THE CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT

APPLICATIONS FOR NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS

 This notice provides information about persons who have applied for a new, amended or renewed NPDES or WQM permit, a permit waiver for certain stormwater discharges or submitted a Notice of Intent (NOI) for coverage under a general permit. The applications concern, but are not limited to, discharges related to industrial, animal or sewage waste, discharges to groundwater, discharges associated with municipal separate storm sewer systems (MS4), stormwater associated with construction activities or concentrated animal feeding operations (CAFOs). This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92 and 40 CFR Part 122, implementing The Clean Streams Law (35 P. S. §§ 691.1—691.1001) and the Federal Clean Water Act.

 For NPDES renewal applications in Section I, the Department of Environmental Protection (Department) has made a tentative determination to reissue these permits for 5 years, subject to effluent limitations and monitoring and reporting requirements in their current permits, with appropriate and necessary updated requirements to reflect new and changed regulations and other requirements.

 For applications for new NPDES permits and renewal applications with major changes in Section II, as well as applications for MS4 individual permits and individual stormwater construction permits in Sections IV and VI, the Department, based upon preliminary reviews, has made a tentative determination of proposed effluent limitations and other terms and conditions for the permit applications. These determinations are published as proposed actions for comments prior to taking final actions.

 Unless indicated otherwise, the Environmental Protection Agency (EPA) Region III Administrator has waived the right to review or object to proposed NPDES permit actions under the waiver provision in 40 CFR 123.24(d).

 Persons wishing to comment on an NPDES application are invited to submit a statement to the regional office noted before an application within 30 days from the date of this public notice. Persons wishing to comment on a WQM permit application are invited to submit a statement to the regional office noted before the application within 15 days from the date of this public notice. Comments received within the respective comment periods will be considered in the final determinations regarding the applications. Comments should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.

 The Department will also accept requests for a public hearing on applications. A public hearing may be held if the responsible office considers the public response significant. If a hearing is scheduled, a notice of the hearing will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. The Department will postpone its final determination until after a public hearing is held.

 The following effluent limitations are proposed for discharge to the receiving waters, Youghiogheny River, classified as a warm water fishery with existing and/or potential uses for aquatic life, water supply and recreation. The first existing/proposed downstream potable water supply is PA American Water's Beck Run intake, located on the Monongahela River, over 12 miles below the discharge point.

 The following effluent limitations are proposed for discharge to the receiving waters, known as Moon Run, which are classified as a warm water fishery with existing and/or potential uses for aquatic life, water supply and recreation. The first downstream potable water supply intake from this facility is the Moon Township Municipal Authority on the Ohio River.

 PA0002666, Amendment No. 1, Industrial Waste. NAICS Code 324 and 325, Sonneborn, Inc., 575 Corporate Drive, Suite 415, Mahwah, NJ 07430-2330. Facility Name: Sonneborn. This existing facility is located in Fairview Township, Butler County.

 Description of Proposed Activity: Amendment of an NPDES Permit for an existing discharge of treated industrial waste, treated stormwater and untreated stormwater from a producer of surface active agents. This amendment is providing an opportunity for the public and other interested parties, to comment on the site-specific ambient water quality criteria that are being proposed for the Bear Creek Area Chemical Site, as described as follows. The Cadmium limit at Outfall 010 along with the TRE special condition is also being removed. This is a major discharge.

 The receiving water is South Branch Bear Creek. The receiving stream is in State Water Plan 17-C and is classified for the following uses: warm water fishes, aquatic life, water supply and recreation. This discharge is not expected to affect public water supplies.

 The proposed effluent limits for Outfall 003 based on a design flow of n/a MGD.

 In addition, the permit contains the following major special conditions:

 • Chemical Additives.

 • Schedule of Compliance for Temperature.

 • Site-Specific Water Quality Criteria.

Site-Specific Water Quality Criteria

 Consideration of effluent limits and/or monitoring requirements in this permit for Benzene Metadisulfonic Acid (BDSA), Benzene Monosulfonic Acid (BSA), p-Phenol Sulfonic Acid (p-PSA), and Resorcinol were based onsite-specific criteria that were developed by AMEC Earth & Environmental (AMEC), a consultant to Beazer East, Inc. (Beazer East). The criteria have been developed with methodologies approved by the Department of Environmental Protection (Department). The development of site-specific criteria for these substances was announced in the Pennsylvania Bulletin (39 Pa.B. 2594, May 23, 2009) as part of a request by the Department for analytical test methods, data and pertinent scientific information since there are no EPA-approved analytical methods for benzene metadisulfonic acid, benzene monosulfonic acid and p-phenol sulfonic acid (sulfonates).

 Documentation to support the request was submitted to the Department on April 11, 2008 by Babst, Calland, Clements, and Zomnir, on behalf of Beazer East. These criteria apply to the sites that are located within an area approximately 60 square miles in size and that has been designated by the Department under the Hazardous Sites Cleanup Act (HSCA) as the ''Bear Creek Area Chemical Site'' (BCACS).

 Because water quality criteria had not been developed for the sulfonates or resorcinol by either the Department or the U.S. EPA, AMEC used the U.S. EPA's National guidelines to develop aquatic life water quality criteria as stated in 25 Pa. Code § 16.22. In addition, the Department developed ambient water quality criteria for the protection of human health for resorcinol as stated in 25 Pa. Code § 16.32. The following documentation was used to support the resorcinol human health criterion: Resorcino—Concise International Chemical Assessment Document 71, published under the United Nations Environment Programme, the International Labour Organization, and the World Health Organization 2006. The proposed ambient water quality criteria are in the following table:

 In the absence of an EPA approved analytical test method for the sulfonates and resorcinol, the Department is requiring that analytical laboratories apply for and obtain accreditation in accordance with 25 Pa. Code Chapter 252 prior to accepting and analyzing samples for analysis of these compounds. Therefore, the permittee may only rely on results received from a laboratory that has obtained accreditation for the sampling and analysis of sulfonates and resorcinol. Specific analytical requirements for the compounds are contained in the table that follows:
