09-00186: Kinder Morgan Bulk Terminals, Inc. (1 Sinter Lane, Fairless Hills, PA 19030) on April 7, 2011, is a non-Title V facility in Falls Township, Bucks County. The State-Only (Synthetic Minor) Operating Permit, No. 09-00186, has been amended to incorporate conditions from Plan Approval No. 09-0186B. This amendment allows for the implementation of self-unloading vessels where material dust emissions can be controlled by water suppression. The only pollutants of concern from this operation are PM and HAP emissions. In combination with the facility's Source ID 101 (Bulk Material Handling System), this operation has a potential-to-emit of 20.71 tons per year (TPY) for total PM, 9.75 TPY for PM-10, 3.09 TPY for PM-2.5, and 9.94 TPY for total HAP. The facility has site-wide potentials of 151.6 TPY for total PM, 42.2 TPY for PM-10, 8.0 TPY for PM-2.5, and 9.94 TPY for total HAP. PM emissions from the self-unloading vessels are controlled by primarily by water suppression, and in some cases covers on conveyors and enclosures around transfer points. The operating permit contains recordkeeping and operating restrictions designed to keep the facility operating within the allowable emissions and all applicable air quality requirements.

FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704.  To construct, operate and maintain 26.46 miles of 30" natural gas pipeline (Loop 317) within the West Branch of the Susquehanna River watershed (Warm Water Fishery). Construction of the pipeline loop will require forty-one (41) stream and eighty-eight (88) wetland crossings associated with the pipeline right-of-way (ROW) and access roads. All pipeline crossings shall be placed beneath streambeds and wetlands so there will be a minimum of 3 feet of cover between the top of the pipe and the lowest point in the streambed or wetland. Trench plugs or clay dikes shall be used at every waterway and wetland crossing to ensure the existing hydrology is not altered. The project is centered approximately 1 mile north of the Village of Monroeton in Bradford County. The 317 Loop will start N 41° 44` 5"; W 76° 45` 39" - terminate N 41° 42` 28"; W 76° 20` 4".

ENVIRONMENTAL ASSESSMENTS

Northwest Region: Watershed Management Program Manager, 230 Chestnut Street, Meadville, PA 16335-3481

EA25-052, Pennsylvania Department of Environmental Protection Northwest Regional Office, 230 Chestnut Street, Meadville, PA 16335. Currie Landfill Remediation, in Millcreek Township, Erie County, ACOE Pittsburgh District (Swanville, PA Quadrangle N: 42°, 5`, 55"; W: 80°, 8`, 5").

 The Pennsylvania Department of Environmental Protection Northwest Regional Office Hazardous Sites Cleanup Program has requested 401 Water Quality Certification for encroachments associated with the consolidation and capping of waste in place at the Currie Landfill site. The Currie Landfill site is bordered to the north by West 15th Street, to the east by Pittsburgh Avenue, to the northwest by Sellinger Avenue and to the south by Conrail railroad tracks. The site consists of three parcels of land, two currently owned by the Erie Drive-In Theater Corporation, referred to as parcels A and B; and one owned by UPS Freight, referred to as parcel C. The area that will be part of the remedial response will include the entirety of parcels A and B, and also include the northwest corner of parcel C.

 The proposed remediation will consolidate the landfill waste and place a two foot soil cap over the waste. This alternative will remove the waste from parcel A and a portion of parcel C to be incorporated with the waste in parcel B. A two foot soil cap would be placed over parcel B. Parcel A will be covered with clean fill followed by course aggregate for future land development opportunities. The northeastern area of the undeveloped landfill will serve as the constructed wetland stormwater detention basin. Waste will be removed from the stream banks and will be restored with a 25` riparian buffer. The waste and soil cap will be graded to a final slope of 1% crowned from the center of parcel B to the north and south into collection channels that will drain into the stormwater detention basin. Parcel A will slope 1% to the south and drain into the storm water detention basin. Parcel A will be an impervious surface and parcel B will have a vegetative cover. Operations and maintenance will be required by the landowners to maintain the landfill cap and to ensure the wetland stormwater detention pond operates properly.

 The proposed encroachments are: 1) to remove waste from the streambanks and associated floodplain of the West Branch of Cascade Creek for a length of approximately 700 feet, 2) to reconstruct and maintain streambanks, riparian area and stream channel for a length of approximately 700 feet, 3) to construct stormwater BMPs including associated outfalls within the floodway and floodplain of the West Branch of Cascade Creek and 4) to impact an unknown area of wetland if the wetland is located on top of waste that would be removed. The West Branch of Cascade Creek is a perennial stream classified as a warm water fishery and migratory fishery.

EROSION AND SEDIMENT CONTROL

 The Department of Environmental Protection (Department) approved the Greene County Municipal Waste Management Plan Revision on March 31, 2011. This plan revision approval contained conditions regarding the continued operation of the Greene County Recycling Facility.

 Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Key features of the Revision include updated municipal solid waste calculations, ongoing landfill disposal capacity, at the Greater Lebanon Refuse Authority, yard waste composting, and on going recycling options.
