The work will follow along the Chester County Trail from the East and West Whiteland Township line to the Mill Lane Pump Station. This project is situated approximately 2,000 feet northwest of the intersection SR 202 and SR 30 (Malvern, PA USGS Quadrangle N:  7 inches, W:  12.5 inches).

   To remove an existing road crossing; to construct and maintain a minor road crossing consisting of a 20-foot long by 4-foot by 2.5-foot concrete box culvert with fish baffles depressed 6-inches below streambed elevation in a tributary to Ontelaunee Creek (HQ-CWF); and to construct and maintain seven utility line crossings each consisting of a 6-inch diameter HDPE waterline crossing under various tributaries to Ontelaunee Creek and adjacent wetlands.    To place fill in approximately 0.48 acre of wetland for the purpose of constructing a commercial shopping center including a number of structures, parking lots, entrance ways and stormwater system. The project is located on SR 0611, approximately 0.5 mile east of the Bartonsville exit from I-80. (Saylorsburg, PA Quadrangle N:  22.5 inches; W:  1.7 inches).

   E40-663. Luzerne County, Luzerne County Courthouse--Engineer's Office, Wilkes-Barre, PA 18711, in Wilkes-Barre City, Luzerne County, United States Army Corps of Engineers, Baltimore District.

   The proposed project involves placement of 1.45 feet of fill for the construction of a parking lot within the floodplain of the Susquehanna River. An existing building and asphalt pavement will be removed during construction. Fill for the proposed site will include sub-base, aggregate base and asphalt pavement. Drainage structures, curbing and a 4-foot retaining wall will also be constructed. The wall will work to direct run-off to the proposed drainage structures. The project is located on the northwest corner of the intersection of Pierce and Water Streets in Wilkes-Barre City, Luzerne County. (Kingston, PA Quadrangle N:  0.5 inches; W:  0.5 inches).

To construct a bridge and fill wetlands in North and South Strabane Townships, Washington County, Pittsburgh ACOE District. The applicant proposes to construct and maintain a 24` extension to an existing concrete box culvert, a 31` extension to an existing elliptical plate culvert and to extend an existing culvert 13` upstream and 10` downstream, all on a UNT to Chartiers Creek (WWF) and to remove the existing structure and to construct and maintain a bridge with a single 70` span over Chartiers Creek (WWF) and to place fill in approximately 0.03 acre of wetland (PEM) for the purpose of widening SR 1041 (Racetrack Road) and adding a ramp to Interstate 79.

The applicant proposes to place and maintain fill in 0.21 acre of wetlands in the floodplain of UNTs to Chartiers Creek (WWF) for the purpose of construction of a commercial and residential development (Southpointe II Development) located at the site of the abandoned Western Center State School.

   The applicant proposes to construct a 1,500 square foot house on concrete piers within the floodway of a tributary to Crooked Creek approximately 0.5 mile SE of the intersection of SR 322 and SR 18. The house has already been constructed and the application resulted from an enforcement activity. The tributary to Crooked Creek is a perennial stream classified as a WWF. The project proposes to impact approximately 1,500 square feet of floodway.

   To construct and maintain: 1) 340 foot long by 2 foot wide by 2 foot high earthen berm on the top of the right bank of a UNT to Wild Cat Run for the purpose of protecting an earthen road from flood waters; 2) a wooden pedestrian bridge with a 19-foot clear span and 4-foot underclearance across Wild Cat Run for private use; 3) a 24-inch diameter HDPE culvert with a rock headwall to make a new road crossing near the upstream limit of the earthen berm, located 3,100 feet upstream of the intersection of Gum Stump Road and Runville Road (SR 144) (Bellefonte, PA Quadrangle N:  21.07 inches; W:  13.35 inches) in Boggs Township, Centre County. This project proposes to impact 340 linear feet of the UNT to Wild Cat Run and 5 linear feet of Wild Cat Run that are tributaries to Wallace Run, which is classified as a HQ-CWF and proposes no wetland impacts.

   To construct, operate, maintain and remove, when deemed necessary, a single span bridge across Basin Run that will provide access to State Game Lands No. 100. The bridge shall be constructed and maintained with a minimum span of 80 feet and underclearance of 15 feet. The project is located along the eastern right-of-way of SR 1011 approximately 1.64 miles east of Cooper Township Road No. 730 and SR 1011 intersection.

THE CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT

FINAL ACTIONS TAKEN FOR NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS

   The Department of Environmental Protection (Department) has taken the following actions on previously received applications for new, amended and renewed NPDES and WQM permits, applications for permit waivers and Notices of Intent (NOI) for coverage under general permits. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92 and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P. S. §§ 691.1--691.1001) and the Federal Clean Water Act.

   Sections I---VI contain actions related to industrial, animal or sewage wastes discharges, discharges to groundwater and discharges associated with municipal separate storm sewer systems (MS4), stormwater associated with construction activities and concentrated animal feeding operations (CAFOs). Section VII contains notices for parties who have submitted NOIs for coverage under general NPDES permits. The approval for coverage under general NPDES permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions set forth in each general permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions set forth in the respective permit. Permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

   Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period.    PA0229067, CAFO, SIC 0241, Thomas M. Craig, 2336 Zion Road, Bellefonte, PA 16823. This existing facility is located in Spring Township, Centre County.

   Description of Proposed Activity: Murmac Farms is an existing dairy farm that will be expanding operations to include 1,090 cows (adult, heifers and dry), totaling 1,397 Animal Equivalent Units.

   The water body nearest to this facility is a UNT to Nittany Creek in the Bald Eagle Creek Watershed (SWP-09C) and has a designated use of CWF.

   Except for the chronic or catastrophic rainfall events defined as over the 25-year/24-hour rain storms, the CAFO permit is a nondischarge NPDES permit. Where applicable, compliance with 40 CFR Federal effluent limitation guidelines is required. The permit requires no other numeric effluent limitations and compliance with the Pennsylvania Nutrient Management Act and The Clean Stream Law constitutes compliance with the state narrative water quality standards.

   In addition to the effluent limits, the permit contains the following major special conditions.

   1.  Compliance with the farm's Nutrient Management Plan.
   2.  Compliance with the farm's Preparedness, Prevention and Contingency Plan.
