Acceptance of Rulemaking Petition for Study

[Saturday, August 29, 2009]On August 18, 2009, the Environmental Quality Board (Board) accepted a rulemaking petition for study under 25 Pa. Code Chapter 23 (relating to Environmental Quality Board Policy for Processing Petitions--Statement of Policy). The petition, submitted by the Lycoming Creek Watershed Association, requests the redesignation of the main stem of Lycoming Creek (source to Long Run; and Long Run to the mouth; in Tioga and Lycoming Counties) from Cold Water Fishes (CWF) and Warm Water Fishes (WWF), respectively, to High Quality (HQ); and Roaring Branch (source to confluence with Lycoming Creek; Tioga County) from HQ-CWF to Exceptional Value (EV). Under 25 Pa. Code § 93.4d(a) (relating to processing petitions, evaluations and assessments to change a designated use), the Department of Environmental Protection (Department) is required to publish a notice of intent to assess candidate waters. The Department's assessment notice for Lycoming Creek and Roaring Branch will appear in a future issue of the Pennsylvania Bulletin.
