall to repair steam bank erosion and create stability. The wall will be approximately 10 feet high with a one horizontal to six vertical batter and will not exceed the present height of the bank. Length of stream bank impact is approximately 380 feet.

   E11-317. Joseph D. McKelvey, Executive Director, John Murtha-Johnstown Cambria County Airport, 479 Airport Road, Suite 1, Johnstown, PA 15904. To place fill in wetlands in Richland Township, Cambria County, Pittsburgh ACOE District. (Geistown, PA Quadrangle N:  11.7 inches; W:  11.8 inches and Latitude: 40° 18` 58"--Longitude: 78° 50` 02.21"). The applicant proposes to place and maintain fill in 0.19 acre of wetland in the watershed of UNTs to Solomons Run (WWF) for the purpose of developing a 19-acre parcel at the airport for construction of storage facilities for military equipment. The applicant proposes to impact 661 linear feet of the channel of said streams and temporarily impact 0.13 acre of wetlands.

   E30-214. McHolme-Waynesburg, LLC, 315 Payday Drive, Elizabeth, PA 15037-9442. To place fill in wetlands in Franklin Township, Greene County, Pittsburgh ACOE District. (Waynesburg, PA Quadrangle N:  3.03 inches; W:  0.74 inches and Latitude: 39° 53` 30"--Longitude: 80° 07` 49"). The applicant proposes to place and maintain fill in approximately 0.29 acre of wetlands (PEM/PSS) and two UNTs to Coal Lick Run (WWF) for a distance of approximately 1,505.0 linear feet for thepurpose of constructing the Waynesburg Crossing Com-mercial Development. The project is located on the north side of Rolling Meadows Road, just east form the intersection of Rolling Meadows Road and Interstate Route 79 and will impact 0.29 acre of wetlands and 1,505.0 linear feet of stream channel.

   Northwest Region: Watershed Management Program Manager, 230 Chestnut Street, Meadville, PA 16335-3481.

   E10-417, Larry Colonello, 131 Meredith Drive, Mars, PA 16046. Colonello Driveway Across Tributary to Glade Run, in Middlesex Township, Butler County, ACOE Pittsburgh District (Valencia, PA Quadrangle N:  40° 42` 08"; W:  7° 55` 40").

   To construct and maintain a steel I-beam bridge having a clear, normal span of 22 feet and an underclearance of 6 feet across a tributary to Glade Run and impacting a total of 0.14 acre of adjoining wetland associated with the roadway approach to the bridge for a private driveway extending south from Overbrook Road approximately 0.5 mile east of SR 8. Project proposes contribution to the Pennsylvania Wetland Replacement Fund for compensation for the 0.14 acre of wetland impact.

   E37-170, Mohawk Trails Golf Course, 5117 Erie Street, New Castle, PA 16102-9101. Mohawk Trails Golf Course Pond Maintenance and Construction, in Mahoning Township, Lawrence County, ACOE Pittsburgh District (Edinburg, PA Quadrangle N:  41° 00` 10"; W:  80° 26` 24").

   To conduct the following activities at Mohawk Trails Golf Course west of SR 551 approximately 0.5 mile south of Edinburg:

   1.  To extend and maintain an existing stream enclosure by an additional 30 feet on the downstream end and associated 0.63 acre of fill (dredged material) in a tributary to Mahoning River.

   2.  To conduct maintenance dredging activities at five existing impoundments having a total surface area of 3.815 acres in tributaries to Mahoning River within the golf course, including the impoundment associated with D37-053. Anticipated total volume of dredged material is 14,800 cubic yards.

   To construct a new nonjurisdictional on-stream dam on a tributary to Mahoning River having a contributory drainage area less than 100 acres, less than 15 feet maximum depth and less than 50 acre-feet of storage. Total length of stream impacted by the embankment and impoundment is indicated to be 169 feet.

ENVIRONMENTAL ASSESSMENTS

   Southwest Region: Watershed Management Program Manager, 400 Waterfront Drive, Pittsburgh, PA 15222-4745.

   EA30-002. Stream Restoration Incorporated, 3016 Unionville Road, Cranberry Township, PA 16066. To construct a passive, acid mine drainage treatment system in Dunkard Township, Greene County, Pittsburgh ACOE District (Morgantown North, PA Quadrangle N:  22.3 inches; W:  12.8 inches and Latitude: 39° 44` 52"--Longitude: 79° 57` 58"). The applicant proposes to construct and maintain a passive, acid mine drainage treatment system to treat the drainage discharges emanating from the Mathews property. The project will affect a reported 0.70 acre of the PEM wetland and 215 feet of a UNT of Dunkard Creek (WWF) with the collection-system design, which includes a forebay, vertical flow ponds, hybrid horizontal/vertical flow ponds, settling ponds, an oxidation precipitation channel, a horizontal flow limestone bed and approximately 0.75 acre of aerobic wetlands. The project site is on SR 2004, approximately 1,600 feet from its intersection with SR 2011.
