PUBLIC WATER SUPPLY (PWS) PERMITS The Department of Environmental Protection has taken the following actions on applications received under the Pennsylvania Safe Drinking Water Act (35 P. S. §§ 721.1--721.17) for the construction, substantial modification or operation of a public water system.
Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary of the Board at (717) 787-3483. LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

PREAMBLE 2
The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).
Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, shall also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a Site-Specific Standard remediation. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media; benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

A work plan for conducting a baseline remedial investigation is required by provisions of the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

The final report demonstrated attainment of the Statewide Health Standard and the Site-Specific Standard, using pathway elimination and was approved on January 15, 2008.

The applicant is remediating the site to a combination of Statewide Health and Site-Specific Standards.

The Final Report demonstrated attainment of the Statewide Health Standard and was approved by the Department of Environmental Protection on January 14, 2008.

American Geosciences, Inc., 3925 Reed Boulevard, Suite 400, Murrysville, PA 15668 on behalf of Markovitz Enterprsies, Inc.--Flowline Division, 1400 New Butler Road, New Castle, PA 16107 has submitted a Risk Assessment Report concerning the remediation of site soil contaminated with cis-1,2-dichloroethene, trichloroethene, nickel, vinyl chloride and site groundwater contaminated with 1,1,2-trichloroethane, 1,1-dichloroethene, cis-1,2-dichloro- ethene, tetrachloroethene, trans-1,2-dichloroethene, trichloroethene, vinyl chloride and dissolved nickel. The Risk Assessment Report was disapproved by the Department of Environmental Protection on January 18, 2008.

To maintain a stone lined channel in Washington Township, Armstrong County, Pittsburgh ACOE District (East Brady, PA Quadrangle N: 8.17 inches; W: 16.58 inches, Latitude: 40° 55` 12"; Longitude: 79° 29` 42").
1. To construct and maintain approximately 78 linear feet of a UNT to the Allegheny River (WWF) upstream of an existing 60-inch culvert, by filling an unauthorized on-stream concrete basin. Portions of the concrete basin walls for a minimum depth of 2.5 feet below the proposed grade will be removed.
2. To construct and maintain approximately 94 linear feet of new channel just downstream of the existing 60-inch diameter culvert. The purpose of the new channel is to restore the aquatic habitat and fish passage from the Allegheny River (WWF) to the reach of the UNT extending upstream of the existing culvert.
3. To operate and maintain approximately 65 linear feet of the existing, grouted, stone-lined channel below the existing culvert.
4. To construct and maintain a flow diversion structure located downstream of the existing culvert, consisting of 6-inch thick slush grout impregnated with native stream bed material and an 11.75-inch high by 4.5-foot wide concrete diversion berm having five 3-inch wide by 4-inch deep weir slots located 15 feet downstream of the culvert, to distribute the base (normal) flow (80% to the new channel and 20% to the original channel).
5. To construct and maintain stream bank stabilization, including riparian vegetative plantings along the 362 linear feet of the total length of the watercourse affected by this project, in accordance with the approved plans.
6. To operate and maintain an approximately 0.11 acre pond in the floodway of a UNT to the Allegheny River along the project.

To restore a stream bank along Rolling Rock Creek in Ligonier Township, Westmoreland County, Pittsburgh ACOE District (Ligonier, PA Quadrangle N: 15.2 inches; W: 14.8 inches, Latitude: 40° 12` 32"; Longitude: 79° 13` 51"). To construct and maintain a low flow log frame channel block along Rolling Rock Creek (HQ-CWF) to restore the stream bank along this watercourse. Flood debris shall also be removed from Rolling Rock Creek at this location to restore the natural stream channel. The project site is located approximately 370 ft. from the confluence of this watercourse with the Loyalhanna Creek, on lands owned by Rolling Rock Farms.

The City of Philadelphia proposes the installation of an inflatable dam in the Rock Run Relief Sewer at 7th Street and Nedro Avenue and Crest gate in the trunk sewer of the CSO regulating structure at 1st Street and Ramona Avenue. The Department of Environmental Protection's (Department) review of the project and the information received has not identified any significant, adverse environmental impact resulting from this proposal. The Department hereby categorically excludes this project from the State Environmental Review Process.
