Availability of Technical Guidance

   Technical guidance documents are available on the Department of Environmental Protection's (Department) web site at http://www.depweb.state.pa.us (DEP Keywords: ''Technical Guidance''). The ''Final Documents'' heading is the link to a menu of the various Department bureaus where each bureau's final technical guidance documents are posted. The ''Draft Technical Guidance'' heading is the link to the Department's draft technical guidance documents.

   The Department will continue to revise its nonregulatory documents, as necessary, throughout 2009.

Ordering Paper Copies of Department Technical Guidance

   The Department encourages the use of the Internet to view and download technical guidance documents. When this option is not available, persons can order a paper copy of any of the Department's draft or final technical guidance documents by contacting the Department at (717) 783-8727.

   In addition, bound copies of some of the Department's documents are available as Department publications. Check with the appropriate bureau for more information about the availability of a particular document as a publication.

Changes to Technical Guidance Documents

   Following is the current list of recent changes. Persons who have questions or comments about a particular document should call the contact person whose name and phone number is listed with each document.

Draft Guidance

   DEP ID: 275-2101-009. Title: Waste Derived Liquid Fuels (WDLF). Description: The Department of Environmental Protection (Department) is proposing a revision to the technical guidance for the use of Waste Derived Liquid Fuels (WDLF). This proposed technical guidance document change, authorized under section 6.6(c) of the Air Pollution Control Act and 25 Pa. Code §§ 127.1 and 127.12(a)(5), will apply to owner/operator sources that switch from a virgin fuel to a WDLF. The technical guidance will also apply to a change from an existing WDLF to one of a different classification or to a change in the contaminant or physical property characteristics within a WDLF category that is substantially different than specified in a previously issued plan approval. The owners and operators of new and existing sources are required to obtain plan approvals under 25 Pa. Code Chapter 127.

   The objective of this technical guidance is to establish air quality permit review procedures for sources that use WDLF and to establish a method to classify WDLF for ease in permit review using minimum contaminant and physical property specifications. Waste oil fuel that does not exceed the specifications is termed ''on-specification waste oil fuel.'' Waste oil fuel that exceeds any specification level is termed ''off-specification waste oil fuel.'' The classification will be used in conjunction with the permit review requirements to identify the level of permit review required.

   The following changes will be considered to be modifications pursuant to 25 Pa. Code § 121.1:

   1.  A change from a virgin fuel to a waste derived liquid fuel or a virgin oil to which waste liquids or solids have been added or blended;

   2.  A change from a waste derived liquid fuel to one in a different classification; or,

   3.  A change in the contaminant or physical property characteristics within a waste derived liquid fuel category that is substantially different than specified in a previously filed plan approval application or occurring after July 1, 1972, at a previously unpermitted source. New sources as well as existing (pre-1972) or new (post-1972) modified air contamination sources are required to obtain 25 Pa. Code Chapter 127 plan approval.

   This revised technical guidance document contains updated classifications and definitions of waste derived and hazardous waste derived liquid fuels. In addition to defining the limits that classify waste derived liquid fuel as on-specification waste derived liquid fuel or off-specification waste derived liquid fuel, the requirements for toxic substances derived liquid fuels has been updated. Each applicant for a waste derived liquid fuel plan approval must submit, for each fuel supplier or waste stream, a completed supplemental form entitled Waste Derived Liquid Fuel, which will be used to determine the waste derived liquid fuel classification as defined in Section B of the technical guidance document (Addendum B).

   This technical guidance document also describes both general and specific permit review procedures, analytical and sampling reference techniques, total halogen screening, sample taking and retaining procedures, PCB/METALS/TX/Flash auditing procedures and WDLF content specifications. Written Comments: The Department invites written comments on the proposed change.
