Actions on applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. FEDERAL WATER POLLUTION CONTROL ACT SECTION 401 The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).
Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.
Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. The applicant proposes to remove 94.0-lineal feet of existing culvert and stabilize 258 lineal feet of a UNT to Conoy Creek (TSF) (Elizabethtown, PA Quadrangle N: 4.0 inches; W: 14.6 inches, Latitude: 40° 08` 47.4"; Longitude: 76° 36` 11.5") as mitigation for the new bridge.

E10-424. St. Kilian Parish, P. O. Box 394, 212 Hook Street, Mars, PA 16046. Church expansion project in Cranberry Township, Butler County, ACOE Pittsburgh District. The applicant proposes to construct the following activities as part of a church expansion project east of Franklin Road south of the intersection with SR 228 in Cranberry Township:
1. To install and maintain a Con/Span bridge having a waterway opening of 6.67 feet and a span of 54 feet with a length of 68 feet.
2. To install and maintain a 130-foot long box culvert having a clear span of 12 feet and an underclearance of 3 feet on a tributary to Kaufman Run.
3. To remove a road crossing with existing 18-inch and 30-inch culverts and restore approximately 30 feet of stream channel.
4. Permanent impacts to 0.40 acre of wetland (PEM, PSS, PFO) for construction of driveways, parking area and stormwater detention pond.
5. To restore approximately 130 feet of tributary 1 to Kaufman Run as mitigation for the proposed box culvert stream enclosure.
The applicant proposes a combination of onsite wetland mitigation of 0.26 acre and a contribution to the Wetland Replacement Fund for the remaining 0.20 acre, total mitigation required 0.46 acre (Mars Quadrangle N: 40° 40` 52.8"; W: 80° 04` 25.5").
E20-550, Cochranton Borough, 109 East Adams Street, P. O. Box 66, Cochranton, PA 16314. Cochranton Borough Sewage Facilities Project, in Cochranton Borough and Wayne Township, Crawford County, ACOE Pittsburgh District (Cochranton, PA Quadrangle N: 4.0 inches; W: 8.5 inches).
The applicant proposes to construct and maintain a sewage collection and treatment system for the Borough of Cochranton consisting of approximately 44,000 linear feet of gravity sewer line and 8,800 linear feet of pressure sewer line, pump stations and a sewage treatment plant involving: 1) to construct and maintain 13 sewer line stream crossings of UNTs to French Creek by the open trench method and a sewer line crossing of Little Sugar Creek by directional drilling; 2) to construct and maintain five sewer line crossings of PEM, PSS and PFO wetlands; 3) to permanently fill 0.007 acre of wetland for the construction of an access drive; 4) to construct and maintain a 1-foot diameter PVC plastic sewage treatment plant outfall to French Creek (N: 41° 30` 10"; W: 80° 02` 20"); 5) to construct and maintain three pump stations at the Fairgrounds (N: 41° 31` 9.8"; W: 80° 03` 11.4"), South Atlantic Avenue (N: 41° 30` 45.3"; W: 80° 02` 24") and Lee Lane (N: 41° 30` 38.6"; W: 80° 02` 28.7"), with a net fill of 1,109 cubic yards within the FEMA floodplain; and 6) to construct and maintain a floodplain fill mitigation area consisting of the removal of approximately 1,112 cubic yards of earthen material from the FEMA floodplain near the proposed sewage treatment plant (N: 41° 30` 12.5"; W: 80° 02` 11.9"). Little Sugar Creek is a perennial stream classified as a CWF. The tributaries to French Creek and French Creek are classified as WWF.
