FEDERAL WATER POLLUTION CONTROL ACT SECTION 401 The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).
Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

Engineering District 9-0 requests authorization for stream and wetland impacts associated with the reconstruction and widening of SR 56 Section 10 in East Saint Clair Township, Bedford County. This phase of the project, which will significantly improve traffic safety along the Route 56 corridor, involves the following 105 impacts:
1. Remove an existing 48-inch RCP (length of 46.0 feet) and construct and maintain a 48-inch by 76-inch RCP (length of 92.0 feet) at Station 498+00 (Alum Bank, PA Quadrangle N: 11.57 inches; W: 3.33 inches, Latitude: 40° 08` 36"; Longitude: 78° 34` 58"). PEM wetlands, associated with a UNT to Stone Creek (WWF) currently exist at the downstream invert of the culvert. The proposed extension will permanently impact 0.04-acre and temporarily impact 0.02-acre of PEM wetland;
2. Construct and maintain a 30-inch pipe outfall and associated riprap apron to a UNT to Stone Creek (WWF) at Station 513+00 (Alum Bank, PA Quadrangle N: 11.61 inches; W: 2.57 inches, Latitude: 40° 08` 21"; Longitude: 78° 34` 59"). The proposed outfall and scour protection will permanently impact 37.0 lineal feet of stream channel and temporarily impact another 25.0 lineal feet of channel;
3. Relocate and maintain 100.0 feet of a UNT to Stone Creek (WWF) between Stations 530+00 and 531+00 (Alum Bank, PA Quadrangle N: 11.61 inches; W: 1.77 inches, Latitude: 40° 08` 05"; Longitude: 78° 34` 59"). The proposed extension will permanently impact 0.01-acre and temporarily impact 0.04-acre of PEM wetland;
4. Remove an existing 18-inch RCP with 24-inch CMP end sleeve (total in-stream length of 60.0 feet) at Station 530+00 (Alum Bank, PA Quadrangle N: 11.61 inches; W: 1.77 inches, Latitude: 40° 08` 05"; Longitude: 78° 34` 59"); and construct and maintain an 18-inch CMP (instream length of 100.0-feet) with associated riprap apron at Station 531+00 (Alum Bank, PA Quadrangle N: 11.61 inches; W: 1.64 inches, Latitude: 40° 11` 20"; Longitude: 78° 30` 42"). Net permanent channel impact is 76.0 lineal feet, with temporary impacts to another 30.0 feet. The proposed pipe and roadway fill will permanently impact 0.15-acre and temporarily impact 0.01-acre of PEM wetland;
5. Maintain fill within 0.53-acre of PEM wetland to widen the intersection of SR 56 and T-548 at Station 534+00 (Alum Bank, PA Quadrangle N: 11.51 inches; W: 1.53 inches, Latitude: 40° 08` 00"; Longitude: 78° 34` 57");
6. Enhance and maintain 0.34-acre of PEM wetland at Station 534 (Alum Bank, PA Quadrangle N: 11.51 inches; W: 1.53 inches, Latitude: 40° 08` 00"; Longitude: 78° 34` 57");
7. Relocate and maintain 402.0 lineal feet of an ephemeral UNT to Stone Creek (WWF) between Stations 532+00 and 535+50 (Alum Bank, PA Quadrangle N: 11.49 inches; W: 1.46 inches, Latitude: 40° 08` 01"; Longitude: 78° 34` 59"). The relocation will temporarily impact 402 lineal feet of stream channel;
8. Remove an existing 36-inch RCP (in-stream length of 75.0-feet) and construct and maintain a 48-inch RCP (in-stream length of 90.0-feet) within a UNT to Stone Creek (WWF) at Station 535+50 (Alum Bank, PA Quadrangle N: 11.49 inches; W: 1.46 inches, Latitude: 40° 07` 59"; Longitude: 78° 34` 56"). The pipe replacement will permanently impact 40.0 lineal feet of stream channel. Channel stabilization downstream of the proposed culvert, consisting of bank grading and vegetative matting, will temporarily impact 180.0 lineal feet of stream channel;
9. Construct and maintain an 18-inch pipe outfall to UNT to Stone Creek (WWF) at Station 535+50 (Alum Bank, PA Quadrangle N: 11.49 inches; W: 1.26 inches, Latitude: 40° 07` 55"; Longitude: 78° 34` 56"). The outfall is located immediately downstream of the 48-inch RCP;
10. Remove an existing 4-foot by 6-foot concrete arch culvert (in-stream length of 62.0 feet) and construct and maintain a 78-inch by 78-inch concrete box culvert (in stream length of 98.0 feet) within the channel of Stone Creek (WWF) at Station 540+50 (Alum Bank, PA Quadrangle N: 11.53 inches; W: 1.26 inches, Latitude: 40° 07` 55"; Longitude: 78° 34` 57"). Net permanent channel impact is 40.0 lineal feet;
11. Construct and maintain an 18-inch pipe outfall to Stone Creek (WWF) at Station 540+00 (Alum Bank, PA Quadrangle N: 11.53 inches; W: 1.26 inches, Latitude: 40° 07` 55"; Longitude: 78° 34` 57"). The outfall is located immediately downstream of the 78-inch by 78-inch box culvert;
12. Construct and maintain a levee within the 100-Year Floodway located on the left downstream bank of Stone Creek at Station 540+50 (Alum Bank, PA Quadrangle N: 11.53 inches; W: 1.26 inches, Latitude: 40° 07` 55"; Longitude: 78° 34` 57") beginning immediately upstream of SR 56 and extending upstream 150-feet. Top width of the levee is 5.0 feet with 2:1 side slopes. Levee height ranges from 0.0 to 6.0 feet.
The applicant proposes to create a minimum of 0.73-acre of compensatory palustrine emergent wetland at a preapproved offsite location (Fetter property, Alum Bank, PA Quadrangle N: 6.00 inches; W: 15.6 inches, Latitude: 40° 09` 28.8"; Longitude: 78° 36` 45.7"). The applicant met stream channel compensation requirements by removing an abandoned dam located on Blacklog Creek in Huntingdon County (Orbisonia, PA Quadrangle N: 19.6 inches; W: 1.5 inches, Latitude: 40° 14` 9.9"; Longitude: 77° 53` 9.9") in June 2006.

2. Relocate and maintain four separate reaches of UNT to Adams Run (WWF) between Stations 572+00 and 578+50; 587+00 and 589+70; 590+60 and 591+15; 600+50 and 602+25. Relocation will result in permanent impacts to 25 lineal feet of stream and temporary impacts to 219 feet of stream.
3. Maintain fill within a total of 0.47-acre of PEM wetlands and temporarily impact another 0.20-acre of PEM wetland associated with UNTs to Adams Run at Stations 586+00; 587+00; 592+00; 589+00; 577+00; 595+00; and 599+00;
The applicant is required to provide 0.47-acre of replacement PEM wetland. The applicant met stream channel compensation requirements by funding the removal of an abandoned dam located on Blacklog Creek in Huntingdon County.
