The applicant is requesting the right to purchase a maximum of 648,000 gallons per day based on a maximum flow rate of 450 gallons per minute from the United Water Company through an interconnection that will be constructed. LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995

PREAMBLE 1


Acknowledgment of Notices of Intent to Remediate Submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.908).

 Sections 302—305 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. Persons intending to use the Background Standard, Statewide Health Standard, the Site-Specific Standard or who intend to remediate a site as a special industrial area must file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site and a description of the intended future use of the site. A person who demonstrates attainment of one, a combination of the cleanup standards or who receives approval of a special industrial area remediation identified under the act will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.

 Under sections 304(n)(1)(ii) and 305(c)(2) of the act, there is a 30-day public and municipal comment period for sites proposed for remediation using a Site-Specific Standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area of the site. For the sites identified, proposed for remediation to a Site-Specific Standard or as a special industrial area, the municipality within which the site is located may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified. During this comment period, the municipality may request that the person identified as the remediator of the site develop and implement a public involvement plan. Requests to be involved and comments should be directed to the remediator of the site.

 For further information concerning the content of a Notice of Intent to Remediate, contact the environmental cleanup program manager in the Department regional office before which the notice appears. If information concerning this acknowledgment is required in an alternative form, contact the community relations coordinator at the appropriate regional office. Groundwater and soil has been impacted with the release of No. 2 fuel oil. The future use of the site will be the same.

Milton and Nancy Kreiser Property, North Annville Township, Lebanon County. Trimpi Associates, Inc., 1635 Old Plains Road, Pennsburg, PA 18073, on behalf of Milton and Nancy Kreiser, 2010 Boltz Lane, Lebanon, PA 17046 and State Farm Mutual Insurance Company, P. O. AIR QUALITY

PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS

NEW SOURCES AND MODIFICATIONS

 The Department of Environmental Protection (Department) has developed an ''integrated'' plan approval, State operating permit and Title V operating permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the public. This approach allows the owner or operator of a facility to complete and submit all the permitting documents relevant to its application one time, affords an opportunity for public input and provides for sequential issuance of the necessary permits.

 The Department has received applications for plan approvals and/or operating permits from the following facilities.

 Copies of the applications, subsequently prepared draft permits, review summaries and other support materials are available for review in the regional office identified in this notice. Persons interested in reviewing the application files should contact the appropriate regional office to schedule an appointment.

 Persons wishing to receive a copy of a proposed plan approval or operating permit must indicate their interest to the Department regional office within 30 days of the date of this notice and must file protests or comments on a proposed plan approval or operating permit within 30 days of the Department providing a copy of the proposed document to that person or within 30 days of its publication in the Pennsylvania Bulletin, whichever comes first. Interested persons may also request that a hearing be held concerning the proposed plan approval and operating permit. Comments or protests filed with the Department regional offices must include a concise statement of the objections to the issuance of the Plan approval or operating permit and relevant facts which serve as the basis for the objections. If the Department schedules a hearing, a notice will be published in the Pennsylvania Bulletin at least 30 days prior the date of the hearing.

44-03015A: First Quality Baby Products (97 Locust Road, Lewistown, PA 17044) for use of cleaning solvents for maintanence of the diaper/training pants production equipment in Lewistown, Mifflin County. Potential volatile organic compound (VOC) emissions from cleaning are estimated at 12 tons per year. The plan approval will include emission limits and work practice standards along with monitoring, recordkeeping and reporting requirements to ensure the facility complies with the applicable air quality regulations.

63-00955A: National Fuel Gas Supply Corp. (1100 State Street, Erie, PA, 16512) for installation of two new 2,370-bhp Caterpillar G3608 compressor units at their proposed Buffalo Compressor Station, in Buffalo Township, Washington County.

 In accordance with 25 Pa. Code §§ 127.44(b) and 127.45, the Department of Environmental Protection intends to issue a Minor Source Plan Approval to allow installation of two new 2,370-bhp Caterpillar G3608 compressor units at their proposed Buffalo Compressor Station, in Buffalo Township, Washington County. Best Available Technology at the facility will be met by control of emissions from the Caterpillar G3608 compressor units with CO/VOC oxidation catalysts, operation in conformance with manufacturer recommendations and good operating practices.

 Annual emissions from the proposed facility are estimated to be 32.04 tons of NO2, 13.73 tons of CO, 19.22 tons of VOC, 5.49 tons of formaldehyde and total emissions of 8.23 tons of HAPs. The proposed process units are subject to the applicable requirements of 25 Pa. Code Chapter 127, related to construction, modification, reactivation and operation of sources, 40 CFR 60, Subpart JJJJ and 40 CFR 63, Subpart ZZZZ. The Plan Approval contains appropriate emission limitations, testing, monitoring, recordkeeping, reporting requirements, and work practice standards.

OPERATING PERMITS


Intent to Issue Title V Operating Permits under the Air Pollution Control Act (35 P. S. §§ 4001—4015) and 25 Pa. Code Chapter 127, Subchapter G.

09-00014: Bake Rite Rolls—Division of Northeast Foods, Inc. (2945 Samuel Drive, Bensalem, PA 18020) for renewal of the Title V Operating Permit in Bensalem Township, Bucks County. The Bensalem facility manufactures hot dog and hamburger rolls and English muffins in ovens and griddles. The facility is a major source of Volatile Organic Compounds (VOC), due to ethanol (VOC) releases as product is baked. There are no control devices for sources operated at the facility. There are no new significant sources at the facility. The parts washer (Source ID 110) has been replaced with a parts washer which uses an aqueous based solvent. The new parts washer is therefore considered insignificant and not subject to the requirements of 25 Pa. Code § 129.63 (degreasing operations). Two Boilers, listed as Source ID 031 and 032, have been permanently removed and replaced with two small boilers. The maximum capacity of the new boilers is 1.68 mmBtu/hr, each. These boilers are exempt from plan approval requirements according to 25 Pa. Code § 1297.449(e) and are listed in Section G (Miscellaneous) of the permit as insignificant. The renewal contains all applicable requirements including monitoring, recordkeeping and reporting. The sources at this facility are not subject to Compliance Assurance Monitoring (CAM) under 40 CFR Part 64.


Intent to Issue Operating Permits under the Air Pollution Control Act (35 P. S. §§ 4001—4015) and 25 Pa. Code Chapter 127, Subchapter F.

46-00244: ACME Corrugated Box Co. (2700 Turnpike Drive, Hatboro, PA 19040-4219) for renewal of a non-Title V, State-only Operating Permit in Upper Moreland Township, Montgomery County. ACME Corrugated Box Comany operates a dual-fired, 21.4 mmBtu/hr Vapor Power boiler with a maximum potential to emit 19.20 tons of NOx per year. A cold degreaser (Source ID 100) was removed from the facility and therefore, has been removed from the renewal operating permit. This facility is categorized as a natural minor facility. The permit includes monitoring, recordkeeping and reporting requirements to address all applicable air quality requirements.

09-00139: Safety-Kleen Systems, Inc. (77 Towpath Road, Fairless Hills, PA 19030) for operation of a drum washing and solvent recovery facility in Falls Township, Bucks County. This action is an operating permit renewal for a non-Title V (Stage only) facility. The major sources of air emissions are two return/fill stations and six volatile organic liquid storage tanks. The renewal will include monitoring, recordkeeping and reporting requirements designed to keep the facility operating within all applicable air quality requirements.

23-00063: Department of Corrections—Chester State Correctional Institution (500 East 4th Street, Chester, PA 19013) for renewal of a non-Title V, State-only, Synthetic Minor facility in the City of Chester, Delaware County. The facility operates two 51 mmBtu/hr boilers, a 20 mmBtu/hr Boiler, two 1,500-KW emergency generators, a 200-KW generator, a fire pump and two parts washers. The facility has a potential to emit 23.2 tons of nitrogen oxides per year, 27.5 tons carbon monoxide per year, 70.1 tons of sulfur dioxide per year, 3.5 tons of particulate matter per year and 10.4 tons of volatile organic compounds per year. Monitoring, recordkeeping and reporting requirements have been added to the permit to address applicable limitations.

23-00051: Riddle Memorial Hospital (1068 West Baltimore Pike, Media, PA 19063) for operation of a Hospital Waste Incinerator, three boilers and five emergency generators in Middletown Township, Delaware County. The permit is a renewal for a Title V facility. The facility is required to have a Title V Operating Permit under 40 CFR Part 60, 62.14480. This renewal of the Title V Operating Permit does not authorize any increase in air emissions of regulated pollutants above previously approved levels. The facility is also subject to the requirements of 40 CFR Part 60, Subpart Ce. The Title V Operating Permit contains all applicable requirements including monitoring, recordkeeping and reporting.

S09-024: Friends Hospital (4641 Roosevelt Boulevard, Philadelphia, PA 19124) for operation of a hospital and health care facility in the City of Philadelphia, Philadelphia County. The facility's air emission sources include three 400 horsepower (HP) boiler firing No. 6 oil or natural gas, one 300 Btu/hr boiler firing natural gas, three 85-100 kilowatt (kw) emergency generators firing No. 2 oil, and one 15 kw emergency generator firing natural gas.

 The operating permit will be reissued under the Pennsylvania Code Title 25, Philadelphia Code Title 3 and Air Management Regulation XIII. Permit copies and other supporting information are available for public inspection at AMS, 321 University Avenue, Philadelphia, PA 19104.  Persons wishing to file protest or comments on the previous operating permit must submit the protest or comments within 30 days from the date of this notice. Any protests or comments filed with AMS must include a concise statement of the objections to the permit issuance and the relevant facts upon which the objections are based. Based upon the information received during the public comment period, AMS may modify the operating permit or schedule a public hearing. The hearing notice will be published in the Pennsylvania Bulletin and a local newspaper at least 30 days before the hearing.

PLAN APPROVALS


Receipt of Plan Approval Applications and Intent to Issue Plan Approvals, and Intent to Issue Amended Operating Permits under the Air Pollution Control Act (35 P. S. §§ 4001—4015) and 25 Pa. Code Chapter 127, Subchapter B And Subchapter F. These actions may include the administrative amendments of an associated operating permit.

PA 44-302-077: Pocono Medical Center (206 East Brown Street, East Stroudsburg, PA 18301) for modification to the existing emission limits for NOx and SOx from their existing boilers for their facility in East Stroudsburg Borough, Monroe County.

 In accordance with 25 Pa. Code §§ 127.44(a) and 127.45(a), the Department of Environmental Protection (Department) has received and intends to issue a Plan Approval to Pocono Medical Center (206 East Brown Street, East Stroudsburg, PA 18301) for their facility in East Stroudsburg Borough, Monroe County. This Plan Approval No. 44-302-077 will be incorporated into the company's Synthetic Minor Permit No. 45-00021 through an administrative amendment at a later date.

 Plan Approval No. 45-302-077 is for modification to the existing emission limits for NOx and SOx from their existing boilers. The company shall be subject to and comply with 25 Pa. Code § 123.41 for visible emissions. The company shall be subject to and comply with 25 Pa. Code § 123.22 for Sulfur Compound Emissions. The company is subject to NSPS Subpart Dc requirements. These limits will meet BAT requirements for this source. The Plan Approval and Operating permit will contain additional recordkeeping and operating restrictions designed to keep the facility operating within all applicable air quality requirements.

 Copies of the application, the Department's analysis and other documents used in the evaluation of the application are available for public review during normal business hours at Air Quality Program, 2 Public Square, Wilkes-Barre, PA 18711.

 Any person(s) wishing to provide the Department with additional information, which they believe should be considered prior to the issuance of this permit, may submit the information to the address shown in the preceding paragraph. Each written comment must contain the following:

 Name, address and telephone number of the person submitting the comments.

 Identification of the proposed permit No. 45-302-077.

 A concise statement regarding the relevancy of the information or objections to the issuance of the permit.

 A public hearing may be held, if the Department, in its discretion, decides that such a hearing is warranted based on the comments received. All persons submitting comments or requesting a hearing will be notified of the decision to hold a hearing by publication in the newspaper or the Pennsylvania Bulletin or by telephone, where the Department determines such notification is sufficient. COAL AND NONCOAL MINING ACTIVITY APPLICATIONS

 Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1—1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301—3326); The Clean Streams Law (35 P. S. §§ 691.1—691.1001); the Coal Refuse Disposal Act (52 P. S. §§ 30.51—30.66); The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1—1406.21). Mining activity permits issued in response to such applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P. S. §§ 4001—4015); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1—693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101—6018.1003).

 The following permit applications to conduct mining activities have been received by the Department of Environmental Protection (Department). A copy of the application is available for inspection at the District Mining Office indicated above each application. Where a 401 Water Quality Certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for the certification.

 Written comments or objections, or requests for an informal conference, or a public hearing, as applicable, on a mining permit application may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the address of the district mining office indicated above each application within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121—77.123 and 86.31—86.34 regarding notices of filing of permit applications, opportunity for comment, and informal conferences.

 Written comments or objections related to a mining permit application should contain the name, address and telephone number of persons submitting comments or objections; application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based.

 Requests for an informal conference, or a public hearing, as applicable, on a mining permit application, as provided by 25 Pa. Code §§ 77.123 or 86.34, must contain the name, address and telephone number of the requestor; the application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

 When a National Pollutant Discharge Elimination System (NPDES) number is listed, the mining activity permit application was accompanied by an application for an individual NPDES permit. The Department has made a tentative determination to issue the NPDES permit in conjunction with the mining activity permit, but the issuance of the NPDES permit is contingent upon the approval of the associated mining activity permit.

 For coal mining activities, NPDES permits, when issued, will contain effluent limits that do not exceed the technology-based effluent limitations. The proposed limits are listed in Table 1.

 For noncoal mining activities, the proposed limits are found in Table 2. Discharges from noncoal mines located in some geologic settings (for example, in the coal fields) may require additional effluent limits. If additional effluent limits are needed for an NPDES permit associated with a noncoal mining permit, then the permit description below specifies the parameters. The limits will be in the ranges specified in Table 1.

 More restrictive effluent limitations, restrictions on discharge volume, or restrictions on the extent of mining that may occur, will be incorporated into an NPDES permit when necessary for compliance with water quality standards and antidegradation requirements (in accordance with 25 Pa. Code Chapters 91—96).

 The procedures for determining the final effluent limits, using a mass-balance equation or model, are found in Technical Guidance Document 362-0600-001, NPDES Program Implementation—Memorandum of Understanding Concerning Water Quality Management, NPDES Program Implementation and Related Matters. Other specific factors to be considered include public comments and Total Maximum Daily Loads (TMDLs).

 Persons wishing to comment on an NPDES permit application should submit a statement to the Department at the address of the district mining office indicated previously each application within 30 days of this public notice. Comments received within the comment period will be considered in the final determinations regarding the NPDES permit applications. Comments must include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.

 The Department will also accept requests or petitions for a public hearing on NPDES permit applications, as provided in 25 Pa. Code § 92.61. The request or petition for a public hearing shall be filed within 30 days of this public notice and shall contain the name, address, telephone number and the interest of the party filing the request, and shall state the reasons why a hearing is warranted. A public hearing may be held if the Department considers the public interest significant. If a hearing is scheduled, a notice of the hearing on the NPDES permit application will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. In the case where a public hearing is held, the Department will consider comments from the public hearing in the final determination on the NPDES permit application.

32080101 and NPDES No. PA0262561. P&N Coal Co., Inc., P. O. Box 332, Punxsutawney, PA 15767, permit renewal for the continued operation and restoration of a bituminous surface mine in Banks Township, Indiana County, affecting 25.4 acres.  Department of Transportation, Engineering District 3-0 proposes to replace a single span concrete slab bridge with a single span concrete box culvert. The existing structure has a normal span of 7.76 feet, skew of 90°, an underclearance of 3.3 feet, and a low chord elevation of 422.92 feet. The proposed structure has a normal span of 7.0 feet, skew of 90°, an underclearance of 6.0 feet, and a low chord elevation of 421.67 feet. The proposed box culvert will impact approximately 85 feet of stream channel. The channel flow line drops nearly 6 feet in elevation, due to three concrete formed steps within the existing structure. These steps within the existing structure will result in a proposed box culvert slope of 7.3% and 50 feet of upstream channel slope changes. The culvert outlet elevation is bound by an existing private stream enclosure, which outlets into the Susquehanna River. The proposed structure will be located on the same horizontal and similar vertical alignment. The project will not impact any jurisdictional wetland. This project will not require mitigation. The project is located over Herrold Run, which is a Tributary to the Susquehanna River (WWF). The project is located in Union Township, Snyder County.

 Project proposes to breach and remove Marshalls Lake Dam across Pond Creek (HQ-CWF) for the purpose of eliminating a threat to public safety and restoring the stream to a free flowing condition. The project will restore approximately 2,500 feet of stream channel. The dam is located approximately 400 feet north of the intersection of SR 402 and US 209 (East Stroudsburg, PA Quadrangle Latitude: 41° 02` 37"; Longitude: -75° 07` 36").
