LAND RECYCLING AND ENVIRONMENTAL REMEDIATION
UNDER ACT 2, 1995
PREAMBLE 1
Acknowledgment of Notices of Intent to Remediate Submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).
Sections 302--305 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. Persons intending to use the Background Standard, Statewide Health Standard, the Site-Specific Standard or who intend to remediate a site as a special industrial area must file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site and a description of the intended future use of the site. A person who demonstrates attainment of one, a combination of the cleanup standards or who receives approval of a special industrial area remediation identified under the act will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.
Under sections 304(n)(1)(ii) and 305(c)(2) of the act, there is a 30-day public and municipal comment period for sites proposed for remediation using a Site-Specific Standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area of the site. For the sites identified, proposed for remediation to a Site-Specific Standard or as a special industrial area, the municipality within which the site is located may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified. During this comment period, the municipality may request that the person identified as the remediator of the site develop and implement a public involvement plan. Requests to be involved and comments should be directed to the remediator of the site.
For further information concerning the content of a Notice of Intent to Remediate, contact the environmental cleanup program manager in the Department regional office before which the notice appears. If information concerning this acknowledgment is required in an alternative form, contact the community relations coordinator at the appropriate regional office. Charles Metzger, ECC, Inc., 135F Gaither Drive, Mount Laurel, NJ 08054 on behalf of James Gorman, 522 McFarlan Road, Kennett Square, PA 19348 has submitted a Notice of Intent to Remediate. Groundwater at the site has been impacted by the release of No. 2 fuel oil. The future use of the site will remain a residential property following project completion.

Kirsch, c/o Richard E. Javage, Jr., Esq., 3550 Township Line Road, Drexel Hill, PA 19026 has submitted a Notice of Intent to Remediate. Groundwater at the site has been impacted by release of chlorinated solvent. The subject property will continue to be an automobile dealership and service facility after completion of the pending real estate transaction.

Soil at the site has been impacted with the release of Pcb. It is anticipated that the intended future use of the property will be a residential condominium complex.

Richard Kranes, Goldman Environmental Consultants, 60 Brooks Drive, Braintree, MA 02182 has submitted a Notice of Intent to Remediate (on behalf of his client, CIRCOR International, Inc., 25 Corporate Drive, Suite 130, Burlington, MA 01803), concerning the remediation of site groundwater found or suspected to have been impacted by volatile organics and inorganics as a result of an historical release of chlorinated aromatic compounds. The applicant proposes to remediate the site to meet the Site-Specific Standard for groundwater, using pathway elimination. A summary of the Notice of Intent to Remediate was published in The Times-Leader on July 3, 2008.
Former Kenny's Restaurant and Lounge, Palmer Township, Wayne County. John R. Ross, P. E., EarthRes Group, Inc., P. O. Box 468, Pipersville, PA 18947 has submitted a Notice of Intent to Remediate (on behalf of his client, The Dime Bank, 820 Church Street, Honesdale, PA 18431), concerning the remediation of soils found or suspected to have been contaminated by petroleum related compounds as the result of a release from an overturned underground storage tank containing No. 2 heating oil during demolition activities. The applicant proposes to meet the Residential Statewide Health Standard for soils. The proposed future use of the property will be for commercial use. A summary of the Notice of Intent to Remediate was published in The News Eagle on June 21, 2008. A Final Report was simultaneously submitted.

David Fife, Quad Three Group, Inc., Glenmaura Professional Center, 72 Glenmaura National Boulevard, Suite 105, Moosic, PA 18507 has submitted a Notice of Intent to Remediate (on behalf of his client, Emily Giorgianni, R. R. 1, Box 6, Kingsley, PA 18826), concerning the remediation of soil and groundwater found or suspected to have been impacted by No. 2 fuel oil as a result of a release from an aboveground storage tank due to the installation of a faulty filter. The applicant proposes to remediate the site to meet the Statewide Health Standard. The proposed future use of the property will be residential. A summary of the Notice of Intent to Remediate was published in the Susquehanna County Transcript on June 25, 2008.

The applicant proposes to remediate the site to meet the Site-Specific Standard for soil and Statewide Health Standard for groundwater. Costy's Used Truck and Auto Parts, Inc., Richmond Township, Tioga County, O'Brien & Gere, 512 East Township Road, 2 Valley Square, Suite 120, Blue Bell, PA 19422 on behalf of David and Daniel Kurzejewski, Costy's Used Truck and Auto Parts, Inc., R. R. 1, Box 876 (2395 South Main Street), Mansfield, PA 16933 has submitted a Notice of Intent to Remediate soil and groundwater contaminated with VOC and semi-VOCs and metals (lead and zinc). The applicant proposes to remediate the site to meet the Site-Specific Standard. The intended future use of the property is continued commercial use. A summary of the Notice of Intent to remediate was reported to have been published in the The Wellsboro Gazette on June 25, 2008.

Walker Fuel Oil Spill Site, Fairfield Township, Crawford County. Moody & Associates, Inc., 11548 Cotton Road, Meadville, PA 16335 on behalf of Fortunata Walker, 704 Sara Lane, Verona, PA 15147 has submitted a Notice of Intent to Remediate. A spill occurred from an outside oil tank. Approximately 200 gallons of Fuel Oil No. 2 was released onto the ground. The site will continue to be used as a vacation home. The Notice of Intent to Remediate was published in The Meadville Tribune on June 11, 2008.
AIR QUALITY
PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS
NEW SOURCES AND MODIFICATIONS The Department of Environmental Protection (Department) has developed an ''integrated'' plan approval, State operating permit and Title V operating permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the public. This approach allows the owner or operator of a facility to complete and submit all the permitting documents relevant to its application one time, affords an opportunity for public input and provides for sequential issuance of the necessary permits.
The Department has received applications for plan approvals and/or operating permits from the following facilities.
Copies of the applications, subsequently prepared draft permits, review summaries and other support materials are available for review in the regional office identified in this notice. Persons interested in reviewing the application files should contact the appropriate regional office to schedule an appointment.
Persons wishing to receive a copy of a proposed plan approval or operating permit must indicate their interest to the Department regional office within 30 days of the date of this notice and must file protests or comments on a proposed plan approval or operating permit within 30 days of the Department providing a copy of the proposed document to that person or within 30 days of its publication in the Pennsylvania Bulletin, whichever comes first. Interested persons may also request that a hearing be held concerning the proposed plan approval and operating permit. Comments or protests filed with the Department regional offices must include a concise statement of the objections to the issuance of the Plan approval or operating permit and relevant facts which serve as the basis for the objections. If the Department schedules a hearing, a notice will be published in the Pennsylvania Bulletin at least 30 days prior the date of the hearing.
Persons with a disability who wish to comment and require an auxiliary aid, service or other accommodation to participate should contact the regional office identified before the application. TDD users should contact the Department through the Pennsylvania AT&T Relay Service at (800) 654-5984.
Final plan approvals and operating permits will contain terms and conditions to ensure that the source is constructed and operating in compliance with applicable requirements in 25 Pa. Code Chapters 121--143, the Federal Clean Air Act (act) and regulations adopted under the act.

(650 Cathill Road, Sellersville, PA 18960) for addition of ethanol and isopropyl alcohol granulation formulations to an existing Glatt 120 Fluid Bed Processor at its facility in West Rockhill Township, Bucks County. The potential VOC emissions from this project were estimated to be 11.7 tpy on a 12-month rolling sum basis. The facility limit for VOC emissions is 24 tpy on a 12-month rolling sum basis.
46-0032D: SPS Technologies, Inc. (301 Highland Avenue, Jenkintown, PA 19046) for the installation of a Plating Line, at SPS major manufacturing aerospace parts facility at Highland Avenue, Abington Township, Montgomery County. The installation of the Plating Line may result in the emissions of: 7.80 tpy of PM and 7.80 tpy of HAPs. The Plan Approval and Operating Permit will contain additional recordkeeping and operating restrictions designed to keep the facility operating within all applicable air quality requirements. The facility currently has a Title V Operating Permit No. 46-00032. The Plan Approval will subsequently be incorporated into the Title V Operating Permit through an administrative amendment in accordance with 25 Pa. Code § 127.450.

54-302-075: Pine Grove Area School District (103 School Street, Pine Grove, PA 17963-1698) for modification and operation of a 6.0 mmBtu heat input coal fired boiler at the Pine Grove Area School District, Pine Grove Borough, Schuylkill County. Presently this boiler utilizes anthracite coal containing sulfur and ash less than 0.65% and 10% by weight respectively. By this application the school district is seeking permission to utilize anthracite coal containing sulfur and ash less than 1% and 12% by weight respectively. Potential SOx and filterable PM emissions increase will be 14.32 tpy and 0.4 tpy respectively due to this change. The school district will operate and maintain the boiler in accordance with the good engineering practices to assure proper operation. The Plan Approval and Operating permit will contain additional recordkeeping and operating restrictions designed to keep the facility operating within all applicable air quality requirements.

06-05069O: East Penn Manufacturing Co., Inc. (P. O. Box 147, Lyon Station, PA 19536-0147) for construction of a third surface coating line to be controlled by a total enclosure and existing carbon adsorption system at their battery assembly plant in Richmond Township, Berks County. The new line will be subject to 40 CFR Part 63, Subpart MMMM, National Emission Standards for HAPs from Miscellaneous Metal Coating Operations, MACT. The plan approval will include monitoring, recordkeeping, work practices and reporting requirements designed to keep the source operating within all applicable air quality requirements. The facility is presently covered by the Title V operating permit application No. 06-05069. The plan approval will be incorporated into the permit in accordance with 25 Pa. Code § 127.450 (Administrative Amendment).
38-03035B: V & S Lebanon Galvanizing, LLC (1000 Buckeye Park Road, Columbus, OH 43207) for an increase in the annual galvanized steel throughput from 36,000 to 46,000 tons during any consecutive 12-month period at their facility in Union Township, Lebanon County. The facility has the potential to emit less than 1 tpy of SOx and VOCs, 7 tpy of NOx, 6 tpy of CO, 5 tpy of PM and 2 tpy of combined HAPs. The plan approval will include monitoring, work practice standards, recordkeeping and reporting requirements to ensure the facility complies with the applicable air quality regulations.

14-318-002: Valley Enterprise Containers, LLC (111 Eagleville Road, Blanchard, PA 16826) for the construction of a metal waste container (dumpster) surface coating operation in Liberty Township, Centre County.
The air contaminant emissions from the surface coating operation are not expected to exceed 15.79 tons of VOCs, 2.36 tons of VHAPs, 2.88 tons of PM/PM10 and 4.94 tons of acetone per year.
The facility in which the respective surface coating operation is located is not a major (Title V) facility for any air contaminant.
The Department of Environmental Protection's (Department) review of the information submitted by Valley Enterprise Containers, LLC indicates that the surface coating operation will comply with all applicable regulatory requirements pertaining to air contamination sources and the emission of air contaminants including 25 Pa. Code § 129.52 and the BAT requirement of 25 Pa. Code §§ 127.1 and 127.12. Based on this finding, the Department proposes to issue plan approval for the construction of the surface coating operation.
The following is a summary of the conditions the Department proposes to place in the plan approval to be issued to ensure compliance with all applicable requirements:
1. The total combined VOC emissions from the surface coating operation shall not exceed 15.79 tons in any 12-consecutive month period, the total combined VHAP emissions shall not exceed 2.36 tons in any 12-consecutive month period and the total combined acetone emissions shall not exceed 4.94 tons in any 12-consecutive month period.
2. No more than 9,975 gallons of coatings, as-received from the vendor or supplier, shall be used in any 12-consecutive month period, none of which shall have a VOC content in excess of 3.36 pounds per gallon of coating or a VHAP content in excess of .97 pound per gallon of coating.
3. Nothing shall be added to the coatings onsite other than acetone and no more than 1,500 gallons of acetone shall be used in any 12-consecutive month period.
4. No coatings containing chromium, lead, manganese, nickel or cadmium may be used.
5. No VOC-containing materials, VHAP-containing materials or acetone-containing materials shall be used for the cleanup of either coating application equipment or for the preparation of the surfaces to be coated.
6. All surface coating shall be done with airless spray guns (or such alternate coating application equipment as the Department determines to have an equivalent, or better, transfer efficiency).
7. All surface coating shall take place in a spray booth, the doors of which shall be closed whenever coating is occurring.
8. The spray booth shall be equipped with a full set of filter panels whenever coating is occurring and shall only be exhausted to atmosphere through these filter panels. Spare filter panels shall be kept onsite.
9. The spray booth shall be equipped with instrumentation to monitor the differential pressure across the filter panels on a continuous basis.
10. The concentration of PM in the spray booth exhaust shall not exceed .01 grain per dry standard cubic foot of effluent gas volume.
11. All containers of VOC-containing materials, VHAP-containing materials and acetone-containing materials shall be kept closed except when removing material from the container or placing material into the container.
12. Comprehensive accurate records shall be maintained of the identity, quantity, VOC content, VHAP content, acetone content and solids content of each coating and coating additive used each day, the component mix ratio for any coatings to which an additive is added onsite, and the amount of VOCs, VHAPs and acetone emitted each month. All records are to be retained for at least 5 years, shall be reported to the Department on an annual basis and shall otherwise be made available to the Department upon request.
19-00032A: Benton Area School District (600 Green Acres Road, Benton, PA 17814) has submitted an application (19-00032A) to the Department of Environmental Protection (Department) for plan approval to construct a 7.5 mmBtu/hr, Advanced Recycling Equipment, Inc. Model No. CCUE407-W, wood-fired boiler and install a multi-clone collector to control PM emissions from the boiler. The boiler is proposed to generate supplemental steam for domestic heating purposes at L. R. Appleman Elementary School and the Benton Area Middle/High School located in Benton Borough, Columbia County.
The Department's review of the information submitted by Benton Area School District indicates that the proposed construction will meet all applicable air quality requirements pertaining to air contamination sources and the emission of air contaminants, including the BAT requirements of 25 Pa. Code §§ 127.1 and 127.12. Based on these findings, the Department intends to approve the application and issue plan approval for construction of the 7.5 mmBtu/hr, wood-fired boiler that includes installation of multiclone collector to control PM emissions from the boiler. Additionally, if the Department determines the construction and operation of the boiler and multiclone collector are in compliance with all plan approval conditions, the conditions established in the plan approval will be incorporated into the State-only operating permit 19-00032 by means of an administrative amendment under 25 Pa. Code § 127.450. This facility is a State-only facility.
The following is a summary of the conditions the Department proposes to place in the plan approval to ensure compliance with all applicable regulatory requirements:
1. Under the BAT requirements of 25 Pa. Code §§ 127.1 and 127.12, the NOx, expressed as NO2 emissions from the exhaust of ID C031 associated with Source ID 031 shall not exceed 0.22 lb/mmBtu of heat input and 7.23 tons in any 12-consecutive month period.
2. Under the BAT requirements of 25 Pa. Code §§ 127.1 and 127.12, the CO emissions from the exhaust of ID C031 associated with Source ID 031 shall not exceed 0.16 lb/mmBtu of heat input and 5.39 tons in any 12-consecutive month period.
3. Compliance with this streamlined plan approval condition assures compliance with 25 Pa. Code § 123.22.
Under the BAT requirements of 25 Pa. Code §§ 127.1 and 127.12, no person may permit the emission of SOx, expressed as SO2 into the outdoor atmosphere from the exhaust of ID C031 associated with Source ID 031 in excess of the rate of 0.03 lb/mmBtu of heat input and 0.99 ton in any 12-consecutive month period.
4. Under the BAT requirements of 25 Pa. Code §§ 127.1 and 127.12, the VOC emissions from the exhaust of ID C031 associated with Source ID 031 shall not exceed 0.004 lb/mmBtu of heat input and 0.13 ton in any 12-consecutive month period.
5. Compliance with this streamlined plan approval condition assures compliance with 25 Pa. Code § 123.11.
Under the BAT requirements of 25 Pa. Code §§ 127.1 and 127.12, the PM emissions from the exhaust of ID C031 associated with Source ID 031 shall not exceed 0.22 lb/mmBtu of heat input and 7.23 tons in any 12-consecutive month period.
6. Under the BAT requirements of 25 Pa. Code §§ 127.1 and 127.12, no person may permit the emission into the outdoor atmosphere of visible air contaminants in a manner that the opacity of the emissions from ID C031 associated with Source ID 031 is equal to or greater than 10% by Method 9, except during the start up and shut down of Source ID 031.
During start up and shut down of Source ID 031, the permittee shall still comply with the opacity limitations as specified in 25 Pa. Code § 123.41.
7. The permittee shall perform PM, NOx and CO stack tests upon ID C031 associated with Source ID 031 within 120 days from the commencement of operation of Source ID 031 to demonstrate compliance with the PM, NOx and CO emissions limitations above. The permittee shall perform an opacity test upon the exhaust of ID C031 by utilizing the Method 9 reference test method to verify compliance with the opacity limitation.
(a) Testing is to be done using reference method test procedures acceptable to the Department.
(b) Testing is to be performed while Source ID 031 is operating at its maximum routine operating conditions.
8. At least 60 days prior to the scheduled performance of the stack testing required by this plan approval, the permittee shall submit a test plan or protocol to the Department. This plan shall contain a description of the specific testing and analytical procedures to be used in performing the testing, a description of the procedure proposed for the determination of the heat input to Source ID 031 during each test run, a listing of all boiler and air pollution control equipment operating parameters to be monitored during test performance and dimensioned sketches of the test port locations showing the upstream and downstream ductwork, stack, and the like configuration.
The Department shall be given 15 days notice of the scheduled dates for the performance of stack testing required by the plan approval. The Department is under no obligation to accept the results of any testing performed without adequate advance notice having been provided.
Within 60 days of completion of the testing required by this plan approval, two copies of a test report shall be submitted to the Department. This report shall contain the results of the stack testing, a description of the testing and analytical procedures actually used, a copy of all boiler heat input determinations or calculations made for the test period, all boiler and air pollution control equipment operating data recorded during the testing, a copy of all raw data and a copy of all calculations generated during data analysis.
9. Under the BAT requirements of 25 Pa. Code §§ 127.1 and 127.12, ID C031 shall be equipped with instrumentation to accurately measure the differential pressure across the collector on a continuous basis.
10. Under the BAT requirements of 25 Pa. Code §§ 127.1 and 127.12, Source ID 031 shall be fired on virgin hardwood sawdust and wood chips consisting of green and kiln-dried wood only. No coated or treated wood, laminated wood, particleboard, flakeboard or materials other than green or kiln-dried wood shall be burned in this boiler.
11. The permittee shall keep accurate and comprehensive records of the following information for Source ID 031; stack test reports, the supporting calculations on a monthly basis used to verify compliance with the NOx, CO, SOx, VOC and PM emission limitations in any 12-consecutive month period, and the differential pressure across ID C031 at least once per day.
These records shall be kept for a minimum of 5 years and shall be made available to the Department upon request.
12. Under the BAT requirements of 25 Pa. Code §§ 127.1 and 127.12, the multiclone collector ash discharge system shall remain sealed from the open air at all times except when changing fly-ash disposal dumpster. Additionally, the level of accumulated ash in the fly-ash disposal dumpster shall be checked daily and the dumpster shall be emptied prior to becoming full.
13. Under the BAT requirements of 25 Pa. Code §§ 127.1 and 127.12, the wood augers and conveyors of Source ID 031 shall be fully enclosed. Additionally, the wood augers and conveyors shall be constructed and operated in a fully enclosed structure (boiler bulding).
14. Under the BAT requirements of 25 Pa. Code §§ 127.1 and 127.12, the fuel pit (FM031) shall be constructed in a fully enclosed structure (boiler building). Additionally, the opening of the vehicle from which the fuel is being dispensed from and into FM031 shall break the plane of the opening, as described herein, during the unloading operation of fuel for Source ID 031. The plane of the opening is the area of the door opening of the enclosed structure (boiler building). The doors shall be completely shut except during unloading operations of fuel for Source ID 031.
15. Under the BAT requirements of 25 Pa. Code §§ 127.1 and 127.12, the permittee shall not operate Source ID 031 without the simultaneous operation of ID C031.
16. Under the BAT requirements of 25 Pa. Code §§ 127.1 and 127.12, this plan approval is issued for the construction of a 7.5 mmBtu/hr Advanced Recycling Equipment Model No. CCUE-407-W wood fired boiler with an integral fuel delivery system for the boiler (Source ID 031). Written comments, objections or requests for informal conferences on applications may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the district mining office indicated before an application within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34.
Where any of the mining activities listed will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. NPDES permits will contain, at a minimum, technology-based effluent limitations as identified in this notice for the respective coal and noncoal applications. In addition, more restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit, when necessary, for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). Persons or agencies who have requested review of NPDES permit requirements for a particular mining activity within the previously mentioned public comment period will be provided with a 30-day period to review and submit comments on the requirements.
Written comments or objections should contain the name, address and telephone number of the person submitting comments or objections; the application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor; the application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor wishes to have the conference conducted in the locality of the proposed mining activities.

The dam is a part of the Authority's de-icing/stormwater treatment system.
