FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department of Environmental Protection (Department). Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the State to certify that the involved projects will not violate the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA or to the issuance of a Dam Permit, Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment must submit comments, suggestions or objections within 30 days of the date of this notice, as well as questions, to the regional office noted before the application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.
The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Individuals will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on each working day at the regional office noted before the application.

The applicant proposes to construct, operate and maintain a passive treatment acid mine drainage abatement system resulting in 0.498-acre of permanent impact to wetlands associated to a UNT to Morgan Run (CWF) and 26-feet of permanent stream to the same UNT. The proposed permanent wetland impact results in construction of a treatment and settling basins. Stream impacts result from 26-feet of channel being relocated for the discharge of treated acid mine drainage. The project is located along the western right-of-way of Decatur Township Road No. 659 (T-659) approximately 2,275-feet south of SR 2012 and T-659 intersection. The Morgan Run-FROG Acid Mine Drainage Project permanently impacts 0.0498-acre of wetland for which the applicant has agreed to replace with 0.498-acre of wetland for mitigation of those impacts.

The applicant has proposed to: (1) place and maintain fill in a UNT to the West Branch, Susquehanna River; (2) and construct operate and maintain a construction and post-construction stormwater management basin in the same UNT for development of industrial and commercial lots within the Firemen's Industrial Park-South Parcels. The UNT to the West Branch, Susquehanna River is protected as a CWF through Chapter 93 Rules and Regulations. As proposed, permanent fill shall be placed and maintained in 1,000-feet of existing channel, floodway and floodplain ranging from a depth of 5-feet to 15-feet. As proposed, Stormwater Management Basin No. 1 excavation and embankment shall be made in 200-feet of existing channel, floodway and floodplain. The proposed commercial and industrial lot development project represents a permanent loss of 1,200-feet of stream channel and floodplain, for which no stream mitigation has been offered to offset the loss. The project is located approximately 3,150-feet east of SR 0879 and Industrial Park Road within the Firemen's Industrial Park.
E47-087. United States Gypsum Company, 60 PPL Road, Danville, PA 17821. Supply Gas Line and Rail Siding, in Penn, Franklin and Moreland Townships, Lycoming County and Derry and Anthony Townships, Montour County, ACOE Baltimore District (Washingtonville, PA Quadrangle Latitude 41° 03` 29"; Longitude 76° 39` 51").
The project proposes to construct a 17-mile natural gas pipeline, a new railroad spur off of the Norfolk Southern main line and a 2-inch sanitary sewer line to support operations at a new gypsum wallboard plant. All stream impacts associated with the gas pipeline and the sanitary sewer are intended to be temporary. One permanent stream impact is associated with the railroad spur and will consist of replacement of an existing Culvert Crossing. Wetland impacts associated with this project are as follows: Natural gas pipeline impacts total 4.51 acres of forested, emergent, forested/scrub shrub and open water. These impacts are intended to be constructed in such a manner as to not create secondary impacts associated with these locations. Rail spur wetland impacts total 1.74 acres of permanent impacts and 3.33 acres of estimated indirect impacts associated with forested, scrub shrub and emergent wetland complexes. The sanitary sewer line proposes one emergent temporary wetland impact totaling 0.04 acre. This project spans a multicounty, multitownship alignment and is intended to support the minimum permanent impacts to any wetland and stream impacts. The drainage basins involved with this project are as follows UNT to Sugar Run (CWF), Derr Run (CWF), Jakes Run (CWF), Little Muncy Creek (CWF), Laurel Run (CWF), West Branch of Chillisquaque Creek (WWF), Middle Branch Chillisquaque Creek (WWF), Mud Creek (WWF) and UNTs to these Streams.
E55-214. Department of Transportation District 3-0, 715 Jordan Avenue, Montoursville, PA 17754. Culvert Extension for Deceleration Land, in Monroe Township, Snyder County, ACOE Baltimore District (Sunbury, PA Quadrangle Latitude 40° 50` 30"; Longitude 76° 50` 10").
The proposed project intends to extend a concrete arch culvert 20 linear feet upstream to accommodate a deceleration lane into a proposed mall complex. The culvert extension proposed shall attach to the existing in place culvert and will impact the UNT to the Susquehanna River (WWF) for 20 linear feet of permanent impact and 38 linear feet of temporary impact. This project proposes to permanently impact 334 square feet of emergent/scrub-shrub wetland and temporarily impact 667 square feet of the same wetland. This project is located along Routes 11 and 15 in Shamokin Dam adjacent to the Hampton Inn Motel.

E02-1560. Department of Transportation, District 11-0, 45 Thoms Run Road, Bridgeville, PA 15017. To construct a retaining wall in Castle Shannon Borough, Allegheny County, Pittsburgh ACOE District. The project is located approximately 6 miles south of Pittsburgh and approximately 150 ft. down stream of the SR 88 intersection with Grove Road, in Castle Shannon Borough.

FINAL ACTIONS TAKEN FOR NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS The Department of Environmental Protection (Department) has taken the following actions on previously received applications for new, amended and renewed NPDES and WQM permits, applications for permit waivers and Notices of Intent (NOI) for coverage under general permits. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92 and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P. S. §§ 691.1--691.1001) and the Federal Clean Water Act.
