NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR
NPDES PERMITS FOR CAFOs

 The State Conservation Commission has taken the following actions on previously received applications for nutrient management plans under 3 Pa.C.S. Chapter 5, for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits or NOIs for coverage under a general permit for CAFOs under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

 Persons aggrieved by an action may appeal under 3 Pa.C.S. § 517, section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704 to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. Plan Description: The approved plan provides for Sanitary Sewer Service Extension for 1645, 1649, and 1651 Freemansburg Avenue, which Bethlehem Township submitted to the Department on August 4, 2011. The submission was found to be consistent with the planning requirements given in Chapter 71 of the Rules and Regulations of the Department.

 This Planning Module provides for the extension of Sanitary Sewer Service to three existing homes (1645, 1649, and 1651 Freemansburg Avenue) to connect to the existing Nancy Run Interceptor due to malfunctioning on-lot sewage disposal systems. The 1750 gpd of proposed sewage flows include those from four adjacent properties that may connect in the future.

 The Bethlehem Township Municipal Authority will prepare the design, obtain all the necessary permits, and pay up front, for the construction of the collection system.

 The individual property owners will be responsible for the installation of their own grinder pumps and the connection to the Service Mains located near their homes. The property owners will own, operate and maintain their individual grinder pump systems. Bethlehem Township is currently working on an On-lot Sewage Management Program, which will incorporate an Individual Grinder Pump Operations & Maintenance Program.

 Bethlehem Township Municipal Authority will acquire and pay for the access easements and permanent easements from the property owners in an effort to allow the Authority access to the sewer extension for maintenance.

 Sewage flows from the project will be conveyed and treated by the City of Bethlehem.

 The City of Bethlehem provides public water to the project area.

 It is the responsibility of Bethlehem Township to implement this 537 Planning Module Plan in accordance with the schedule contained in the Planning Module.

 Any required NPDES Permits or WQM Permits must be obtained in the name of Bethlehem Township Municipal Authority.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995

PREAMBLE 2


The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907).

 Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P. S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

David Everitt and Mark Ellis, MEA, Inc., 1365 Ackermanville Road, Bangor, PA 18013 have submitted a Final Report (on behalf of their client, William Besecker, 1211 Bush Road, Cresco, PA 18326), concerning the remediation of soil found to have been impacted by No 2 fuel oil as a result of a release from a 1,000-gallon underground storage tank, which had a broken return line. The report was submitted to document attainment of the Residential Statewide Health Standard for soil. A public notice regarding the submission of the Final Report was published in the Pocono Record on August 18, 2011.

Former New Jersey Zinc Company-West Plant, 1120 Mauch Chunk Road, Palmerton Borough, Carbon County. Mr. J. Mark Nielsen, ENVIRON International Corporation, 1760 Market Street, Suite 1000, Philadelphia, PA 19103 has submitted a Cleanup Plan (on behalf of his client, CBS Operations, Inc., 333 Wacker Drive, 27th Floor, Chicago, IL 60606), concerning the remediation of soil and groundwater found to have been impacted by VOCs, Semi-VOCs, and metals as a result of historical operations at this former zinc manufacturing plant. The plan was submitted in partial fulfillment of the Site-Specific Standard. A public notice regarding the submission of the Cleanup Plan was published in The Morning Call on May 19, 2011.

Hershey Trust Farm 15 Landfill, Hershey Road, Hershey, PA, South Hanover Township, Dauphin County. URS Corporation, 4507 North Front Street, Suite 200, Harrisburg, PA 17110, on behalf of Hershey Trust Company, 100 Mansion Road East, Hershey, PA 17033, submitted a combined Remedial Investigation, Risk Assessment, and Final Report concerning remediation of site soils contaminated with arsenic, VOCs, SVOCs, and pesticides. The combined report is intended to document remediation of the site to meet the Residential Statewide Health and Site Specific Standards.

Northwest Region: Environmental Cleanup Program Manager, 230 Chestnut Street, Meadville, PA 16335-3481

Former McInnes Steel Facility, City of Corry, Erie County. Urban Engineers, Inc., 1319 Sassafrass Street, Erie, PA 16501 on behalf of The Redevelopment Authority in the City of Corry, 1524 Enterprise Road, Corry, PA 16407 has submitted a Risk Assessment Report concerning remediation of site soils contaminated with Arsenic, Iron, and Lead. The report is intended to document remediation of the site to meet the Site-Specific Standard.

Southwest Region: Environmental Cleanup Program Manager, 400 Waterfront Drive, Pittsburgh, PA 15222-4745

Exxon Mobil Irwin Terminal (Former), North Huntingdon Township, Westmoreland County. Groundwater and Environmental Services, Inc. 800 Commonwealth Drive, Suite 201, Warrendale, PA 15086 on behalf of ExxonMobil Environmental Services Company, 1545 Route 22 East, Room CCM09E, Annandale, NJ 088010 has submitted a Final Report concerning the remediation of site soil and groundwater contaminated with leaded gasoline constituents.

Plans and reports required by the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

If information concerning a final report is required in an alternative form, contact the community relations coordinator at the appropriate regional office. The report documented attainment of a combination of the Statewide Health Standard for soil and the Background Standard for soil. The Final Report was approved on September 13, 2011. The report was originally submitted within 90 days of the release.

LTV Southside Parcel B1b, City of Pittsburgh, Allegheny County. Mr. Martin C. Knuth, Civil and Environmental Consultants, Inc. on behalf of the Urban Redevelopment Authority of Pittsburgh, 200 Ross Street, Pittsburgh, PA has submitted a Final Report concerning remediation of site soils on Parcel B1b of the Southside Works mixed use development that is contaminated with metals, volatiles and semi-volatiles. The Report Final was approved on September 8, 2011.

LTV Southside Parcel C3a, City of Pittsburgh, Allegheny County. Mr. Martin C. Knuth, Civil and Environmental Consultants, Inc. on behalf of the Urban Redevelopment Authority of Pittsburgh, 200 Ross Street, Pittsburgh, PA and Southside Works HB Associates, LP, 2705 South Water Street, has submitted a Final Report concerning remediation of site soils on Parcel C3a of the Southside Works mixed use development that is contaminated with metals, volatiles and semi-volatiles. The Report Final was approved on September 8, 2011.

 General Permit Numbered WMGR131 is for the beneficial use of carbonaceous wastes: (i) petroleum coke, (ii) uncontaminated and untreated wood chips generated during the pulp and/or paper making process, and (iii) other paper and wood industry wastes comprised of primarily wood fibers, and tire-derived fuel generated at the Glatfelter facility that is located in the Borough of Spring Grove, York County as alternative fuels to be combined with waste coal/coal for circulating fluidized bed (CFB) boilers at the facility. The resulting boiler ash generated by co-firing the approved alternative fuels is beneficially used as (a) structural fill, (b) soil substitute or soil additive, (c) at coal mining activity sites, (d) at abandoned surface mining sites, and (e) other beneficial uses. This residual waste general permit was issued by the Central Office on September 19, 2011.

Emissions from this facility are estimated to be 28.81 tons of NOx, 10.94 tons of CO, 47.52 tons of VOCs, 0.11 ton of SO2, 5.88 tons of HAPs and 1.81 tons of PM per year.
