Patricia and Raynard Spaide, Petitioners v. Ira Troy Huntington, Jr., Respondent; Doc. No. 0001-97-07
[38 Pa.B. 4960]
[Saturday, September 6, 2008]On July 30, 2008, the Secretary of the Commonwealth issued an adjudication and order in the matter of Patricia and Raynard Spaide, Petitioners v. Ira Troy Huntington, Jr., Respondent. After notice and opportunity for a hearing under 13 Pa.C.S. § 9518(d) (relating to claim concerning inaccurate or wrongfully filed record), the Department of State (Department) has determined that a financing statement filed in the Berks County Recorder of Deeds Office by Ira Troy Huntington, Jr., naming Patricia and Raynard Spaide as debtors, was fraudulently filed. The Department concluded that no rational basis exists under 13 Pa.C.S. § 9509 (relating to persons entitled to file a record) entitling Ira Huntington to file the initial financing statement and that Huntington filed the initial financing statement with intent to annoy, harass or harm Patricia and Raynard Spaide.
Individuals may obtain a copy of the adjudication and order by writing to Martha H. Brown, Assistant Counsel, Department of State, Office of Chief Counsel, 301 North Office Building, Harrisburg, PA 17120.
PEDRO A. CORTES,
Secretary
