PUBLIC WATER SUPPLY (PWS) PERMITS The Department of Environmental Protection has taken the following actions on applications received under the Pennsylvania Safe Drinking Water Act (35 P. S. §§ 721.1--721.17) for the construction, substantial modification or operation of a public water system.
Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary of the Board at (717) 787-3483. LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).
Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, shall also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media; benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media, benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by provisions of the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

The reports demonstrated that the applicant has met the Site-Specific/Pathway Elimination Standard and were approved on October 30, 2006.

To remove an existing two span structure and construct, operate and maintain a single span prestressed spread box beam bridge to carry SR 0006 over the Allegheny River for improved public highway safety. The single span bridge shall be constructed with a minimum clear normal span of 56.8 feet, underclearance of 10.5 feet, and skew of 75°. Since the Allegheny River is a stock trout stream, no construction or future repair work shall be done in or along the stream channel between March 1 and June 15 without the prior written approval of the Fish and Boat Commission. The bridge replacement project is located along the north and south right-of-way of SR 0006 approximately 750 feet east of the SR 0049 and SR 0006 intersection. This permit also authorizes construction, operation, maintenance and removal of temporary cofferdams, stream diversions, causeways and pedestrian footbridges. All in-stream temporary structures shall be constructed of clean rock, which is free of fines. Upon project completion, all temporary structures shall be removed with the disturbed areas restored to original contours and elevations.

To construct a bridge in Hovey Township, Armstrong County and Foxburg Borough, Clarion County, Pittsburgh ACOE District. (Emlenton, PA Quadrangle N: 2.6 inches; W: 7.8 inches and Latitude: 41° 8` 24"--Longitude: 79° 40` 52"). To remove the existing SR 58 single lane, steel truss bridge which has three 180 ft. long each spans; and to construct and maintain a two lane bridge upstream and adjacent to the existing bridge, which will have two 165 ft. center spans and two 140 ft. end spans with a minimum underclearance of 18.6 ft. above normal pool elevation over the Allegheny River (WWF) and associated stormwater outfalls between Foxburg Borough, Clarion County and Hovey Township, Armstrong County. A temporary causeway is to be used to construct the pier nearest Foxburg Borough and barges are to be used to construct three other piers. The site is located approximately 1.65 miles north of the Allegheny River confluence with the Clarion River.

The applicant proposes to fill a 0.14 acre vernal pool wetland to construct homes on existing lots within an existing residential subdivision approximately 0.75 mile N of the intersection of SR 6 and SR 18. Project includes replacement of 0.152 acre of wetland approximately one mile from the proposed fill as described in the application.

Submission Date Extension for Calendar Year 2005 Applications for Municipal Recycling Program Performance Grant Applications under Section 904 of the Municipal Waste Planning, Recycling and Waste Reduction Act of 1988, Act 101 The Department of Environmental Protection (Department) announces an extension to the deadline for calendar year 2005 Recycling Program Performance Grant applications from municipalities for grant assistance under the Pennsylvania Municipal Waste Planning, Recycling and Waste Reduction Act of 1988, Act 101, P. L. 556, section 904.
The deadline for submission of calendar year 2005 applications has been extended to 3 p.m., December 15, 2006. Applications must be on forms provided by the Department. Applications received by the Department after that date will not be considered. Grant awards are predicated on the receipt of recycling fees required by sections 701 and 702 of Act 101 and the availability of moneys in the Recycling Fund.
