Changes to Technical Guidance Documents

Following is the current list of recent changes. Persons who have questions or comments about a particular document should call the contact person whose name and phone number is listed with each document.

Interim Final Technical Guidance—Substantive Revision

DEP ID: 258-2182-773. Title: Management of Fill. Description: This interim final modification separates Form FP-001 (Certification of Clean Fill) from the policy to be a stand-alone document to better accommodate future revisions to the form. Before clean fill that has been affected by a spill or release may be placed on a property, Form FP-001 must be provided to the Department certifying the origin of the fill material and results of analytical testing to qualify the material as clean fill. Concurrent with separating Form FP-001 from the policy, the Department has revised the form to be more informative and consistent with the Management of Fill policy. Although the Department is not soliciting formal comment on Form FP-001, interested persons may offer recommendations for improvements to the form for Department consideration. This technical guidance will be published as interim final with a 30-day comment period. Comments: Written comments should be submitted to Todd M. Wallace, Acting Director, Bureau of Waste Management, 14th Floor, Rachel Carson State Office Building, P. O. Box 8471, Harrisburg, PA 17105-8471. The Department will accept comments submitted by e-mail, but comments submitted by facsimile will not be accepted. A return name and address must be included in each e-mail transmission. Comments must be received by the Department by September 7, 2010. Contact: Questions regarding the draft technical guidance document should be directed to Peter Arnt, at parnt@state.pa.us or (717) 787-4325.

 Effective date: August 7, 2010.

Draft Technical Guidance—Substantive Revision

DEP ID: 257-3120-003. Title: Guidelines for Conducting Underground Storage Tank Facility Operations Inspections. Description: Storage Tank Regulations require periodic inspection of the operation of underground storage tank facilities. The purposes of the inspections are to determine if a facility's underground storage tanks have been installed and are being operated and maintained in accordance with Storage Tank Regulations. Third-party inspectors, certified by the Department, perform routine facility operations inspections. This guidance clarifies the procedures certified inspectors should follow when completing an underground storage tank facility operations inspection. Substantive revisions were made to the guidance to update the procedures Department-certified inspectors should follow when completing an underground storage tank facility operations inspection and to correlate with changes to the Storage Tank Regulations published on November 10, 2007, and December 26, 2009. Written Comments: The Department is seeking comments on the substantive revisions to draft technical guidance No. 257-3120-003. Interested persons may submit written comments on this draft technical guidance document by September 6, 2010. Comments submitted by facsimile will not be accepted. The Department will accept comments submitted by e-mail. A return name and address must be included in each e-mail transmission. Written comments should be submitted to Kris A. Shiffer, Department of Environmental Protection, Bureau of Waste Management, Division of Storage Tanks, Rachel Carson State Office Building—14th Floor, P. O. Box 8762, Harrisburg, PA 17105-8762 or kshiffer@state.pa.us. Contact: Questions regarding the draft technical guidance document should be directed to Kris Shiffer at (717) 772-5809 or kshiffer@state.pa.us.

Effective date: Upon publication of notice as final in the Pennsylvania Bulletin.

Draft Technical Guidance

DEP ID: 257-2300-001. Title: Underground Storage Tank Class A and Class B Operator Training Courses. Description: Storage Tank Regulations require that underground storage tank operators be designated by tank owners and trained as soon as practicable, contingent upon availability of approved training providers, but not later than August 8, 2012 (See Section 245.436 relating to operator training). There are three distinct classes of operators: Class A, B and C. Class A and B operators require formal training, testing and certification of training completion. Enactment of the Federal Energy Policy Act of 2005 requires states receiving funds under RCRA, Subtitle I to implement an underground storage tank operator training program. This guidance correlates with recent changes to Chapter 245 published on December 26, 2009, and will allow the Department to continue to receive Federal grants under Subtitle I. Written Comments: The Department is seeking comments on draft technical guidance No. 257-2300-001. O. Box 8762, Harrisburg, PA 17105-8762 or kshiffer@state. pa.us. Contact: Questions regarding the draft technical guidance document should be directed to Kris Shiffer at (717) 772-5809 or kshiffer@state.pa.us.

Effective date: Upon publication of notice as final in the Pennsylvania Bulletin.
