Public Hearing for NPDES Permit No. PAI023508001;
Proposed Marjol Battery Site Project,
Throop Borough, Lackawanna CountyOn February 19, 2008, the Department of Environmental Protection (Department) received an administratively complete NPDES Permit application package for the proposed Marjol Battery Site Project located in Throop Borough, Lackawanna County.
The Department will hold a public hearing to accept comment on the documentation and plans associated with the Individual NPDES Permit Application No. PAI023508001 for the discharge of stormwater from construction activities to Sulphur Creek and the Lackawanna River in Throop Borough, Lackawanna County.
The public hearing will be conducted on Wednesday, April 16, 2008, at 7 p.m. at the Throop Community Civic Center, 500 Sanderson Street, Throop Borough, Lackawanna County by the Watershed Management Program, Permitting and Technical Services Section, 2 Public Square, Wilkes-Barre, PA 18711-0790, (570) 826-2511.
The Department requests that individuals wishing to testify at the hearing submit a written notice of intent to Marjol Batter Site Hearing, Department of Environmental Protection, Watershed Management Program, 2 Public Square, Wilkes-Barre, PA 18711. The Department will accept notices up to the day of the hearing. The Department requests that individuals limit their testimony to 10 minutes so that all individuals have the opportunity to testify. The Department can only review comments made with regard to the NPDES Permit Application No. PAI023508001 documentation and plans. Written copies of oral testimony are requested. Relinquishing time to others will not be allowed. Individuals attending the hearing will have the opportunity to testify if they so desire; however, individuals who preregister to testify will be given priority on the agenda.

Bureau of Deep Mine Safety
Approval of Request for Variance The Department of Environmental Protection (Department), Bureau of Deep Mine Safety (BMS) has approved Rosebud Mining Company's request for a variance from the requirements of Section 290(d) of the Pennsylvania Bituminous Coal Mine Act at the Dutch Run Mine. This notification contains a summary of this request and the basis for the Department's approval. Summary of the Request: Rosebud Mining Company requests a variance to reduce the number of main entries in the D Mains Section at the Dutch Run Mine.
The basis for the Bureau's approval is summarized as follows:
1. Dutch Run has developed portions of this same mine with less than five entries previously without any complications.
2. Longwall mines have successfully ventilated three entry systems for distances up to 12,000 feet. Longwall gate-road development generally encounters methane liberations far in excess of those shown at the Dutch Run Mine.
3. According to an October 2007 air sample collected by MSHA, the Dutch Run Mine produces 41,160 CFM of CH4 per 24 hours.
4. An Axidyne L-10-60 fan is capable of 320,000 cfm. The fan is currently operating on blade setting 2 out of a total of 6.
5. Reducing the number of main entries from five to three reduces the amount of exposed roof.
6. A CO monitoring system will enhance escapability through the variance area by providing early warning.
Continued authorization for operation under the approval is contingent upon compliance with the measures described in your enclosed plan and the following conditions.
1. All unused crosscuts through the variance area must have adequate ground to roof support placed on both entrances in line with the entry rib. Additional supplemental support must be installed throughout the area as required.
2. All roof falls that occur in the variance area must be completely cleaned and permanently supported before resumption of mining.
3. Dutch Run must mine a minimum of two cross-cuts prior to expanding into five entries to ensure that bad roof conditions have been passed.
4. The CO sensors should be placed in the primary intake escapeway and in the belt at the beginning and at the end of the variance area.
5. The CO system shall provide visual and audible alarms. The audible alarms shall be transmitted over the mine communication system.

Swisher Contracting, Inc., GFCC No. 17-07-05, Bradford Township, Clearfield County (Upper West Branch Watershed): A no-cost construction contract has been awarded to Swisher Contracting, Inc., that will result in the reclamation of approximately 18.8 acres of abandoned mine lands including 2,500 feet of abandoned highwall and the reclamation of 18.8 acres of abandoned mine spoil and the recovery of 18,500 tons of coal reserves. Approximately 9,880 tons of alkaline material in the form of imported baghouse lime (waste lime) will be added to the 5.4 acre coal extraction area. Blasting has been approved as part of the reclamation activities. The site will be reclaimed and regraded to approximate original contour. The estimated value of the reclamation work is $112,800, which will be done at no cost to the Commonwealth. The site is located approximately one-half mile southeast of the Woodland interchange of Interstate 80 on lands formerly mined and subsequently abandoned by Woolridge Coal Company in the late 1940's.
