Proposed Programmatic Agreement With the Federal Highway Administration, Advisory Council on Historic Preservation and State Historic Preservation Officer for Delegation of Activities Under the National Historic Preservation Act

[Saturday, March 14, 2009]The Department of Transportation (Department) is hereby providing notice of a proposed Programmatic Agreement with the Federal Highway Administration, Advisory Council on Historic Preservation and State Historic Preservation Officer for delegation of activities to the Department under section 106 of the National Historic Preservation Act (16 U.S.C. § 470). Under the proposed agreement, the Department would be responsible for establishing whether there is an undertaking subject to section 106, establishing the Area of Potential Effect (APE), determining the eligibility of historic properties within the APE, and making findings of effect.
The proposed programmatic agreement can be viewed online at ftp://ftp.dot.state.pa.us/public/bureaus/BEQ/draftpa.pdf.

The Department will accept written comments postmarked no more than 30 days from the date of this notice.
