FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

   The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

   Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

   Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board.    To reauthorize the construction and maintenance of the following water obstructions and encroachments associated with the development of a proposed 700-lot residential subdivision known as The Hills at Lock Ridge. The water obstructions and encroachments were previously authorized by Permit No. E39-381, which expired prior to completion of construction. Other water obstructions were previously authorized and constructed under Permit No. E39-381.

   1.  A road crossing of a tributary to Swabia Creek (Tributary B) (HQ-CWF), consisting of a 6.0-foot by 3.5-foot concrete box culvert, with its invert depressed 6 inches, for the construction of Stack Road.

   2.  Relocation of approximately 1,720 linear feet of a tributary to Swabia Creek (Tributary B) for widening of Orchard Road.

   3.  Recreational facilities (including soccer and playground equipment and 6-foot wide bituminous path) in the floodway of Swabia Creek (HQ-CWF).

   The project is located on a 272-acre tract of land on the south side of the Norfolk Southern Railroad, adjacent to T-480, T-482, T-484 and Lock Ridge Park and Furnace Museum (Allentown West, PA Quadrangle N:  2.0 inches; W:  11.0 inches). (Subbasin: 2C)

   E48-386. Lower Mt. Bethel Township, 2004 Hutchison Avenue, P. O. Box 257, Bangor, PA 18063. Lower Mt. Bethel Township, Northampton County, United States Army Corps of Engineers Philadelphia District.

   To construct and maintain a 5-foot wide by 72-foot long concrete, fair-weather ford crossing for the purpose of providing a pedestrian crossing in Oughoughton Creek (CWF). The project is located approximately 3,000 feet upstream of the confluence with the Delaware River (Belvidere, PA-NJ Quadrangle N:  8.8 inches; W:  17.2 inches). (Subbasin: 1F)

   To construct and maintain three dry hydrants, two in Westcolang Lake (HQ-CWF) and one in a pond locally known as Briars Pond. The hydrants are located in the Masthope Mountain Community Residential Development (Narrowsburg, NY-PA Quadrangle N:  2.1 inches; W:  5.3 inches). (Subbasin: 1A)

   To construct and maintain a 140-foot long, 6.0-foot CMP stream crossing in a UNT to Beaver Creek (WWF) (Latitude: 40° 16` 35.4"; Longitude: 76° 46` 31.8"), a 160.0-foot long, 7.0-foot CMP stream crossing in a UNT to Beaver Creek (WWF) (Latitude: 40° 16` 35.46"; Longitude: 76° 46` 40.86") and to permanently impact 0.243 acre of palustrine emergent wetlands associated to a UNT to Beaver Creek (WWF) at the southwest intersection of Lyters Lane and 67th Street (Harrisburg East, PA Quadrangle N:  5 inches; W:  3.5 inches, Latitude: 40° 16.640` N; Longitude: 76° 46.595` W) in Lower Paxton Township, Dauphin County. Applicant proposes 0.245 acre of onsite wetland mitigation.

   To construct and maintain 4-foot wide timber bridge having for spans for a total of 83 feet and a maximum underclearance of about 10 feet across a tributary to Slippery Rock Creek (CWF) and adjoining wetlands for a scenic walkway connecting Phases 1 and 2 to Phase 3 of the Weathervane Hill residential development along Harmony Road (T-376) approximately 1,500 feet north of SR 173.

Approval of Request for Variance

   The Department of Environmental Protection (Department), Bureau of Deep Mine Safety (BMS) has approved Rosebud Mining Company's request for a variance from the requirements of Section 290(d) of the Pennsylvania Bituminous Coal Mine Act at the Keystone East Mine. This notification contains a summary of this request and the basis for the Department's approval.    Summary of the Request:  Rosebud Mining Company requests a variance to reduce the number of main entries in the 1 Left Butt Section at the Keystone East Mine.

   The basis for the BMS's approval is summarized as follows:

   1.  The Keystone East mine variance area will allow short-term access to the 1st Left Butt reserves only. When the coal within this area is depleted the mine will be sealed.

   2.  Longwall mines have successfully ventilated three entry systems for distances up to 12,000 feet. Longwall gate-road development generally encounters methane liberations far in excess of those shown at the Keystone East Mine.

   3.  According to a June 28, 2007, air sample collected by MSHA, the Keystone East Mine produces 50,015 CFM of CH4 per 24 hours.

   4.  The main fan is located 700 feet from the mouth of the 1st Left Butt and can supply as much air as is required to mine the 1st Left Butt area safely.

   5.  Reducing the number of main entries from four to three reduces the amount of exposed roof within a potentially bad roof area.

   6.  A CO monitoring system will enhance escapability through the variance area by providing early warning.

   Continued authorization for operation under the approval is contingent upon compliance with the measures described in the enclosed plan and the following conditions.

   1.  All unused crosscuts through the variance area must have two cribs placed on both entrances in line with the entry rib. Additional supplemental support will be installed throughout the area as required.

   2.  All roof falls that occur in the variance area must be completely cleaned and permanently supported before resumption of mining.

   3.  CO sensors should be placed in the primary intake escapeway at the beginning of the variance area. A second sensor should be positioned along the primary intake escapeway at the end of the variance area.

   4.  The CO system shall provide visual and audible alarms at the tailpiece.
