THE CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT
APPLICATIONS FOR NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS This notice provides information about persons who have applied for a new, amended or renewed NPDES or WQM permit, a permit waiver for certain stormwater discharges or submitted a Notice of Intent (NOI) for coverage under a general permit. The applications concern, but are not limited to, discharges related to industrial, animal or sewage waste, discharges to groundwater, discharges associated with municipal separate storm sewer systems (MS4), stormwater associated with construction activities or concentrated animal feeding operations (CAFOs). This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92 and 40 CFR Part 122, implementing The Clean Streams Law (35 P. S. §§ 691.1--691.1001) and the Federal Clean Water Act.

For applications for new NPDES permits and renewal applications with major changes in Section II, as well as applications for MS4 individual permits and individual stormwater construction permits in Sections IV and VI, the Department, based upon preliminary reviews, has made a tentative determination of proposed effluent limitations and other terms and conditions for the permit applications. These determinations are published as proposed actions for comments prior to taking final actions.
Unless indicated otherwise, the EPA Region III Administrator has waived the right to review or object to proposed NPDES permit actions under the waiver provision in 40 CFR 123.24(d).
Persons wishing to comment on an NPDES application are invited to submit a statement to the regional office noted before an application within 30 days from the date of this public notice. Persons wishing to comment on a WQM permit application are invited to submit a statement to the regional office noted before the application within 15 days from the date of this public notice. Comments received within the respective comment periods will be considered in the final determinations regarding the applications. Comments should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.
The Department will also accept requests for a public hearing on applications. A public hearing may be held if the responsible office considers the public response significant. If a hearing is scheduled, a notice of the hearing will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. The Department will postpone its final determination until after a public hearing is held.

Description of Proposed Activity: The transfer and discharge of untreated Delaware River water to the North Branch Neshaminy Creek by means of the Bradshaw Reservoir.
The receiving stream, North Branch Neshaminy Creek is in the State Water Plan Watershed 2F--Neshaminy Creek and is classified for: WWF. The nearest downstream public water supply intake for North Penn and North Wales Water Authorities is located on North Branch Neshaminy Creek.

The receiving stream, a UNT to East Branch Big Elk Creek is in the State Water Plan Watershed 7K, within the Chesapeake Bay Watershed, and is classified for: HQ-TSF, MF. There are no public water supply intakes identified downstream. This facility is a Phase 4 discharger as described in Pennsylvania's Chesapeake Bay Tributary Strategy.
The proposed effluent limits for Outfall 001 are based on an annual average flow of 0.35 mgd.

This renewal will also reflect an application to transfer the permit from Uwchlan Township to Uwchlan Township Municipal Authority.
The receiving stream, Shamona Creek, is in the State Water Plan Watershed 3H and is classified for: HQ-TSF, MF. The nearest downstream public water supply existing or proposed is a future Downingtown water filtration plant located on East Brandywine Creek, approximately 4.5 miles below the point of discharge.

This facility is located in East Manchester Township, York County.
Description of activity: The Department of Environmental Protection, Southcentral Regional Office Water Management Program, is proposing to amend NPDES Permit No. PA0008281 to include a new outfall for the discharge of treated wastewater generated by two flue gas desulfurization (scrubber) towers. A new industrial wastewater treatment plant will be constructed to treat the wastewater.
The receiving streams, Susquehanna River, Conewago Creek and Hartman Run, are in Watersheds 7-F and 7-H, and classified for WWF, water supply, recreation and fish consumption. The nearest downstream public water supply intake for Wrightsville Water Supply Co. is located on the Susquehanna River, approximately 10 miles downstream.
The proposed effluent limits for Outfall 007 (scrubber wastewater) for a design flow of 0.52 mgd are:

Description of activity: The application is for renewal of an NPDES permit for an existing discharge of treated sewage.
The receiving stream, West Branch of Perkiomen Creek, is in Watershed 3-E, and classified for exceptional value, water supply, recreation and fish consumption. The nearest downstream public water supply intake for Philadelphia Suburban Water Company is located on the Green Lane Reservoir, approximately 15 miles downstream. The discharge is not expected to affect the water supply.

The following effluent limitations are proposed for discharge to the receiving waters, North Fork of Little Beaver Creek, classified as a HQ-CWF with existing and/or potential uses for aquatic life, water supply and recreation. The first existing/proposed downstream potable water supply is the City of East Liverpool Ohio's intake, located on the Ohio River, 15 miles below the discharge point.

WQM Permit No. 5408401, Sewerage, Wayne Township Municipal Authority, P. O. Box 97, Friedensburg, PA 17933. This proposed facility is located in Wayne Township, Schuylkill County, PA.
Description of Proposed Action/Activity: This project consists of construction of a sanitary sewage collection system to service the 443-Long Run Corridor in Wayne Township.

WQM Permit No. 5508401, Sewerage, SIC 4952, Spring Township Municipal Authority, P. O. Box 133, Beaver Springs, PA 17812. This proposed facility is located in Spring Township, Snyder County.
Description of Proposed Action/Activity: The applicant proposes several renovations to the existing sewage treatment facilities in Spring Township, Snyder County. The renovations include repainting the plant as well as the addition of a 79,000 gallon sludge digestion tank to increase the sludge digestion capacity of the facility. The existing sludge digestion tanks will be modified and used as additional aeration capacity for the treatment process.
