NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs

 The State Conservation Commission has taken the following actions on previously received applications for nutrient management plans under 3 Pa.C.S. Chapter 5, for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits or NOIs for coverage under a general permit for CAFOs under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

LAND RECYCLING AND

PREAMBLE 2


The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907).

 Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P. S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

 For further information concerning plans or reports, contact the environmental cleanup program manager in the Department regional office under which the notice of receipt of plans or reports appears. If information concerning plans or reports is required in an alternative form, contact the community relations coordinator at the appropriate regional office. Ackerman Property, 1314 Detweiler Avenue, Hellertown Borough, Northampton County. Christopher A. Jacangelo, J. Rockwood & Associates, Inc., P. O. Box 1006, Easton, PA 18044-1006 has submitted a Final Report (on behalf of his client, David C. Ackerman, 2276 Jordan Road, Orefield, PA 18069), concerning the remediation of soil found to have been impacted by No. 2 fuel oil, which was discovered during the removal of an underground, fuel oil storage tank. The report was submitted in order to document attainment of the Residential Statewide Health Standard for soil. A public notice regarding the submission of the Final Report was to have been published in The Morning Call on July 15, 2011.

Austin's Auto Service, 1843 West Broad Street, Bethlehem City, Lehigh County. Scott Campbell and Andrew Gutshall, EarthRes Group, Inc., P. O. Box 468, Pipersville, PA 18947 have submitted a combined Remedial Investigation Report/Final Report (on behalf of their client, Austin's Auto Service, 1843 West Broad Street, Bethlehem, PA 18018), concerning the remediation of soil found to have been impacted by unleaded gasoline as a result of historical operations at a former gasoline station and the current auto service station. The combined report was submitted to document attainment of the Site-Specific Standard for soil. A public notice regarding the submission of the combined Remediation Investigation Report/Final Report was expected to be published in The Morning Call on July 22, 2011.

LAND RECYCLING AND

A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

Toby Kessler, Gilmore and Associates, Inc., 65 East Butler Avenue, Suite 100, New Britain, PA 18901 submitted a Final Report (on behalf of his client, GVH Coopersburg, L.P., 323 Union Street, Suite 300, Nashville, TN 37201), concerning the remediation of groundwater found to have been impacted by volatile organic substances possibly related to a cesspool associated with historical operations at this former automobile service center. The report documented attainment of the Residential Statewide Health Standard for groundwater and was approved on July 18, 2011.

Southcentral Region: Environmental Cleanup Program Manager, 909 Elmerton Avenue, Harrisburg, PA 17110.

Boward Residence, 4020 Locust Lane, Harrisburg, PA, Lower Paxton Township, Dauphin County. Skelly and Loy, Inc., 449 Eisenhower Boulevard, Suite 300, Harrisburg, PA, 17111, on behalf of June Boward, 4020 Locust Lane, Harrisburg, PA 17109, submitted a Final Report concerning the remediation of site soils and groundwater contaminated with No. 2 fuel oil. The Final Report demonstrated attainment of the Residential Statewide Health standard, and was approved by the Department on July 18, 2011.

Former Allison Hill Automotive Property, 47 South 14th Street, City of Harrisburg, Dauphin County. Skelly & Loy, Inc., 449 Eisenhower Boulevard, Harrisburg, PA 17111, on behalf of the Redevelopment Authority of the City of Harrisburg, PO Box 2157, Harrisburg, PA 17105-2157, submitted a Remedial Investigation Report concerning remediation of site soils contaminated with VOCs, PAHs and inorganics. The Report was approved by the Department on July 19, 2011. The site will be remediated to a combination of Non-Residential Statewide Health and Site-Specific standards.

Oak Knoll Estates, Lot 36, 36 Oak Knoll Estates, Elizabethtown, PA 17022 Conewago Township, Dauphin County. Brownfield Associates, Inc., 500 Coatesville Road, West Grove, PA 19390, on behalf of PCS Chadaga (dba, Oak Knoll Estates) c/o Property Management, Inc., 1300 Market Street, Lemoyne, PA 17043, submitted a Final Report concerning remediation of site soils contaminated with No. 2 fuel oil. The Final Report demonstrated attainment of the Residential Statewide Health standard, and was approved by the Department on July 20, 2011.

Monitoring and recordkeeping requirements were added to Source ID No. 110 to demonstrate compliance with the applicable limits on the source.

 The facility's major emission sources include the boilers (controlled by an ESP), rerun unit charge heater 2, crude unit vacuum heater, resin heater, No. 2 Earth Burner (controlled by a scrubber), emergency fire pumps and compressors, storage tanks (controlled by a flare), plant wide-fugitive emissions, wastewater treatment, propane deresiner unit (controlled by a flare), degreasers, flue gas holder, coal unloading, and flyash loading. The facility is a major facility due to its potential to emit Nitrogen Oxides (NOx), Sulfur Oxides (Sox), and Volatile Organic Compounds (VOCs). The facility is subject to the Title V Operating Permit requirements adopted in 25 Pa. Code Chapter 127, Subchapter G.  2. Construct and maintain a two lane 39.3 ft. wide, 36.7 ft. long, single span bridge, skewed 60 degrees, having a total length of 47 ft. and a minimum underclearance of 3.3 ft. over an unnamed tributary of East Branch Coxes Creek (WWF) with a drainage area of 3.08 square miles. This bridge is located 0.3 miles east of the above culvert crossing in Somerset Borough (Somerset, PA Quadrangle, N: 3.3. inches, W: 11.3 inches; Latitude: 40° 1` 5" and Longitude: 79° 4` 52").

 3. Construct and maintain 130` of a relocated portion of an unnamed tributary to East Branch Coxes Creek (WWF).

 4. Construct and maintain a road crossing over a wetland, consisting of three (3) 42" x 29" CMPA pipes (depressed 1`) and eight (8) 12" CMPA pipes.

 5. Construct and maintain multiple roadway storm- water outfalls.

 The project will impact a cumulative total of 0.37 acres of PEM/PSS wetland and approximately 416' of watercourse, in the East Branch Coxes Creek basin. Wetland mitigation will be provided at PennDOT's Louie Beach Advanced Wetland Compensation Site, Somerset County (Somerset, PA Quadrangle, N: 3.3 inches, W: 11.5 inches; Latitude: 40° 1` 13" and Longitude: 79° 4` 54"). Approximately 435` of stream mitigation will be provided, in and near the project area.

To place and maintain fill in 0.01 acres of PFO and 0.24 acres of PEM wetlands, associated temporary crossings of Little Daniels Run (TSF), improve an existing ford crossing of Little Daniels Run, and high flow stream diversions of unnamed tributaries to Little Daniels Run with drainage areas of less than 100 acres for the purpose of constructing and maintaining a 5.0 acres wetland compensation site located in State Game Land 297 (Amity, PA Quadrangle, N: 0.7 inches; W: 15.0 inches; Latitude: 40° 4` 53" and 80° 7` 56"); North Bethlehem Township, Washington County.

E65-939. Ligonier Township Supervisors, 1 Municipal Park Drive, Ligonier, PA 15658. To construct and maintain a Truss Pedestrian bridge having a clear span of 90 feet and an underclearance of 11.5 feet on the existing concrete abutment of an abandoned railroad bridge across Mill Creek (CWF) as part of the new Ligonier Valley Trail System. The project is located in Ligonier Township, Westmoreland County (Ligonier, PA Quadrangle N: 22.5 inches; W: 15.25 inches; Latitude: 40° 14` 56"; Longitude: 79° 14` 03") in Ligonier Township, Westmoreland County.

E25-727A, Erie-Western Pennsylvania Port Authority, 208 E Bayfront Pkwy, Ste 201, Erie PA 16507-2413, Seaway Trail Roadway along Presque Isle Bay, Lake Erie in the City of Erie, Erie County, United States Army Corps of Engineers, Pittsburgh District (Erie North, PA Quadrangle Latitude: 42° 7` 50"; Longitude: 80° 6` 2").

 Permit No. E25-727 which authorizes the Erie-Western Pennsylvania Port Authority to construct and maintain a roadway and associated features between Walnut and Cherry Streets north of the Bayfront Parkway resulting in approximately 6,933 square feet of permanent and 9,061 square feet of temporary impacts within Presque Isle Bay, Lake Erie, in the City of Erie, Erie County is amended to modify the project eliminating the originally proposed soldier pile wall and sidewalk in favor of a rock riprap slope along the shoreline and modify the roadway to consist of a 12-foot wide, one-way, westbound roadway, with twenty-eight (28) 12-foot wide adjacent parallel parking spaces on the south side of the facility, and a 12-foot wide shared pedestrian/bike path on the north side of the facility. The curb-to-curb width of the facility with rain gardens, oil/grit separators and landscaping as originally permitted will be unchanged. The project will include the construction and maintenance of the originally authorized 12-foot wide by 50-foot long permanent, handicapped-accessible fishing pier and demolition of existing dock structures in Presque Isle Bay. The total disturbance within Presque Isle Bay will remain unchanged.

E42-299A, Bradford Economic Development Corp., P. O. Box 490, 20 Russel Boulevard, Bradford, PA 16701. Lafferty Hollow Industrial Park - Major Amendment, in Foster Township, McKean County, ACOE Pittsburgh District (Derrick City, PA Quadrangle N: 41°, 57`, 32.3"; W: -78°, 35`, 51.2").

 To amend Permit No. E42-299 which authorized Bradford Economic Development Corporation to conduct various stream and wetland impacts associated with the construction of Lafferty Hollow Industrial Park, a 350-acre industrial park in five phases including building pads and access roads along Lafferty Hollow Road in Foster Township, McKean County. The permit is amended to include construction and maintenance of an extension of existing sewer and water lines along Lafferty Hollow Road Crossing Kendall Creek, a sub-channel of Kendall Creek and a tributary to Kendall Creek for a total of 3 crossings.

E61-293, Cornplanter Township, 138 Petroleum Center Road, Oil City, PA 16301. T-560 Waitz Road Across Cherrytree Run, in Cornplanter Township, Venango County, ACOE Pittsburgh District (Oil City, PA Quadrangle N: 41°, 28`, 52"; W: 79°, 41`, 46").

 To remove the existing bridge and to construct and maintain a 19.3-foot long prestressed concrete spread box beam bridge having a clear, normal span of 64 feet and an underclearance of 10 feet across Cherrytree Run at the confluence with Oil Creek on a new alignment shifted approximately 15 feet downstream resulting in the placement of fill within the mapped 100-year flood plain and floodway of Oil Creek beginning approximately 100 feet south of S.R. 8 and extending downstream along the right bank approximately 550 feet on T-560, Waitz Road.

EA17-010. EQT Gathering, LLC, EQT Plaza, 625 Liberty Avenue-Suite 1700, Pittsburgh, PA 15222. Concrete Road Removal and Site Restoration of Jack Dents Branch-Medix Run, Goshen Township, Clearfield County, ACOE Baltimore District

 The applicant proposes to remove an existing concrete road crossing Jack Dents Branch, Medix Run, to restore the natural stream channel cross-section, profile and stability. As proposed, the restoration of the stream channel section shall include but not be limited to, construction of a temporary rock construction access along the stream left and right over-bank, complete removal of the 12-foot (wide) by 18-foot (long) concrete slab, and stabilization of stream bank along both stream banks that were affected by the concrete road section. Construction of the temporary access road shall be with clean AASHTO rock with minimal Number 1 gradation. Upon completion of the concrete slab removal, the temporary construction access road shall be completely removed with the area graded, scarified, and vegetative cover established to good condition. The concrete slab road section shall be completely removed from the stream channel, floodway and floodplain. Removal of the slab shall be completed in dry work conditions by dam and pumping, fluming or diverting stream flow around the work area. The concrete slab and its encased pipes shall be properly disposed. Since Jack Dents Branch is both a wild trout and stock trout fishery, no in-stream activity shall be conducted in or along the stream channel between October 1 to December 31 and March 1 to June 15 without prior written approval from the Pennsylvania Fish and Boat Commission. The project is located along the northern right-of-way of Jack Dent Road approximately 1.8-miles east of Medix Grade Road and Jack Dent Road intersection. This approval under Chapter 105, Section 105.12(a)(11) also includes 401 Water Quality Certification.

Notice of Requirements
The Covered Device Recycling Act—
Act 108 of 2010 (CDRA)

 This notice provides information about the requirements of the CDRA.

 Electronic products constitute one of the fastest growing streams of today's consumer and commercial waste. On November 23, 2010, the Pennsylvania General Assembly passed the Covered Device Recycling CDRA; which establishes a number of requirements for individuals and entities involved throughout the life cycle of certain ''covered'' electronic devices. Covered devices include desktop computers, laptop computers, computer monitors, computer peripherals and televisions.

 Beginning January 1, 2012, most of the CDRA requirements go into effect. Outlined below, these requirements address the manufacture, sales, and end-of-life collection, management and recycling of covered devices in Pennsylvania.

 Manufacturers of covered devices offered for sale in Pennsylvania:

 • Beginning January 1, 2012, must annually register their covered device brands with DEP, and affix brand labels to their new covered devices.

 • Must establish and conduct ongoing recycling programs that offer no cost covered device collection opportunities to consumers. No cost means no fee may be charged unless a financial incentive, such as a coupon or rebate, of equal or greater value is provided. The devices collected through these programs must be properly recycled at certified electronics recycling facilities.

 • Must report covered device collection and recycling data to DEP annually.

 Retailers that offer covered devices for sale in Pennsylvania:

 • Beginning January 1, 2012, may only sell covered devices that are labeled with a brand registered with DEP.

 • Must notify customers of how and where they can recycle their covered devices.

 • Are not required to offer covered device collection opportunities; but if they do, they must offer them to consumers at no cost. No cost means no fee may be charged unless a financial incentive, such as a coupon or rebate, of equal or greater value is provided. Any devices collected from consumers must be properly recycled at certified recycling facilities.

 Electronics Recycling Facilities:

 • Whether located in or outside of Pennsylvania, facilities that process or recycle covered devices that are collected from consumers through any electronics collection program in Pennsylvania, whether municipal, manufacturer, retailer, etc., must have achieved and maintained one of the following certifications:

 • R2 (Responsible Recycling Practices Standard) Certification,

 • e-Stewards Certification,

 • An internationally accredited third-party environmental management standard for the safe and responsible handling of covered devices.

 • Current PA Residual Waste Regulations, requiring electronics processing/recycling facilities that are located in Pennsylvania to obtain a DEP general permit #WMGR081 (regarding the processing and beneficial use of electronic equipment and components by sorting, disassembling or mechanical processing) prior to processing any electronic devices or electronic waste, remain in effect.

 Haulers and Transfer Stations:

 • Covered devices that are collected from consumers through electronics collection programs in Pennsylvania may only be recycled at certified electronics recycling facilities.

 The PA Department of Environmental Protection (DEP):

 • Will post and maintain a list of registered and non-compliant covered device brands on its website for retailers and consumers to access.

 • Will also post on its website and make available via its toll-free recycling hotline (1-800-346-4242) an up-to-date list of all covered device collection opportunities offered to consumers, including those offered by manufacturers and retailers.

 • Will review manufacturers' covered device collection and recycling plans, and will oversee the implementation of all approved plans to ensure compliance with the CDRA.

 • Will encourage the use of existing covered device collection infrastructure to the extent that it is cost effective, and is environmentally sound.

 • Will organize and coordinate public education and outreach regarding the recycling of covered devices, including assisting retailers as necessary in the conduct of their public education and outreach efforts.

 Beginning January 24, 2013, a disposal ban on covered devices goes into effect in Pennsylvania. From this point forward, no person may dispose of a covered device, or any of its components, with their municipal solid waste. These devices and their components must be properly recycled and may not be taken to nor accepted by landfills or other solid waste disposal facilities for disposal. However, non-hazardous residuals of covered devices that are produced during the recycling of those devices by solid waste disposal facilities are excluded from the disposal ban. The effects of the disposal ban are outlined below.

 Consumers:

 • May not dispose of their covered devices with municipal waste.

 • Will need to take their covered devices to an electronics collection location for proper recycling, or place for curbside collection if a specific electronics collection program is offered.

 Businesses:

 • May not dispose of their covered devices with municipal waste.

 • Will need to recycle their covered devices.

 Landfills and Resource Recovery Facilities:

 • May not accept covered devices or their components for disposal. However, they may accept non-hazardous residuals produced during the recycling of covered devices.

 • Owners and operators of landfills will not be found in violation of the CDRA so long as they make a good faith effort to comply with the Act; post, in a conspicuous location at the facility, a sign stating that covered devices and their components will not be accepted; and notify, in writing, all collectors registered to deposit solid waste to the facility that covered devices and their components will not be accepted at the facility.

 Haulers:

 • May not intentionally accept covered devices for disposal from any source of waste, and may not knowingly commingle covered devices with waste destined for disposal.
