Appeal of Exxon Service Station 9899 under the Storage Tank and Spill Prevention Act; Underground Storage Tank Indemnification Fund; USTIF File No. 2005-0109(M); Doc. No. UT07-07-021 The proceedings in this matter will be governed by Pa.C.S. §§ 501--508, 701--704 (relating to the Administrative Agency Law), 1 Pa. Code Part II (relating to General Rules of Administrative Practice and Procedure) and any other relevant procedure provisions of law.
A hearing is scheduled for May 21 and 22, 2008, beginning at 10 a.m. each day in the Administrative Hearings Office, Capitol Associates Building, Room 200, 901 North Seventh Street, Harrisburg, PA 17102. On or before May 1, 2008, Exxon Service Station 9899 must serve on USTIF a copy of any report generated by an expert witness. Copies of expert reports need not be filed with the Administrative Hearings Office. Experts will be permitted to testify only on matters substantially contemplated by reports supplied to the other party in accordance with this paragraph. On or before May 9, 2008, USTF must serve on Exxon Service Station 9899 a copy of any report generated by an expert witness. Copies of expert reports need not be filed with the Administrative Hearings Office. Motions preliminary to those at hearing, if any, must be filed on or before May 1, 2008, with the Hearings Administrator, Administrative Hearings Office, Capitol Associates Building, Room 200, 901 North Seventh Street, Harrisburg, PA 17102. Responses to preliminary motions, if any shall be filed on or before May 15, 2008. On or before May 14, 2008, each party shall file with the Administrative Hearings Office and serve on the opposing party a prehearing statement which must contain: (a) names and address of witnesses along with the specialties of experts to be called; (b) a list of documents to be used at the hearing; and (c) a summary of special evidentiary or other legal issues. A jointly executed stipulation of facts may be presented for admission into the record at the beginning of the hearing.
