Actions on applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

   The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

   Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

   Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary of the Board at (717) 787-3483. This paragraph does not, in and of itself, create any right of appeal beyond that permitted by applicable statutes and decision law.

   For individuals who wish to challenge an action, appeals must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

   E0-601: Commerce Bank/Harrisburg, N. A., 100 Senate Avenue, Camp Hill, PA 17011 in Spring Township, Berks County, ACOE Philadelphia District.

   To install and maintain a 60-inch by 84-inch concrete box culvert structure to enclose 180 feet of an existing storm water swale, tributary to Wyomissing Creek (CWF), for the purpose of constructing a bank and parking lot on a 1.81-acre vacant lot at the intersection of SR 724 and Bradley Avenue (Sinking Spring, PA Quadrangle, N:  12.3 inches; W:  0.5 inch; Latitude: 40° 19` 04"N, Longitude: 76° 00` 11"W) in Spring Township, Berks County.

   Northcentral Region: Water Management Program Manager, 208 West Third Street, Williamsport, PA 17701.

   E19-249. Columbia County, Columbia County Commissioners, P. O. Box 380, Bloomsburg, PA 17815. Bridge Rehabilitation, in Greenwood Township, Columbia County, ACOE Baltimore District (Bloomsburg, PA Quadrangle N:  22.1 inches; W:  7.79 inches).

   To rehabilitate and maintain the existing single span timber queen post truss covered bridge which has a clear span of 38.7 feet, a curb-to-curb width of 13.25 feet and is on a 90° skew to the roadway baseline.

   Rehabilitation will include construction of new reinforced concrete abutments and wingwalls that replicate the appearance of the original units. Deteriorated timber members will be replaced. R-6 rock will be placed around the substructure units for scour protection. Sediment deposits are to be removed from a 2,000 square foot area immediately upstream of the bridge for a distance of about 60 feet. A two phase temporary dike system will be constructed of shoring and precast barrier, polyethylene liner and sandbags to divert upstream water around construction activities.

   The project is located on T-572 about 0.25 mile off Utt Road.

   The project will not impact wetlands while impacting about 190 feet of waterway. Mud Run is a TSF.

   Southwest Region: Watershed Management Program Manager, 400 Waterfront Drive, Pittsburgh, PA 15222-4745.

   E02-1479. Maronda Homes, Inc., 202 Park West Drive, Pittsburgh, PA 15275. To construct arch culverts in Harrison Township, Allegheny County, Pittsburgh ACOE District. (Freeport, PA Quadrangle N:  2.07 inches; W:  10.68 inches and Latitude: 40° 38` 11"--Longitude: 79° 42` 07"). To construct and maintain: 1) an arch culvert having a span of 14.0 feet with an underclearance of 7.0 feet in a UNT to the Allegheny River (WWF) located under Crown Pointe Circle; 2) an arch culvert having a span of 5.0 feet with an underclearance of 2.58 feet in a UNT to the Allegheny River (WWF) located under Cherry Bark; 3) a 36-inch diameter culvert in a UNT to the Allegheny River (WWF) and associated wetlands located under Allegheny Drive; 4) several utility line crossings and outfall structures; and 5) to place and maintain fill in watercourses and a de minimis area of wetland for the purpose of constructing the Oakridge Estates Residential Development. The project is located approximately 1,200 feet northeast from the intersection of Eisenhower Drive and Buchanan Street and will impact 1,053.0 linear feet of stream channel and a de minimis area (0.04 acre) of wetlands.

   E02-1510. WPXI Television, 11 Television Hill, Pittsburgh, PA 15214-1400. To place fill in wetlands in the City of Pittsburgh, Allegheny County, Pittsburgh ACOE District. (Pittsburgh West, PA Quadrangle N:  21.8 inches; W:  1.4 inches and Latitude: 40° 29` 42"--Longitude: 80° 00` 36"). To place fill in approximately 0.55 acre of PEM wetlands for the purpose of constructing a new WPXI office complex. The project is located just west from the intersection of Evergreen Road and Ivory Avenue and will impact 0.55 acre of PEM wetlands. The applicant proposes to mitigate 0.74 acre of wetlands to compensate for the wetland impacts.

   E04-309. John P. Keppel, 3074 Legionville Road, Baden, PA 15005. To construct a bridge in Harmony Township, Beaver County, Pittsburgh ACOE District. (Ambridge, PA Quadrangle N:  22.3 inches; W:  12.7 inches and Latitude: 40° 37` 21"--Longitude: 80° 12` 55"). To construct and maintain a bridge having a span of 38.0 feet with an underclearance of 8.0 feet across the channel of South Branch Legionville Run (WWF) for the purpose of providing access to applicant's property. The project is located approximately 800 feet southeast from the intersection of Legionville Road and North Legionville Road on the south side of Legionville Road and will impact 17.0 linear feet of stream channel.

   E32-473. Indiana County Conservation District, USDA Service Center, 1432 Route 286 Highway East, Indiana, PA 15701-1467. To construct an outfall structure in Canoe Township, Indiana County, Pittsburgh ACOE District. (Rochester Mills, PA Quadrangle N:  16.3 inches; W:  6.3 inches and Latitude: 40° 50` 25"--Longitude: 78° 55` 15"). To construct and maintain an outfall structure in the left bank of North Branch of Little Mahoning Creek (HQ-CWF) for the purpose of construction of a passive abandoned mine drainage treatment system.

   E65-882. Department of Transportation, P. O. Box 459, Uniontown, PA 15401. To maintain a culvert in Allegheny Township, Westmoreland County, Pittsburgh ACOE District. (Project begins at Vandergrift, PA Quadrangle N:  17.8 inches; W:  15.3 inches and Latitude: 40° 36` 29"--Longitude: 79° 36` 16"). To operate and maintain an 8-foot diameter culvert located in a tributary to Pine Run (WWF); to invert pave the bottom of the existing culvert; to replace and maintain 10 feet of the upstream end of the culvert; to construct and maintain a 14 LF extension on the upstream end; to construct and maintain a 50-foot long relocated channel on the upstream end of the culvert extension; to construct and maintain a 10-foot long extension to a 2-foot diameter culvert located in a tributary to Pine Run with a drainage area under 100 acres on the downstream end; to construct and maintain a 20-foot long riprap energy dissipater to the extended culvert; to construct and maintain a 5-foot long extension on the upstream end of an 18-inch diameter culvert located in a tributary to Pine Run with a drainage area under 100 acres; to construct and maintain a 10-foot long riprap channel upstream of the culvert extension; to construct and maintain an 8-foot long extension on the upstream end to an 18-inch diameter culvert located in a tributary to Pine Run with a drainage area under 100 acres; to construct and maintain a 12-foot extension on the downstream end of the existing culvert; to relocate and maintain 70 feet of a UNT to Pine Creek; to relocate and maintain 10 feet of a UNT to Pine Creek; and to place and maintain fill in 0.03 acre of wetlands (PEM). The work is for the widening of SR 4048 starting at its intersection with SR 356 to the south and SR 56 to the north.

   E65-884. Department of Transportation, P. O. Box 459, Uniontown, PA 15401. To construct a bridge in New Stanton Borough, Westmoreland County, Pittsburgh ACOE District.

   1.  Construct and maintain a two-span bridge; each span is approximately 175 feet long across a UNT to Sewickley Creek (WWF) (Mount Pleasant, PA Quadrangle N:  18.3 inches; W:  15.5 inches and Latitude: 40° 13` 30"--Longitude: 79° 35` 36"). One of the spans will cross over the UNT with an approximate clearance of 45 feet and the other span will cross over the adjacent Turnpike. Approximately 28 feet of riprap scour protection will be placed at existing contour along the east bank and approximately 30 feet beyond the west bank for the western abutment. A temporary stream crossing in accordance with GP-8 will be constructed at this site to facilitate construction.

   2.  Construct and maintain a relocation of an existing culvert and stream section by relocating and extending a 131 LF, 5-foot diameter culvert to a total of 164 LF; fill and maintain 174 feet of stream; construct and maintain 132 feet of stream; and fill and maintain 0.02 acre of de minimis PEM wetland in an adjacent UNT to Sewickley Creek (WWF) and drainage area of 59.5 acres (Mount Pleasant, PA Quadrangle N:  18.6 inches; W:  15.2 inches and Latitude: 40° 13` 40"--Longitude: 79° 35` 31").

   This project is associated with the widening and relocation of SR 3111 between the Byers Avenue and Broadview Road intersections

ENVIRONMENTAL ASSESSMENTS

   Southcentral Region: Water Management Program Manager, 909 Elmerton Avenue, Harrisburg, PA 17110.

   EA38-003: Cornwall Borough, P. O. Box 667, Cornwall, PA 17076 in Cornwall Borough, Lebanon County, ACOE Baltimore District.

   To construct and maintain a streambank stabilization project within a 545 linear foot section of Snitz Creek (TSF) located between Route 419 and Burd Coleman Road at Howard E. Bashore Park (Lebanon, PA Quadrangle N:  4.0 inches; W:  5.2 inches) in Cornwall Borough, Lebanon County. The project consists of the construction of:

   1)  Toe benches on both sides of Snitz Creek approximately 115 feet downstream of Burd Coleman Road.

   2)  One rock vane and one toe bench approximately 250 feet downstream of Burd Coleman Road.

   3)  One toe bench approximately 370 feet downstream of Burd Coleman Road.

   4)  One toe bench approximately 480 feet downstream of Burd Coleman Road.

SPECIAL NOTICES

Planning Grant Awards Under Section 901 of the Municipal Waste Planning Recycling and
Waste Reduction Act of 1988, ACT 101

   The Department of Environmental Protection (Department) announces the following grants to counties under the Pennsylvania Municipal Waste Planning, Recycling and Waste Reduction Act of 1988, Act 101, P. L. 556, section 901 and section 208 of the Waste Tire Recycling Act/Small Business and Household Pollution Prevention Act (Act 190 of 1996).

   Planning grants are awarded to counties for 80% of approved costs for preparing municipal waste management plans as required by Act 101, for carrying out related studies, surveys, investigations, inquiries, research and analysis, including those related to siting, environmental mediation, education programs on pollution prevention and household hazardous waste and providing technical assistance to small businesses for pollution prevention. Grants may be awarded for feasibility studies and project development for municipal waste processing or disposal facilities, except for facilities for the combustion of municipal waste that are not proposed to be operated for the recovery of energy. Grant awards are predicated on the receipt of recycling fees required by sections 701 and 702 of Act 101 and the availability of moneys in the Recycling Fund.

   Description: The Pennsylvania Infrastructure Investment Authority, which administers the Commonwealth's State Revolving Fund, is intended to be the funding source for this project. The Berwick Area Joint Sewer Authority proposes to convert the existing oxidation ditches to a Simultaneous Nitrification/Denitrification in Series Operation. The Department of Environmental Protection's (Department) review of the project and the information received has not identified any significant,adverse environmental impacts resulting from this proposal. The Department has categorically excluded this project from the State Environmental Review Process.
