   Under section 2002(b) of The Administrative Code of 1929 (71 P. S. § 512(b)), the Deputy Secretary for Highway Administration makes the following written finding:

   The Department of Transportation (Department) plans to improve existing SR 0501 through the Village of Schaefferstown in Heidelberg Township, Lebanon County, PA. The proposed roadway is a bypass of the Village of Schaefferstown on new alignment. The project will use property within Brendle Farms, the Old Mill Historic District and the Heidelberg Township Bike Path. Brendle Farms is listed on the National Register of Historic Places. The Old Mill Historic District has been determined eligible for the National Register of Historic Places. The Heidelberg Township Bike Path, which begins at the Heidelberg Township Park and extends east to SR 0501, is a publicly owned recreation area that is valued by the officials having jurisdiction over the land. The project requires 2.7 hectares (6.7 acres) of right-of-way from Brendle Farms and 4.1 hectares (10.2 acres) of right-of-way from the Old Mill Road Historic District. The subject project uses two contributing properties within Brendle Farms and three contributing properties within the Old Mill Road Historic District. The project will use 0.01 hectare (0.03 acre) of right-of-way from the Heidelberg Township Bike Path.

   The environmental, economic, social and other effects of the proposed project as enumerated in section 2002 of The Administrative Code of 1929 have been considered. It has been concluded that there is no feasible and prudent alternative to the project as designed and all reasonable steps have been taken to minimize the effects. A Memorandum of Agreement (MOA) has been developed and signed for the proposed action. Minimization/mitigation measures in the MOA include: incorporating design features that will minimize physical and visual effects on contributing resources in each historic property while meeting current Federal and State highway design standards; incorporating historically sensitive landscaping elements; creating educational materials; and providing a historical marker for Brendle Farms. Additional specific mitigation measures may be provided that will address access needs for two property owners on Brendle Farms. The subject project will separate the western portion of the Heidelberg Township Bike Path from the eastern portion of the Heidelberg Township Bike Path at its crossing of the proposed SR 0501. To mitigate impacts to the Heidelberg Township Bike Path, advance signage will be provided on both the roadway and bike path, and pavement markings on the roadway will be provided. A stop sign will be provided on the bike path at the crossing. Pavers on the bike path in the crossing area will serve as a transition, which in combination with the stop sign will provide appropriate warning of the crossing for bike path users.

   The Deputy Secretary for Highway Administration has considered the environmental, economic, social and other effects of the proposed project as enumerated in section 2002 of The Administrative Code of 1929 and has concluded that there is no feasible and prudent alternative to the project as designed and all reasonable steps have been taken to minimize effects.
