PUBLIC WATER SUPPLY (PWS) PERMITS The Department of Environmental Protection has taken the following actions on applications received under the Pennsylvania Safe Drinking Water Act (35 P. S. §§ 721.1--721.17) for the construction, substantial modification or operation of a public water system.

Notice of Prompt Interim Response
Seneca Drum Site
Cranberry Township, Venango CountyThe Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (35 P. S. §§ 6020.101--6020.1305) (HSCA), has conducted a response action for the Seneca Drum Site (site). The site is located in Cranberry Township, Venango County, PA, at the end of Quaker Drive, near Route 257, in Seneca, Venango County, PA. The site is located in a commercial/industrial area and transected by a public water supply line. During repair operations of the public water supply line, leaking drums and waste were discovered buried near the supply line. At the time of the response, the drums and waste excavated during the repair were staged near the pit created by the water line repair. The drums and associated soils mixed with spilled waste contain hazardous substances; including acetone, toluene and xylene have leaked into the surrounding soil and threaten release to site groundwater.
For this prompt interim response, the Department considered three alternatives for the site: 1) no action; and 2) remove the visible wastes, impacted soils and drums in the vicinity of the pit area, along with previously excavated wastes impacted soils and drums; and 3) removal of the previously excavated waste, drums and impacted soils and delineation of all remaining buried drums and waste, followed by excavation and removal.
Each alternative was evaluated with respect to four comparison criteria of: (1) the extent to which each alternative protects the public health and the environment; (2) the extent to which each alternative complies with or otherwise addresses Applicable or Relevant and Appropriate Requirements; (3) the extent to which each alternative is feasible, effective, implementable and permanent; and (4) the relative cost of each alternative.
Furthermore, this comparative analysis evaluated the relative performance of each alternative in relation to each specific comparison criterion. The comparative analysis identified advantages and disadvantages of each alternative, so that tradeoffs between the alternatives could be determined.
Based on the comparative analysis the Department chose to implement Alternative 2 as the prompt interim response for the site. This alternative was selected because it would, in the more cost-effective manner, protect the public and environmental receptors from direct contact with site-related hazardous substances and eliminate the ongoing release and threat of release of hazardous substances into the environment.
This notice is being provided under section 506(b) of HSCA. The administrative record, which contains the information that forms the basis and documents the selection of this response, is available for public review and comment. The administrative record is located at the Department's Northwest Regional Office, 230 Chestnut Street, Meadville, PA 16335 and is available for review Monday through Friday from 8 a.m. to 4 p.m. Telephone before hand for an appointment (814) 332-6648.
The administrative record will be open for comment from August 2, 2008, until October 31, 2008. Persons may submit written comments into the record during this time only, by sending them to James W. LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).
Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, shall also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a Site-Specific Standard remediation. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media; benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

Robbins, HDR Engineering, Inc., 609 Hamilton Mall, The Sovereign Building, Allentown, PA 18101-2111 submitted a Remedial Investigation Report (on behalf of his client, Lehigh Valley Industrial Park, 1805 East Fourth Street, Bethlehem, PA), concerning the investigation of site soils. The report was submitted in partial fulfillment of the Site-Specific Standard. A public notice regarding the submittal of the Remedial Investigation Report was published in The Express Times and The Morning Call on June 18, 2008.

A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media, benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by provisions of the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

46-0029D: Glasgow, Inc.--Springhouse Asphalt Plant--Quarry (Route 309 and Hartman Road, Montgomery, PA 18936) on July 16, 2008, to replace a secondary crusher and screen as well as consolidation and modification of a crushing plant upgrade approved under previously issued Plan Approvals 46-0029B and 46-0029C in Montgomery Township, Montgomery County. Fugitive dust emissions will be controlled by a newly designed wet (water spray) dust suppression system. The plant upgrade under this Plan Approval will improve operating efficiency by using about half the pieces of equipment than the previous production line. The facility shall be subject to the New Source Performance Standard for Nonmetallic Mineral Processing Plants (Subpart OOO). There shall be no fugitive emissions associated with this operation. The Plan Approval requires the monitoring of water pressure and flow rate on the wet dust suppression system. FEDERAL WATER POLLUTION CONTROL ACT SECTION 401 The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).
Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.
Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. Bank Stabilization Project along Laurel Run in Moreland Township, Lycoming County, United States Army Corps of Engineers, Susquehanna River Basin District (Hughesville, PA Quadrangle N: 10.3 inches; W: 3.2 inches).
The proposed project will stabilize approximately 840 linear feet of an embankment along SR 0442, Segment 0190 in Moreland Township, Lycoming County. The work area is approximately 4.2 miles straight line distance east northeast of Clarkstown. Approximately 3,745 tons of R-6 rock, 2,328 square yards of geotextile, 421 tons of R-3 rock and 266 tons of 2A sub base will be used to construct the project. Prior to installing the rock, the Department of Transportation expects to remove 1,420 cubic yards of existing material.
This project proposes to have a minimal impact on Laurel Run, which is designated a HQ-CWF. This project does not propose to impact any jurisdictional wetlands. This permit was issued under section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

Request for Variance The Department of Environmental Protection (Department), Bureau of Mine Safety (Bureau), has received a request for variance from Kimmel's Mining, Inc. The following notification contains a summary of this request. A complete copy of the variance request may be obtained from Cathy Dunn by calling (724) 439-7469 or from the BMS web site at www.depweb.state.pa.us/deepminesafety/site/default.asp.
The Department is publishing a summary of the request in order to solicit comments from affected parties on the proposed variance request. Comments may be used by the Bureau to assist in its investigation of the variance request. Comments will be accepted for 30 days following the publication of this notice. Section 1402 of the Pennsylvania Anthracite Coal Mine Act (52 P. S. § 1402), provides a mechanism for operators to obtain variances from specific requirements of the Act to accommodate the adoption of new machinery, equipment, tools, supplies, methods or processes.
Section 1118(a) (Voltage restriction) states that motors of electrical face equipment shall not be operated at higher than medium voltage.
Summary of the Request: Kimmel's Mining, Inc. requests a variance that approves the use of electrical face equipment at a potential greater than 650 VAC but not exceeding 1,000 VAC nominal voltage at the Williamstown No. 1 Mine.
